The approved budget for the contract is to be taken from the Gen. Fund. Bids received in excess of the ABC shall be automatically rejected at bid opening. Partial Bids are allowed.

In order to qualify, bidders should conform to the eligibility criteria as prescribed under Sec. 23.11 of the IRR-A of R. A. 9184.

Bidding will be conducted through open competitive bidding procedures using non-discretionary "pass/fail" criteria as specified in the IRR-A of R. A. 9184. As such non-submission of the required documents will result in the disqualification of the bidder.

The following documents are required for submission:

A. ELIGIBILITY DOCUMENTS:

1. DTI or SEC Certificate of Registration
2. Valid and current Mayor's permit/municipal license;
3. License to Operate (BFAD);
4. Certificate of Product Registration (C.P.R.)
5. BIR Registration Certification w/c contains the Taxpayer's Identification Number (TIN);
6. Statement that bidder is not blacklisted or barred from bidding by the Government or any of its agencies;
7. Tax Clearance Certificate issued by the BIR main office;
8. Certificate of Registration in the Philippine Government Electronic Procurement System (PhilGeps) issued by the Department of Budget and Management Procurement Service;
9. Statement of the bidder of all its ongoing and completed government and private contracts or purchase orders within the relevant period, where applicable, including contracts awarded but not yet started, if any. The statement shall state for each contract whether said contract is ongoing, completed or awarded but not yet started, within the relevant period where applicable. The statement shall include for each contract, the following:
a. the name of the contract
b. date of the contract
c. kinds of good sold
d. amount of contract and value of outstanding contracts
e. date of delivery
f. end user's acceptance, if completed, and
g. specification whether bidder is a manufacturer, supplier or distributor;

10. Audited financial statements, stamped "RECEIVED" by the BIR or its duly accredited and authorized institutions, for the immediately preceding calendar year, showing, among others, the bidder's total and current assets and liabilities;
11. The bidders computation for its Net Financial Contracting Capacity (NFCC) which shall be in accordance with Sec. 23.11 of the IRR-A of R. A. 9184; or
a commitment from a licensed bank to extend to it a credit line if awarded the contract to be bid; or a cash deposit certificate, in an amount not lower than that set by this City in the bidding documents, which shall be at least equal to 10% of the approved budget for the contract to be bid;
12. Valid joint venture agreement, in case of a joint venture;
13. Registration Certificate with the Cooperatives Development Authority (CDA), in case of Cooperatives;
14. Letter authorizing the BAC or its duly authorized representatives to verify any or all of the documents submitted for the eligibility check;
15. Sworn statement that each of the documents submitted in satisfaction of the eligibility requirements is an authentic and original copy, or a true and faithful reproduction or copy of the original, complete, and that all statements and information provided therein are true and correct.

B. TECHNICAL DOCUMENTS:

1. The Bid Security as to form, amount and validity period;
2. Authority of the signatory;
3. Production/Delivery schedule;
4. Manpower Requirements;
5. After-sales service/parts, if applicable;
6. Technical Specifications with brochures;
7. A sworn affidavit that the bidder is not related to the head of the procuring entity by consanguinity or affinity up to the third civil degree, or and to the same degree of any of the procuring entity's officers or employees having direct access to information that may substantially affect the result of the bidding.

C. FINANCIAL DOCUMENTS:

1. Bid prices in the Bill of Quantities
2. The recurring and the maintenance costs, if applicable

All bids shall be accompanied by a Bid Security, payable to the City of Bais, in any of the following schedule:

Bids and Bid Securities shall be valid for a reasonable period as determined by the head of the procuring entity, but in no case shall exceed 120 calendar days from the date of the opening of bids.

Performance security and warranty shall be governed by the provisions of Secs. 39 and 62, respectively, of the IRR-A of R. A. 9184.

Bid documents can be obtained upon payment of a non-refundable fee equivalent to the total amount of the ABC of the items in which interested bidders intend to bid, in accordance with the following rates:
Below P 50,000.00 - 0.5% but not less than P 100.00

P 50,000.00 but not more than P 100,000.00- 0.45% but not less than P 250.00

P 100,001.00 but not more than P 200,000.00- 0.4% but not less than P 450.00

P 200,001.00 - P 350,000.00 - 0.35% but not less than P 800.00

P 350,001.00 - P 500,000.00 - 0.3% but not less than P 1,225.00

P 500,001.00 - P 1,000,000.00 - 0.2% but not less than P 1,500.00

P 1,000,001.00 and above - 0.1% but not less than P 2,000.00
and not more than P 10,000.00

Bid documents can be obtained at the BAC Secretariat c/o Office of the City Mayor or Office of the City General Services, this city, Tel. Nos. (035) 402-3182, or 402-8115, anytime during office hours; and can also be inquired for further information or particulars.

All other particulars relative to the procurement process shall be governed by the Implementing Rules and Regulations of R. A. 9184 otherwise known as the Government Procurement Reform Act.

Eligibility, Technical and Financial documents shall be submitted together each in separate sealed envelopes duly marked as such on October 16, 2009 at the BAC Secretariat, Office of the City Mayor, this city, at 1:30 P. M. at which date, place, and time said envelopes shall be opened in the presence of the members of the BAC, the attending bidders, the observers, or their duly authorized representative. Late bids shall not be accepted.

The City Government of Bais reserves the right to accept or reject any bid, and to annul the bidding process and reject all bids at anytime prior to contract award, without thereby incurring any liability to the affected bidder or bidders.
