Notice No. 2009-190, Incheon Construction Office

Notice is hereby given that the Incheon Construction Office is soliciting bids for the project described below in accordance with Article 21, and Articles 37 and 38 of the Enforcement Decree of the Construction Technology Management Act and Article 10, and Articles 33 and 36 of the Enforcement Decree Act on Contracts Involving Local Governments.

I. Project Outline
1. Title: Construction and Supervision of Municipal Crematorium Extension and Remodeling (called Seunghwawon)
2. Location: Bupyeong 2 Dong San 58 Beonji, Bupeong-gu (within Seunghwawon)
3. Land Area: 1,680,694 m2
4. Size: One floor underground and two floors above ground (Extension Area: 2,472.68 m2; Remodeling Area: 3,194 m2)
5. Structure: Reinforced Concrete
6. Total Amount of Construction: KRW 6,886 Million (including construction cost by government and value added tax)
7. Duration of Construction: 15 Months from the Date of Commencement
8. Contract Obligations: Implementing and Supervising the Project in terms of construction, civil engineering, machinery management, removal, landscape architecture, waste disposal and so on
9. Total Contract Amount and 2009 Budget: KRW 358,360,000 (2009 Budget: KRW 204,147,000)
10. Contract Period: 15 Months from the Date of Commencement

II. Bidder's Obligations
If selected to contract with the Incheon Construction Office, the bidder is obligated to implement and supervise the project described above in accordance with the following regulations:
1. Clause 2, Article 27, Construction Technology Management Act
2. Clause 2, Article 52, Enforcement Decree, Construction Technology Management Act
3. Article 34, Enforcement Ordinance, Construction Technology Management Act
4. Guidelines on Implementing and Supervising Project by the Ministry of Land, Transport, and Maritime Affairs
5. Act on Contracts Involving Local Governments
6. Contract with the Incheon Construction Office

III. Bidder Qualifications
1. Companies registered as construction and supervision companies according to Article 28 of the Construction Technology Management Act
2. The following details are applied for a joint venture bidder:
a. Joint venture bidders must not exceed more than two partners.
b. Both partners must satisfy bidder qualifications and a representative of the joint venture must select a lead partner who contributes more financing to the bidding than the other.
3. Bidding Restrictions
Companies-temporarily suspended from bidding because of their violation of Article 31 and Article 92 of the Enforcement Decree of Act on Contracts Involving Local Governments-are not allowed to bid.

IV. Registration and Submission of the Bid

2. Briefing Session: To Be Omitted
Open to any bidders for the duration of notice.
3. Registration and Submission
* Date: 09:00~18:00 on Wednesday, September 16, 2009
* Location: Division of Construction (5th Floor), Incheon Construction Office
4. Bid Documents:
* Copy of Certificate of Business Registration Certificate and Copy of Certificate of Supervision Registration
* Certificate of Corporate Registration and Certificate of Corporate Seal
* Certificate of Common Seal (if separate from the Corporate Seal)
* Authorization Letter by a Representative (if registered by a proxy) and Certificate of Employment
* Joint Venture Agreement (if bid by multiple parties)

V. Bid Evaluation and Contract Award

a. Bidders are to be evaluated by the Qualification Evaluation Criteria (set by the Incheon Construction Office) and by Article 38, Article 38, and Article 13 of the Enforcement Ordinance of Construction Technology Management Act.

b. Qualification can be granted up to ten bidders who score more than 90 in the qualification evaluation criteria. If there are less than ten bidders, every bidder will be qualified to bid. If there are less than ten bidders who score more than 90 in the qualification evaluation criteria, bidding will be granted up to the bidder who scores the tenth highest score.

c. The contract will be award to the lowest responsible and responsive bidder who scores more than 95 in the Qualification Evaluation Criteria Involving Local Government Contracts (Rule No. 251 announced by the Ministry of Public Administration and Security on August 6, 2009).

Qualification Evaluation Criteria Score (100 in total) = Performance Capability Score (27) + Additional Score Given to Local Bidders (3) + Bid Price Score (70)

d. Qualification Evaluation Criteria
If a bidder whose main office resides in Incheon participates in bidding as a joint venture, an additional score will be given based upon the Qualification Evaluation Criteria Involving Local Government Contracts (Rule No. 251 announced by the Ministry of Public Administration and Security on August 6, 2009).

e. A separate notice on the bid date and location will be given to selected bidders. No notices will be given to bidders who failed to qualify.

VI. Bid Nullification
Incheon Construction Office reserves the right to reject any bidder who violates Article 39 and Article 42 of the Enforcement Ordinance of Act on Contracts Involving Local Governments.

VII. Other Matters
a. If a bidder is found that its supervisors participate in more than two pre-qualifications and work for two projects simultaneously and that it was awarded a contract before, the contract award with the Incheon Construction Office will be nullified and replaced by a bidder with the second highest score in the Qualification Evaluation Criteria.

b. For details not described in this notice, bidders need to consult with the project proposal, specific conditions on the construction supervision contract, general instructions to bidders for technological contracts, and the Act on Contracts Involving Local Governments or call the Division of Construction (Insu Kim/032-440-5252), Incheon Construciton Office.
