În conformitate cu art. 40, alin. 1 din OUG 34/ 2006 cu modificarile si completarile ulterioare, (inclusiv OUG. 19 / 2009) "Autoritatea contractanta are obligatia de a asigura obtinerea documentatiei de atribuire de catre orice operator economic prin asigurarea accesului direct, nerestrictionat si deplin, prin mijloace electronice, la continutul documentatiei de atribuire". Documentul de plata a garantiei de participare la licitatie, împuternicirea de participare la deschiderea ofertelor si Scrisoarea de înaintare a ofertei (Formular 20) vor fi prezentate de ofertanti cel mai târziu la data si ora stabilite pentru deschiderea ofertelor; neprezentarea garantiei de participare la licitatie duce la respingerea ofertei în conformitate cu art. 33-3-b, din Hotarârea nr. 925/2006 cu modificarile ulterioare. Pentru I.M.M., dovada încadrarii în aceasta categorie se face cel mai târziu la data si ora stabilite pentru deschiderea ofertelor.
