SECTION VI: COMPLEMENTARY INFORMATION
VI.2) ADDITIONAL INFORMATION: The Authority intends to award a Framework
Agreement divided into 10 lots. Economic operators may be awarded more
than one lot.
The Purchasing Authority is acting on behalf of the following
organisation:
All mainland NHS Scotland Health Boards and all NHS Scotland Special
Boards, plus all locations of the Authority.
All locations of the Western Isles, Shetland and Orkney NHS Scotland
Helath Boards are excluded.
The Purchasing Authority is acting on behalf of the following
organisations:
All mainland NHS Scotland Health Boards and All NHS Special Health Boards,
plus all locations of the Authority, All locations of the Western Isles,

VI.3) PROCEDURES FOR APPEAL:
VI.3.1) Body responsible for appeal procedures: Common Services Agency
(commonly known as NHS National Services Scotland), Gyle square 1 South
Gyle Crescent, UK-Edinburgh EH12 9EB. Tel. +44 1312756000 (main

VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The authority will incorporate a standstill period of
minimum of 11 calendar days at the point information on the award of the
contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracted authority before
the contract is entered into. Applicants have two working days from
notification of the award decision to request additional de-briefing and
that information will be provided a minimum of three working days before
expiry of the standstill period. Such additional information should be
requested from the address in section VI.3.1. If an appeal regarding the
award of a contract has not been successfully resolved the Public
Contracts (Scotland) Regulations 2006 provide for aggrieved parties who
have been harmed or are at risk of harm by a breach of the rules to take
action in a court or competent jurisdiction. Any such action must be
brought promptly (generally within three months). Where a contract has not
been entered into the court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the court may only award
damages.
