II.1.4) Short description of the contract or purchase(s): Darlington
Borough Council wish to obtain tenders for the supply and installation of
wired and wireless networking equipment and audio-visual equipment in
Darlington Schools under a framework contract. The framework contract is
for a period of 4 years.
The framework contract is divided into 2 lots:
Lot 1 - Supply and installation of wired and wireless networking
equipment.
Lot 2 - Supply and installation of audio-visual equipment.
All suppliers must confirm in writing as part of their submission that
they do not and will not sub-contract any element of their work in this
contract out to third-party companies in Darlington Schools. Furthermore
suppliers must be able to provide next business day support with a cut-off
point of 4pm on the day of logging any issues. Suppliers must also be able
to respond within a two-hour window from their offices to any Darlington
School. This is to ensure good support response times, suitable survey and
installation timescales and regular strategic meetings either within
Darlington or at the Suppliers main offices.
A formal site survey must be undertaken for every installation prior to
quotation submission. All surveys must be competed with a member of the
Schools ICT Technical Support Staff. All communication regarding
installations, quotations and surveys must be performed through the
Schools ICT Technical Support Staff. At no-point must the supplier be in
direct communication with the school unless under the specific instruction
of the Schools ICT Technical Support Staff.

VI.3) PROCEDURES FOR APPEAL:
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Following the evaluation of tenders, Darlington Borough
Council will incorporate a minimum of 10 calendar days standstill period:
this period will commence from the point that the information on the award
of the contract is communicated to all tenderers. This period allows
unsuccessful tenderers to seek further debriefing from the contracting
authority before the contract is entered into. Applicants have 2 working
days from the notification of the award decision to request additional
debriefing and this information has to be provided a minimum of 3 working
days before the expiry of the standstill period. Such additional
information should be required from the person referenced in the above
address (part 1.1) If an appeal regarding the award of a contract has not
been successfully resolved the Public Contracts Regulations 2006 (SI 2006
No 5) / Utilities Contracts Regulations (SI 2005 No 6) (delete as
appropriate) provide for aggrieved parties who have been harmed or are at
risk of harm by a breach of the rules to take action in the High Court
(England, Wales and Northern Ireland). Any such action must be brought
promptly (generally within 3 months). Where a contract has not been
entered into the Court may order the setting aside of the award decision
or order the authority to amend any document and may award damages. If the
contract has been entered into the Court may only award damages.
