SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

The supply and maintenance of gas analyser equipment for quantitative gas
analysis at the JRC-IE.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The European
Commission (EC) through the Institute for Energy (IE) of the
Directorate-General Joint Research Centre (JRC) at Petten, the Netherlands
(hereinafter: the Commission) establishes test laboratories for fuel cells
and reformer testing. The Commission seeks to purchase mass spectrometry
(MS) gas analyser including ancillaries such as stream selector
(hereinafter: the equipment) to perform quantitative chemical analysis of
gaseous mixtures.
The scope of this call for tender is the manufacture, delivery,
installation, commissioning, operational training, 2 years' warranty
including preventive maintenance and up to 3 years of preventive and
corrective maintenance of the equipment.

whom the contract is to be awarded: Tenders can be submitted by groupings
of suppliers who will not be required to adopt a particular legal form
prior to the contract being awarded. However, a grouping of firms must
nominate 1 party to be responsible for the receipt and processing of
payments for members of the grouping, for managing the service
administration, and for coordination and safety. In the case of groupings
of contractors, the documents required and listed in the following point
III.2 may be supplied by every member of the grouping. A grouping of
suppliers may be requested to assume a legal form such as a consortium
after it has been awarded the contract.

Tenderers will not be eligible to take part in this contract award
procedure if they are in any of the exclusion situations listed in
Articles 93 and 94 of Council Regulation (EC, Euratom) No 1605/2002 of
25.6.2002 (OJ L 248 of 16.9.2002) as amended by Commission Regulation (EC,
Euratom) No 1995/2006 of 13.12.2006 (OJ L 390 of 30.12.2006) as amended by
Council Regulation (EC) No 1525/2007 of 17.12.2007 (OJ L 343 of
27.12.2007). Tenderers must also furnish the documents stipulated in
Article 134(1) of Commission Regulation (EC, Euratom) No 2342/2002 of

of their intention to attend, of their names and functions. For security
reasons you must provide a current identity card or passport when you
enter the Petten site (driver's licence will not be accepted).

The tenders received were unacceptable. The contracting authority decided
