Note: Description of Property Mortgaged by Mortgage Bond No. 11909.
All that allotment of land forming a defined portion of Welideniya Estate and depicted as Lot No.4 in Preliminary Plan No.G/776 dated 04.06.1975 made by V Godahena, Government Surveyor and authenticated by K Gardiyehewa, Superintendent of Surveys Galle on behalf of the Surveyor General situated at Ihala Lelwala in Gangaboda Pattu South of Galle District Southern Province.
Containing in Extent: A4:R3:P21
All the soil and trees of an allotment of land called Endagalagawahena situated at Ihala Keembiya in the Gangaboda Pattu South Galle District, Southern Province.
Containing In Extent: A3:R0:P29
All that the allotment of land called Mahamulanagoda situated at Ihala Lelwala aforesaid.
Containing In Extent: A0:R1:P24
Together with all the plantations standing thereon.
Now this land is depicted as Lot B in Plan No.190 dated 04.03.2001 made by M G Lionel Surveyor of Galle describes as follows:
Land called Lot B depicted in Plan No. 190 dated 04.03.2001 made by M G Lionel Licensed Surveyor of Muhamulanegoda also known as Welideniya Estate situated at Ihala Lelwala aforesaid.
Containing In Extent: A0:R1:P25.6
Together with soil, plantations and everything else standing thereon.
All that allotment of land called Muhamulanegoda situated at Ihala Lelwala aforesaid.
Containing In Extent: A1:R1:P24
Together with all the plantations standing thereon.
This land is now depicted as Lot A in the said Plan No.190 describes as follows:
Land called Lot A depicted in the said Plan No.190 of Mahamulanegoda also known as Welideniya Estate situated at Ihala Lelwala aforesaid.
Containing In Extent: A1:R1:P6.6
Together with soil, plantations and everything else standing thereon.
The Property Mortgaged to DFCC Bank by: Udara Chaminda Alles and Imbulgoda Hewage Leela carrying on business in partnership at Wanduramba (hereinafter referred to as 'The Partners') have made default in payments due on Mortgage Bond No.11909 dated 13th July 2001 attested by C S Pinidiya Notary Public of Matara.

Auction Sale on Thursday 8th October 2009 at 11.00 am at the spot.
Mode of Payment: The Successful purchaser will have to pay the following amounts in cash at the fall of the hammer.
1) 10% (Ten Percent) of the Purchased Price.
2) 1% (One Percent) of the sales Taxes payable to the Local Authority.
3) Auctioneer's Commission of 2 1/2% (Two and a half percent only).
4) Total cost of advertising Rs.38,000.00
5) Clerk's & Crier's Fee of Rs.500.00
6) Notary's Fee for condition of Sale Rs.2000.00
The balance 90% of the purchased price together with any other statutory levies, duties, taxes or charges whenever applicable and imposed by the Government of Sri Lanka or any other authority to be payable within 30 days from the date of sale.

Conditions of Sale: (1) The highest bidder becomes the purchaser. Should any dispute arise between two or more bidders the lot will be put up again and re-sold.
(2) A deposit of 50 percent (50%) to be made on each lot if required, at the time of sale.
(3) All lots to be at the risk of the purchaser from the time of purchase, and no lot can be delivered while the sale is proceeding.
(4) Should any mistake be made in describing a lot such mistake will not be held to vitiate or effect the sake if such lot in anyway – it being understood that intending purchasers will satisfy themselves on all points before bidding and no allowance will be made for imperfections discovered after the lots are knocked down.
(5) No goods to be removed without the sanction of the Auctioneer. Any person removing any portion of the property without an order from the Auctioneer will be subject to an action at law.
(6) Purchasers will bear all expenses of taking down and removing all lots purchased and shall make good any unnecessary damage which may be caused thereby.
(7) Notice- Servant’s bids will not be taken unless they produce an authority from their masters prior to the sale.
(8) All articles must be paid for before delivery and removed immediately after the sale, otherwise they will be resold by public or private sale at the risk of the purchaser who will not be entitled to claim any surplus if any, at such re-sale will be liable for any deficiency.
(9) The Auctioneer to have the option to refuse any bids.
(10) No Goods will be Delivered without Payment.
