Note: The Property Mortgaged to DFCC Vardhana Bank By: Tele-Pix (Pvt) Limited - a Company duly incorporated in the Democratic Socialist Republic of Sri Lanka under the Companies Act. No.17 of 1982 having its registered office at No. 146 Peradeniya Road, Kandy and Habaragamu Ralalage Nimal Nishantha Peiris of No.164 Peradeniya Road, Kandy have made default in payments due on Mortgage Bond No.1996 dated 13th November 1997 and attested by M M Jiffri Notary Public of Kandy.
Description of Property Mortgaged by Mortgage Bond No. 1996
(1) All that divided and defined portion of land marked Lot 1 bearing Assessment No.164 situated at Katukelle within the Town Municipality and District of Kandy Central Province.
Containing In Extent: A0:R0:P2.36 - (0.00598 Hectares)
Together with the buildings, plantations and everything else standing thereon.
(2) All that divided and defined portion of land marked Lot 2 bearing Assessment No.166 situated at Katukelle within the Town Municipality and District of Kandy aforesaid.
Containing In Extent: A0:R0:P2.48 - (0.00627 Hectares)
Together with the buildings, plantations and everything else standing thereon.

Auction Sale on Thursday 01st October 2009 at 3.30 pm at the spot.
Mode of Payment: The Successful purchaser will have to pay the following amounts in cash at the fall of the hammer. (1) 10% (Ten Percent) of the Purchased Price.
(2) 1% (One Percent) of the sales Taxes payable to the Local Authority.
(3) Auctioneer's Commission of 2 1/2% (Two and a half percent only) of the sold price.
(4) Total cost of advertising Rs.32,000.00
(5) Clerk's & Crier's Fee of Rs.500.00
(6) Notary's Fee for condition of Sale Rs.2000.00
The balance 90% of the purchased price together with any other statutory levies, duties, taxes or charges whenever applicable and imposed by the Government of Sri Lanka or any other authority to be payable within 30 days from the date of sale.

Conditions of Sale: (1) The highest bidder becomes the purchaser. Should any dispute arise between two or more bidders the lot will be put up again and re-sold.
(2) A deposit of 50 percent (50%) to be made on each lot if required, at the time of sale.
(3) All lots to be at the risk of the purchaser from the time of purchase, and no lot can be delivered while the sale is proceeding.
(4) Should any mistake be made in describing a lot such mistake will not be held to vitiate or effect the sake if such lot in anyway – it being understood that intending purchasers will satisfy themselves on all points before bidding and no allowance will be made for imperfections discovered after the lots are knocked down.
(5) No goods to be removed without the sanction of the Auctioneer. Any person removing any portion of the property without an order from the Auctioneer will be subject to an action at law.
(6) Purchasers will bear all expenses of taking down and removing all lots purchased and shall make good any unnecessary damage which may be caused thereby.
(7) Notice- Servant’s bids will not be taken unless they produce an authority from their masters prior to the sale.
(8) All articles must be paid for before delivery and removed immediately after the sale, otherwise they will be resold by public or private sale at the risk of the purchaser who will not be entitled to claim any surplus if any, at such re-sale will be liable for any deficiency.
(9) The Auctioneer to have the option to refuse any bids.
(10) No Goods will be Delivered without Payment.
