II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Outsourcing of receipt of applications for visa and residence/work permits
and preliminary tasks.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.
Service category: No 27.
Main place of performance: The main places of performance will be in the
following 17 countries in Europe, Middle East, Asia and Africa:

If it turns out that no single service provider is able to offer his
services in all of the cities in China or Turkey mentioned above, it may
be necessary to sign more than one agreement covering China and Turkey,
respectively.
II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The Danish
Ministry of Foreign Affairs is inviting tenders for the provision of
services related to the receipt of applications for visa and
residence/work permits and preliminary tasks in connection with 20 Danish
missions in Europe, Middle East, Asia and Africa. Based on the numbers of
recent years, the estimated number of applications in the countries and
cities in scope will be approximately 100.000.
The call for tender is divided into lots. The Danish Ministry of Foreign
Affairs will sign one agreement for each of the countries mentioned in
section II.1.2. Tenderers may submit bids for one, more or all lots.
In the context of the present call for tender, it is of particular
importance for the Ministry that service providers offer a high level of
data security following the legislation and procedures of each individual
country and the Danish law on the protection of personal data. This
includes that the service provider shall be able to offer secured premises
following the legislation and procedures of each individual country. It
means that the service provider shall have efficient internal security
aimed at preventing fraud, but also a service oriented attitude towards
the applicants and respect for national, cultural and religious customs
and traditions.
Service providers must be able to assume responsibility for all tasks
prior to the actual handling of the applications and decision making, and
after the conclusion of the case. The services in scope for this
outsourcing comprise the following tasks:
— Setting up a homepage for information on Danish visa and residence
permit legislation and procedures or insertion of this information in
existing homepage,
— Training staff to handle applications for Danish visas and residence
permits,
— Receipt of visa applications and applications for residence permits,
— Receipt of the corresponding fees,
— Check of the completeness of the applications including annexed
documentation, including a check that the documentation has been issued by
the person, company or institution referred to,
— Booking of appointments for applicant interviews,
— Entering visa application data in a web-based application (Visa Self
Service) or transferring filled-in paper based applications to the mission
stated in the agreement with the service provider,
— Capture of biometric data (photographs of face and fingerprints),
— Electronic transfer of biometric data to a suitable point of reception
(via network or solid data transfer media),
— Transport of documents to and from the Danish mission specified in the
agreement with the service provider,
— Transfer of fees to the bank account of the mission as specified in the
agreement with the service provider,
— Handing out of passports and annexed documentation to the applicants,
— Answering telephone inquiries concerning rules and legislation on visas
and residence permits, application status etc.
The Ministry of Foreign Affairs will provide a web-based application to be
used by the service provider for entering the visa application data.
The Ministry of Foreign Affairs will provide equipment for capturing
biometric data.
The implementation of the web-based application and the biometric data
capture equipment will proceed in a series of phases beginning with a
limited number of pilot installations followed by a gradual roll-out.
Pilot installations are planned in London, Ankara, Istanbul and Bangkok
for immediate launching after signature of the agreements independently of
the availability of the web-based application and the biometric data
capture equipment.
The service provider will receive no payments from the Ministry of Foreign
Affairs or the Danish missions, but will be entitled to a fee of at most
30 EUR or equivalent in local currency from each applicant. The service
provider may offer additional services for a fee in agreement with the
mission specified in the contract. These services include photocopying,
passport photographs and courier service for delivery of passports and
documentation.

is regarded as a subsidiary of Moscow which must be covered by the

must transfer applications delivered in St. Petersburg to the Danish
Embassy in Moscow and return the envelopes containing the results of the
application procedure to the applicants in St. Petersburg.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: No deposits or guarantees
required.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Terms of financing
and payment are stated in the tender documents.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: If the contract is awarded a group of
suppliers, such group is required to undertake joint and several liability
and to authorise one supplier to represent the group.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: A solemn
declaration stating whether the candidate has fulfilled his obligations
relating to the payment of social security contributions and to the
payment of direct and indirect taxes in accordance with the legal
provisions in the country in which the candidate is established and in
Denmark.
As an alternative to a solemn declaration a report from the Danish
Commerce and Companies Agency may be submitted. Foreign candidates
submitting an equal report from their country should also submit a solemn
declaration regarding obligations in Denmark.
If a bid is submitted from a group of candidates, each candidate must
submit the above-mentioned declarations.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: A statement of the
undertaking's overall turnover and - if publication hereof is possible
according to the accounting standards of the candidate - a statement of
turnover in the area covered by the contract for a maximum of the last
three financial years available, depending on the date on which the
undertaking was set up or the economic operator started trading, as far as
the information on these turnovers is available.

VI.3) ADDITIONAL INFORMATION: 1) On account of the nature of the services
included, the contract is considered a public service contract as listed
in Annex II B. Contracts which have as their object services listed in
Annex II B shall be subject solely to Article 23 and Article 35(4), cf.
Article 21 of Directive 2004/18/EC. However, the Ministry of Foreign
Affairs is none the less bound to comply with the fundamental rules of the
Treaty in general and the principle of non-discrimination on the ground of
nationality in particular, that principle implying, in particular, an
obligation of transparency in order to enable the contracting authority to
satisfy itself that the principle has been complied with. That obligation
of transparency consists in ensuring a degree of advertising sufficient to
enable the services market to be opened up to competition and the
impartiality of procurement procedures to be reviewed.
2) Furthermore, chapter 6a in the Danish Law on tenders regarding public
contracts and contracts subsidised by contracting authorities
(Lovbekendtgørelse nr. 1410 af 7.12.2007 om indhentning af tilbud på visse
