SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Hire of operated and non-operated plant and small tools and equipment.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Supplies.
Rental.
Main place of delivery: Various sites within the boundaries of Caerphilly,
Rhondda Cynon Taff, Bridgend, Merthyr Tydfil, Vale of Glamorgan, Newport,
Monmouthshire and Torfaen.
NUTS code: UKL1.
II.1.3) The notice involves: The establishment of a framework agreement.
II.1.4) Information on framework agreement: Framework agreement with
several operators.
Number of participants to the framework agreement envisaged: 20.
Duration of the framework agreement: Duration in months: 48.
II.1.5) Short description of the contract or purchase(s): Caerphilly
County Borough Council are leading on an agreement for the Hire of
Operated and Non-Operated Plant. The agreement will be available to be
used by members of the Welsh Purchasing Consortium and other public sector
bodies, please note that Bridgend County Borough Council, Vale of
Glamorgan County Borough Council, Rhondda Cynon Taff County Borough
Council, Newport County Borough Council, Monmouthshire County Borough
Council, Torfaen County Borough Council and Merthyr Tydfil County Borough
Council have expressed an interest in using this framework arrangement.
The agreement is for 3 years with an option to extend for up to a further
12 months.
There are 3 lots which comprise of the following:
1. Lot 1 - Non Operated Plant;
2. Lot 2 - Operated Plant;
3. Lot 3 - Small Tools & Equipment;
Companies are required to express an interest in receiving a pre
qualification questionnaire at this stage of the procurement process. It
is the intention of the Caerphilly County Borough as the lead Authority to
apply a selection criteria for this pre qualification questionnaire, this
will then determine which successful suppliers will be invited to tender.
Please note the weightings attached to the various sections are contained
within the pre qualification questionnaire.
Pre qualification questionnaires will be issued up to the time limit for
receipt of requests for documents.

II.2.1) Total quantity or scope: There are 3 lots which comprise of the
following:-.
1. Lot 1 - Non Operated Plant;
2. Lot 2 - Operated Plant;
3. Lot 3 - Small Tools & Equipment;
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: (a) is
bankrupt or is being wound up, whose affairs are being administered by the
courts, who has entered into an arrangement with creditors or who is in
any analogous situation arising from a similar procedure under national
laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an
order for compulsory winding-up or administration by the courts or for an
arrangement with creditors or is the subject of any other similar
proceeding under national laws or regulations;
(c) has been convicted of an offence concerning his professional conduct
by a judgement which has the force of res judicata;
(d) has been guilty of grave professional misconduct proven by any means
which the contracting authorities can justify;
(e) has not fulfilled obligations relating to the payment of social
security contributions in accordance with the legal provisions of the
country in which he is established or those of the country of the
contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which he is
established or those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information
required under the provisions of the Directive on the criteria for
qualitative selection;

III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: (a) bank statement
and/or evidence of professional risk indemnity insurance;
(b) balance sheets or extracts of balance sheets;
(c) statement of turnover for a maximum of the last 3 years.
Pre-Qualification Questionnaires will be issued.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
(a) a list of works carried out over the last 5 years with certificates of
satisfaction;
(b) a list of principal deliveries effected or services provided in the
last 3 years and evidence of delivery;
(c) an indication of technicians or technical bodies involved;
(d) a description of technical facilities and measures used to ensure
quality;
(e) educational and professional qualifications of the supplier and staff
responsible for performing the contract;
(f) where appropriate, an indication of the environmental management
measures that would be applied when performing the contract;
(g) a statement of average annual manpower and number of staff in the last
3 years;
(h) a statement of tools, plant and equipment available to the supplier;
(i) details of any intended sub-contracting arrangements;
(j) where appropriate, samples, descriptions and photographs of products
and quality assurance certificates.

VI.3) ADDITIONAL INFORMATION: The contract will not be for any fixed
quantity of hire.
Annual Quantity requirements cannot be guaranteed for such items listed in
the pricing/ specification schedule as the Authorities on this framework
may hire from time to time.
Allocation of work will be based on the rates submitted. Initially
representatives of the Authorities will approach the supplier offering the
most competitive rate for a particular requirement. However if the company
is unable to supply, officers will contact the next most competitive
company and will follow this course of action until Authorities
requirements are met.
Welsh contracting authorities and entities in the public sector (as
defined in Directives 92/50/EE and 93/38/EEC as amended by 97/52/EC) such
as government departments, NHS bodies, agencies, local and emergency
authorities (police and fire), educational establishments, registered
charities and utilities that have a requirement in this arrangement.
Caerphilly County Borough Council wishes to establish a framework
arrangement with contractors for use by or on behalf of such contracting
entities.
