ACCESS, 2014 Organising Company, Glasgow City Marketing Bureau and also
other organisations which may be set up by Glasgow City Council during the
lifespan of this contract. Important - note regarding tender evaluation
procedure - This framework is being procured using the restricted
procedure to select the most economically advantageous tender (MEAT).
Normally this would involve selecting a number of economic operators to be
invited to tender based on evaluation of the Pre-Qualification
Questionnaires received, and then applying the MEAT criteria following
submission of full tenders to determine which operators should be
appointed to the panel of contractors to be establised under the
framework. On this occasion, officers of the contracting authority have
concluded that for the majority of the lots within the framework, it is
not possible to establish meaningful commercial criteria which would be
capable of evaluation at any stage prior to the mini-competition which
will be held in order to establish which contractor is awarded specific
contracts under the framework agreement. The contracting authority will
therefore not be seeking cost information at the ITT stage for the lots in
question, but will select economic operators to be appointed to the
framework on the basis of non-economic criteria, particularly technical
ability. Full MEAT evaluation criteria will then be applied at the point
of each mini competition to be held prior to the award of any specific
contract under the framework ensuring value for money is delivered against
each project. Full details of the procedure to be applied and the
safeguards which the contracting authority has built in to ensure no
economic operators will be prejudiced by this approach are contained in
the tender documentation. This procurement project will be carried out in
line with EU Directives relating to public procurement, demonstrating
transparency, openness and fairness at every stage of the process.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Glasgow City Council will incorporate a minumum 10
calendar day standstill period at the point of information on the award of
the contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
required from the procurement officer (see details in Section 1.1 of the
contract notice). If an appeal regarding the award of the contract has not
been successfully resolved The Public Contracts (Scotland) Regulations
2006 (ss1 2006 No. 1) provide for aggrieved parties who have been harmed
or are at risk of harm by a breach of the rule to take action in Sheriff
Court or Court of Session. Any such action must be promptly (general
within 3 months). Where a contract has not been entered into the Court may
order the settings aside of the award decision or order the Authority to
