Council (NCC) is putting together a community-based package of Enterprise
Support Activities aimed at improving entrepreneurship levels in the most
disadvantaged areas in the city. NCC is seeking several providers across a
number of disciplines to assist with the delivery of the Enterprise
Support Activities.
This programme will enable NCC to put in place a panel of preferred
suppliers to deliver a diverse range of pre-start and start-up activities
and specialist business support services. Some of these providers will
deliver services for the duration of the Programme, whilst some may offer
shorter, time-limited pieces of work, as required.
NCC is seeking to secure European Regional Development Fund (ERDF) ( 1 500
000 GBP over 3 years) to match its.
Working Neighbourhoods Fund (WNF) allocation ( 2 000 000 GBP over 3
years). The funding application process is being progressed in parallel
with establishing the framework agreement. Contracts will be awarded once
the full funding package has been secured. NCC reserves the right not to
award a lot.
The services required will be divided into 4 Themes and 13 Lots:
A. Entrepreneurial Young People (4 lots);
B. Animation and Pre-Start Support (5 lots);
C. Start-up Support (1 lot);
D. Growing Business (3 lots).

VI.2) ADDITIONAL INFORMATION: 1. Under this procurement, the contractor
is required to participate actively in the economic and social
regeneration of the locality of, and surroundings of, the place of
delivery for the procurement. Contract performance conditions may
therefore relate in particular to social and environmental considerations;
2. The Contracting Authority reserves the right in line with Regulation 14
(1) (d) (ii) of the Public Contract Regulations 2006 (Article 31 (4) (b)
of Directive 2004/18/EC) to award further contracts to the successful
provider where these are a repetition of the services to be provided under
this contract;
3. TUPE may apply to certain Lots. More information is available on
request and tenderers are advised to seek their own legal advise as to
whether TUPE applies.
VI.3) PROCEDURES FOR APPEAL:
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Contracting Authority will incorporate a minimum 10
calendar day standstill period at the point information on the award of
the contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing for the Contracting Authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
required from the address in part I.1.
If an appeal regarding the award of the contract has not been successfully
resolved the Public Contracts.
Regulations 2006 (SI 2006 No. 5) provide for aggrieved parties who have
been harmed or are at risk of harm by a breach of the rules to take action
in the High Court (England, Wales and Northern Ireland). Any such action
must be brought promptly (generally within 3 months). Where a contract has
not been entered into the Court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the Court may only award
damages. The purpose of the standstill period referred to above is to
allow parties to apply to the courts to set aside the award decision
before the contract is entered into.
