SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Strategic Partnership - Housing and Non-Housing Property Repairs and
Maintenance.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Works.
Realisation, by whatever means of work, corresponding to the requirements
specified by the contracting authorities.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The Contracting
Authority is seeking an innovative private sector partner or partners to
participate and invest in a new joint venture limited company or a joint
venture limited liability partnership.
The Contracting Authority will contract directly, by way of a works
agreement with the new joint venture limited company or a joint venture
limited liability partnership to provide (or arrange for the provision of)
a range of works, repairs and maintenance works to the Contracting
Authority’s housing and non housing stock.
The Contracting Authority is committed to delivering a quality, cost
effective and value for money service using recognised partnering
arrangements and intends that the partnering agreement will incentivise
successful performance and transparency of costs.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The partnering agreement between the
private sector partner or partners and the Contracting Authority and the
subsequent works agreement will be for a period of 10 years with an option
to extend for a period or succession of periods not exceeding 3 years in
total.
The works contract shall comprise, inter alia, the provision of a
multi-trade priority coded comprehensive service to the contracting
authority’s premises (both housing and non-housing stock). This shall
include normal response repairs, immediate response repairs, empty
property repairs, planned repair works and cyclical maintenance. The
reinstatement of fire damaged property, capital works and adaptations may
also be included.
Estimated value excluding VAT:
Range: between 300 000 000 and 390 000 000 GBP.
II.2.2) Options: Yes.
Description of these options: The partnering agreement between the private
sector partner or partners and the Contracting Authority and the
subsequent works agreement will be for a period of 10 years with an option
to extend for a period or succession of periods not exceeding 3 years in
total.
Pursuant to Regulations 14(1)(d) (ii) and 14(5) of the Public Contracts.
(Scotland) Regulations 2006 notification is given that contracts for new
work, works or services which would be a repetition of the work or works
carried out or the services provided under the contract(s) relating to
this notice may be awarded using the negotiated procedure in accordance
with Regulation 14(1)(d)(ii) (subject to the procedure for such award
being commenced within 3 years of relevant contract relating to this
notice being entered into).
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 156 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: The Contracting Authority
reserves the right to require deposits, guarantees, bonds or other forms
of appropriate security.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Details will be
specified within the Invitation To Tender documents.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Details of the required legal form
will be provided in the Invitation to Tender documents.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
The joint venture limited company or a joint venture limited liability
partnership and its supply chain will be required to actively participate
in the achievement of social, environmental and/or sustainability policy
objectives relating to local regeneration, social and economic growth,
recruitment, employment and training and supply chain initiatives.
Accordingly contract performance conditions and evaluation criteria may
relate in particular to social and environmental considerations. Details
will be set out in the Invitation To Tender documents.
The provision of repair and maintenance for the Contracting Authority's
housing and non housing stock is currently outsourced. It is anticipated
that the procurement to which this contract notice relates may require the
transfer of staff under the provisions of TUPE.
III.2) CONDITIONS FOR PARTICIPATION

relating to enrolment on professional or trade registers: Information and

accordance with Articles 45 to 50 of Directive 2004/18/EC and Regulations
23 to 35 of the Public Contracts (Scotland) Regulations 2006 and and as
set out in the pre-qualification questionnaire available from the web site
address in Section II.1.5.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: In accordance with
Article 47 of Directive 2004/18/EC and Regulations 24 of the Public
Contracts (Scotland) Regulations 2006 and and as set out in the
pre-qualification questionnaire available from the web site address in
Section II.1.5.

SECTION VI: COMPLEMENTARY INFORMATION
VI.3) ADDITIONAL INFORMATION: Requests to participate must be by way of
completion and return of the pre-qualification questionnaire (PQQ) by the
date and time specified in Section IV.3.4.
The PQQ and supporting documentation can be accessed from the Public

To access these documents candidates will firstly need to register, if
they have not already done so, on the Public Contracts Scotland web site
and then express interest in this particular procurement via the web site
link provided in Section II.1.5.
Completed PQQ documents should be returned hard copy only to the address
below no later than the time limit for receipt of requests to participate
provided in Section IV.3.4.

In order to proceed to the invitation to tender stage of this procurement,
candidates must satisfy minimum criteria in terms of their financial and
good standing. In addition candidates must achieve minimum criteria for
the scored elements of the PQQ, full details are provide in the PQQ
documentation. The invitation to tender list will be drawn from the PQQ
responses achieving the minimum criteria described above, with the five
highest scoring PQQ responses being selected to proceed to the invitation
to tender stage.
The Contracting Authority reserves the right not to award any contract as
a result of the procurement process initiated by this notice and in such
event will not be liable for any costs incurred by any party.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: North Lanarkshire Council will incorporate a minimum of
10 calendar day standstill period at the point of information on the award
of the contract is communicated to tenderers. This period allows
unsuccessful tenderers to seek further debriefing from the Contracting
Authority before the contract is entered into. Candidates have 2 working
days from the notification of the award decision to request additional
debriefing and that information has to be provided a minimum of 3 working
days before the expiry of the standstill period. Such additional
information should be required from the address in part 1.1 of this
Contract Notice.
