II.1.4) Short description of the contract or purchase(s): Transport for
London has selected a single Service Provider to design, build, operate
and maintain a Cycle Hire Scheme which will comprise a fleet of bicycles,
docking stations (some of which may be mobile), docking points and
supporting infrastructure in London.
Initially this will comprise a fleet of 6 000 bicycles spread across
approximately 400 docking stations within an area equivalent, but not
identical, to the central London Fare Zone 1 (circa 44Km2). Docking
Stations will be placed approximately 300 metres apart.
The design element includes bicycles, docking points, terminals,
information management systems, business operations and maintenance
processes.
The build element will include site preparation, surveying, build and
installation of cycle hire assets as well as the implementation of the
supporting information management systems.
The operation and maintenance elements encompass all the cycle hire assets
(including the bicycles, docking stations and terminals), redistribution
of the bicycles to meet customer demand, provision of a customer contact
centre, revenue collection, user communications and marketing.
The contract will run for 6 years, the design and build work taking 1 year
with the operation running for 5 years. There is an option to extend the
contract for a further 2 years.
Lot 3 – Sponsorship has not been progressed as part of this contract.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY
COMMUNITY FUNDS: No.
VI.2) ADDITIONAL INFORMATION: The procurement process was conducted on
behalf of Transport for London (TfL). TfL is a complex organisation
operating both as a functional body of the Greater London Authority (GLA)
under the direction of the Mayor of London and as a provider of transport
services. The services supplies or works may be provided to TfL and/or its
subsidiaries and/or the GLA or any other authority that is subject to the
requirements of either EU directive 2004/17/EC or 2004/18/EC.
VI.3) PROCEDURES FOR APPEAL:
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Transport for London has observed the minimum 10 calendar
day standstill period from the point at which information on the award of
the contract was communicated to bidders. TfL provided any feedback
requested by the bidders. If an appeal regarding the award of a contract
has not been successfully resolved the Public Contracts Regulations 2006
(SI 2006 No 5) provide for a party who suffers, or risks suffering, loss
or damage as a consequence of a breach of the rules to take action in the
High Court (England, Wales and Northern Ireland). Any such action must be
brought promptly (generally within 3 months). Since the contract has been
entered into, the Court may only award damages. The purpose of the
standstill period referred to above was to allow bidders to apply to the
Courts to set aside the award decision before the contract was entered
into.
