Expansion and Pavement Project by the government

Invitation for Pre-qualification

In accordance with the Article No. 21 of the Construction Technology Management Act, Article No. 37 and 38 of its Enforcement Decree of the Republic of Korea respectively, Jeollanam?do is planning to implement the Provincial Roads Expansion and Pavement Project by the government and now invites eligible consultants to apply for pre-qualification for the construction supervision services for the projects as follows:

2. Selection of Consultants Pre-qualified to Bid

a. In accordance with the Article No. 38 of the Enforcement Decree of the Construction Technology Management Act and the Article No. 13 of its Enforcement Regulations, applications for pre-qualification will be evaluated and the invitation to bid will be issued to those pre-qualified applicants who pass the minimum pre-qualification criteria established by Jeollanam?do and evaluated as pre-qualified.

b. There will not be any separate notification of the results of the pre-qualification. The pre-qualified companies will be eligible to participate in the electronic bid by the deadline for bid submission through Korea On?line E?Procurement System (KONEPS) by logging on the website, http://www.g2b.go.kr.

The companies who are not listed on KONEPS (G2b) are not selected and pre-qualified to bid for the services.

3. Preparation and Submission of Application for Pre-qualification

a. Eligible Applicants for Pre-qualification

1) General Supervision Specialized Firms or Specialized Engineering Works Supervision Firms registered with the Minister of Construction and Transportation in accordance with the Article No. 28 of the Construction Technology Management Act and the Article No. 54 of its Enforcement Decree.

2) A firm submitting an application for pre-qualification may associate with any other firm it chooses on a joint and several liability basis, provided that all the associate firms shall meet the requirements set forth in the above Item No. 3. a. 1). A letter of association shall be included in the application for pre-qualification.

The services will be carried out by a national firm in association with a regional firm. Such an association shall be made three (3) companies including lead firm and two (2) regional firms.

An association with a regional firm existing and being operated in Jeollanam?do will be given regional preference based on the proportion of assignment in accordance with the detailed criteria on qualification and requirements for consulting services for the local government (Article No. 245 of the Ministry of Government Administration & Home Affairs Regulations). You shall participate in the project with more than 49% share of local companies in Joint Venture if possible.

The firms who previously participated or are participating in this project will not be eligible for the project and their applications for pre-qualification will be rejected

b. Pre-qualification Documents and Submission of Applications

1) The Pre-qualification Document will be announced in the home pages of KONEPS of Public Procurement Service (PPS).

2) Applicants will be required to submit two (2) copies of applications for pre-qualification in a sealed envelope, which must be delivered to the address below not later than 09:00 ? 18:00 17th September 2009:

The following document shall be attached with the applications:

Tax Registration Certificate, Corporate Seal Impression Certificate, Corporate Register, Association Agreement and other necessary documents if appropriate.

3) Preparation of Applications:

In accordance with the Guidelines for Pre-qualification Document and Evaluation Criteria established by Jeollanam?do under the Article No. 13?1 of the Enforcement Regulations of the Construction Technology Management Act.

4) Delivery and Integrity

Applications should be delivered in person either by their legal representative carrying their company seal or by their company employee with a power of attorney confirming that they are applicants employee and are given an authority to do so.

If any falseness or fraudulency or counterfeit is found in applications, the applicants who have submitted will be limited to future bids, or their proposal for award will be rejected or the contract with them will be cancelled.

The applications submitted will not be returnable.

4. Selection of Consultant

a. In accordance with the Article No. 21 of the Construction Technology Management Act, Article No. 37 and 38 of its Enforcement Decree and No. 1 of the attached table No. 5 of the Article No. 13 of its Enforcement Regulations of the Republic of Korea respectively, all the applications for pre-qualification shall be evaluated under the Guidelines for Pre-qualification Document and Evaluation Criteria established by Jeollanam?do.

Only the firms whose pre-qualification only the top 10 firms of all have secured more than 77.62 points out of 100 will be invited to bid for the project.

If there is only one applicant for pre-qualification, it will be announced again.

b. The contract award will be made to the successful bidder in accordance with No. 3 of the Article No. 14 and No. 1 thru 4 of the Article No. 42 of the Enforcement Decree of the Act on Contracts to Which the Local Government is a Party for special procurement, Article No. 182 of the Ministry of Government Administration & Home Affairs Regulations and the detailed criteria on qualification and requirements for consulting services for the local government (Article No. 245 of the Ministry of Government Administration & Home Affairs Regulations).

5. Other Information

a. Applications shall be prepared in Korean language in accordance with the Article No. 8 of the Special Regulation of the Enforcement Decree of the Act on Contracts to Which the State is a Party for special procurement.

b. All other matters not contained and mentioned in this notice shall be in accordance with the Act on Contracts to Which the Local Government is a Party for special procurement, the Ministry of Government Administration & Home Affairs Accounting Regulations and the instruction to bidders for consulting services, other official notifications, the contracting plan for this consulting services, terms of references, etc.

All bidders shall be fully aware of the relevant information and data on the project and shall be responsible for any negligence in obtaining such information and data.

c. The supervisors proposed by name in the applications shall remain employed by the applicants until the date of price bid and shall be in actual service with the applicants until the completion of the construction supervision services for its efficiency and continuity.

Should it become necessary for the applicant to replace any of the supervisors proposed by name in the applications because of death or unavoidable reasons, immediately the applicants shall inform this to Jeollanam?do and shall forthwith provide a replacement acceptable to Jeollanam?do with comparable or better qualifications in accordance with the Article No. 32 of the Enforcement Regulation the Construction Technology Management Act. The replacement shall be subject to Jeollanam?dos approval.

d. In the event that any of the resident supervisors specified by name in the applications is listed and manned in the applications for pre-qualification for any other services that has been awarded to the applicant, the applications shall be rejected and further the contract for this services if awarded shall be cancelled.
