This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, proposals are being requested and a written solicitation will not be issued.

The Federal Bureau of Investigation (FBI) is soliciting proposals for No. 0264489B for the award of a Firm Fixed Price (FFP) contract to provide the work and deliverables as described in the attached statement of work. The period of performance is for one year. This is a full and open competition. The NAICS code for this procurement is 541110.  A Bidders Mailing List will not be established and hard copies of documents will not be provided. The solicitaiton will only be available electronically on FEDBIZOPPS. Any amendments when issued will also be available only on this web site.  Matters posted on the web site are not terms of the solicitation unless the solicitation is written or amended to include such matters. Personnel-All personnel identified in the Offeror's proposal and all potential replacement personnel, if any, shall be approved by the FBI.  Resumes and references for all professional personnel whom the Contractor expects to work on the Project shall be included in the Contractor's proposal. The Contractor shall be available immediately upon award to begin the Project.

Deliverables-General Requirements:  All written deliverables shall be provided in hard and electronic copies using Microsoft Word in Arial 12pt font. The electronic copy will be editable (not.pdf or "read only"). The Contractor shall provide 10 paper copies of the final analysis and spreadshet or table (s) and shall send electronic copies to the representatives of the Office of Integrity and Compliance and of the Office of General Counsel.

All deliverables shall be marked and treated as confidential and privileged.

OFFERORS ARE REQUIRED TO INCLUDE PRICING FOR THE OPTIONAL 2 THREE MONTH EXTENSIONS WHEN SUBMITTING THEIR COST PROPOSAL.

PERIOD OF PERFORMANCE IS: 6 MONTHS WITH AN OPTION OF  TWO - 3 MONTH EXTENSIONS.  Written notice shall be provided to the Contractor 15  days before the end of the base period of performance.  An option shall be exercised if the Government determines:  Funds are available and there is a requirement.

DELIVERABLES

1.   PROJECT PLAN-DUE UPON THE AWARD OF THE CONTRACT

2.  STATUS REPORTS-Due at the 30th,60th and 90th day. Meetings providing a written summary advising the FBI of the progress and status of Contractor tasks relative to the approved contract and Project plan. Identify significant accomplishments, milestones and issues. Section 3.1

3.  FINAL ANALYSIS REPORT TO INCLUDE: Written narrative report presenting legal research and analysis. Contractor shall propose a report format, to be agreed upon and/or modified in accordance with discussions with the FBI.  Spreadsheet or table(s): One or more spreadsheets or tables setting forth the environmental, safety and health laws as the federal and state levels applicable to the operation and use as well as use, alone, of firearms training facilities by the FBI. The Contractor and the FBI shall agree on the format for these documents. Section 3.2.

4.  Optional- The FBI may request up to three oral briefings summarizing the findigns requested by the FBI.

AWARD

The FBI reserves the right to award a contract without without discussions with the Offerors.  The contract awarded will be firm-fixed price based on the best value to the FBI and detrmined by an assessment of each Offeror's ability to satisfy the following criteria in descending order of importance:

TECHNICAL

1. Significant environmental litigation and/or counseling experience with firearms training facilities and/or ranges.

2. Significant litigation and/or counseling experience in the general field of environmental law.

3. Significant litigation and/or counseling experience in the field of occupational health and safety.

4. Logic and reasonableness of approach.

5. Experience in designing and overseeing multi-state legal research projects.

EVALUATION FACTORS:

In order to allow the Source Selection Authority the most flexibility in determining the best value to the Government, the relative importance of evaluation factors is:  Technical Evaluation, Past Performance Evaluation and Cost/Price Evaluation.

TECHNICAL EVALUATION-MOST IMPORTANT

Factor T-1: UNDERSTANDING THE REQUIREMENTS-IMPORTANT

The Offeror will be evaluated on their demonstration of a clear understanding of the technical requirement and ability to demonstrate extensive experience in satisfying similar requirements as those set forth in the Statement of Work.

Factor T-2: EXPERIENCE - VERY IMPORTANT

The Offeror will be evaluated on the strength of the Personnel resumes submitted.

The offeror shall provide resumes for all personnel.  Each resume shall address the areas identified in the solicitation. Personnel will be evaluated as to their ability to fulfill the tasks expected of them taking into consideration past relevant job experience, professional education, specific accomplishments and other relevant factors made available in the proposal.

PAST PERFORMANCE EVALUATION-VERY IMPORTANT

The past performance factor assesses the performance record of the Offeror. These factors are listed in descending order of importance as follows:

Factor P-1: Relevance of Experience -Very Important.  Ther Offeror's experience shall be evaluated on the degree of relevance to requirements of the solicitation on the basis of similarity in size, scope, complexity, technical difficulty, contract type and period of performance. Recent experience (defined as gained in the last 5 years) will be evaluated. Evaluations may include interviews with previous clients or proposed personnel.

FACTOR P-2: Quality of Product or Service-Very Important

This factor shall assess the Offeror's past performance to determine its ability to provide a quality product or service. The quality of the Offeror's past performance shall be evaluated on the basis of information contained in the Offeror's proposal and information the Government obtains through reference checks or other means. Past performance evaluation shall assess the Offeror's record of providing high quality services of a similar nature and in a manner that ensures maximal accuracy, throughput, cost effectiveness and overall client satisfaction.

BUSINESS PROPOSAL EVALUATION: As stated in the solicitation, all evaluation factors other than price, when combined, are  more important than price. The Offeror's business proposal will be evaluated with respect to the price estimated over the life of the project. Offerors shall be evaluated to assess the realism and reasonableness of the proposed price to determine if they are realistic for the work to be performed;reflect a clear understanding of the requirements and consistent with the various elements of the Offeror's technical proposal.

Of these three areas technical is most important, past performance is second and price is third.

Offerors are reminded the evaluation factors that apply to this solicitation and their relative importance are within the broad discretion of agency acquisition officials....Price or cost to the Government shall be evaluated in every source selection.

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, proposals are being requested and a written solicitation will not be issued.
The Federal Bureau of Investigation (FBI) is soliciting proposals for No. 0264489B for the award of a Firm Fixed Price (FFP) contract to provide the work and deliverables as described in the attached statement of work. The period of performance is for one six-month period with two three month option periods. This is a full and open competition. The NAICS code for this procurement is 541110. A Bidders Mailing List will not be established and hard copies of documents will not be provided. The solicitation will only be available electronically on FEDBIZOPPS. Any amendments when issued will also be available only on this web site. Matters posted on the web site are not terms of the solicitation unless the solicitation is written or amended to include such matters. Personnel-All personnel identified in the Offeror's proposal and all potential replacement personnel, if any, shall be approved by the FBI. Resumes and references for all professional personnel whom the Contractor expects to work on the Project shall be included in the Contractor's proposal. The Contractor shall be available immediately upon award to begin the Project.
Deliverables-General Requirements: All written deliverables shall be provided in hard and electronic copies using Microsoft Word in Arial 12pt font. The electronic copy will be editable (not .pdf or "read only"). The Contractor shall provide 10 paper copies of the final analysis and spreadsheet or table (s) and shall send electronic copies to the representatives of the Office of Integrity and Compliance and of the Office of General Counsel.
All deliverables shall be marked and treated as confidential, privileged and the property of the FBI.
OFFERORS ARE REQUIRED TO INCLUDE PRICING FOR THE OPTIONAL TWO THREE-MONTH EXTENSIONS WHEN SUBMITTING THEIR COST PROPOSAL.
PERIOD OF PERFORMANCE IS: SIX MONTHS WITH TWO - THREE- MONTH EXTENSIONS. The government will provide written notice of its intent to exercise the option to the Contractor 15 days before the end of the base period of performance. An option shall only be exercised if the Government determines that funds are available and there is still a valid Government need.

 DELIVERABLES
1. PROJECT PLAN-DUE UPON THE AWARD OF THE CONTRACT
2. STATUS REPORTS-Due at the 30th, 60th and 90th day .Provide a written summary advising the FBI of the progress and status of Contractor tasks relative to the approved contract and Project Plan. Identify significant accomplishments, milestones and issues as outlined in Section 3.1
3. FINAL ANALYSIS REPORT TO INCLUDE: Written narrative report presenting legal research and analysis. Contractor shall propose a report format, to be agreed upon and/or modified in accordance with discussions with the FBI. Spreadsheet or table(s): One or more spreadsheets or tables setting forth the environmental, safety and health laws as the federal and state levels applicable to the operation and use as well as use, alone, of firearms training facilities by the FBI. The Contractor and the FBI shall agree on the format for these documents. Section 3.2.
4. Optional- The FBI may request up to three oral briefings summarizing the findings requested by the FBI.


AWARD
The FBI reserves the right to award a contract without discussions with the Offerors. The contract awarded will be set at a firm-fixed price, based on the best value to the FBI as determined by an assessment of each Offeror's ability to satisfy the following criteria in descending order of importance:


EVALUATION FACTORS:
In order to allow the Source Selection Authority the most flexibility in determining the best value to the Government, the relative order of importance of the evaluation factors are: (1) Technical, (2) Past Performance, and (3) Cost/Price.
1.TECHNICAL EVALUATION-MOST IMPORTANT
Factor T-1: EXPERIENCE - VERY IMPORTANT
The Offeror will be evaluated on the strength of the Personnel resumes submitted.
The offeror shall provide resumes for all personnel. Each resume shall address the areas identified in the solicitation. Personnel will be evaluated as to their ability to fulfill the tasks expected of them taking into consideration past relevant job experience, professional education, specific accomplishments and other relevant factors made available in the proposal.
The offeror shall address the following in its proposal:
1. Significant environmental litigation and/or counseling experience with firearms training facilities and/or ranges.
2. Significant litigation and/or counseling experience in the general field of environmental law.
3. Significant litigation and/or counseling experience in the field of occupational health and safety.
4. Logic and reasonableness of approach.
5. Experience in designing and overseeing multi-state legal research projects.
Factor T-2 UNDERSTANDING THE REQUIREMENT-IMPORTANT
The Offeror will be evaluated on its demonstration of a clear understanding of the technical requirements and ability to demonstrate extensive experience in satisfying similar requirements to those set forth in the Statement of Work. 
2. PAST PERFORMANCE EVALUATION-VERY IMPORTANT (BUT NOT AS IMPORTANT AS TECHNICAL)
The past performance factor assesses the performance record of the Offeror. These factors are listed in descending order of importance as follows:
Factor P-1: Relevance of Experience . The Offeror's experience shall be evaluated on the degree of relevance to requirements of the solicitation on the basis of similarity in size, scope, complexity, technical difficulty, contract type and period of performance. Recent experience (defined as gained in the last 5 years) will be evaluated. Evaluations may include interviews with previous clients or proposed personnel.
Factor P-2: Quality of Product or Service
This factor shall assess the Offeror's past performance to determine its ability to provide a quality product or service. The quality of the Offeror's past performance shall be evaluated on the basis of information contained in the Offeror's proposal and information the Government obtains through reference checks or other means. Past performance evaluation shall assess the Offeror's record of providing high quality services of a similar nature and in a manner that ensures maximum accuracy, thoroughness, cost effectiveness and overall client satisfaction.
 3.BUSINESS PROPOSAL EVALUATION:
As stated in the solicitation, all evaluation factors other than price, when combined, are more important than price. The Offeror's business proposal will be evaluated with respect to the price estimated over the life of the project. Proposals shall be evaluated on the feasibility of the work to be performed.
Offerors are reminded that the evaluation factors that apply to this solicitation and their relative importance are within the discretion of agency acquisition officials. Price or cost to the Government shall be evaluated in every source selection.

Answers in response to Questions-RFP 0264489A

1.In the cost proposal, is the FBI looking for a range of estimated costs or a single sum? I assume it's a single sum for each line item and a single sum for the total.  Your assumption is correct.  The FBI is looking for a single sum for each line item.

2.In Line Item 1, what is the significance of the "not to exceed 480 hours? Is the FBI also seeking the number of hours we think we will have to spend for each line item and on the project?  The Not to Exceed (NTE) has been removed.

3. Line Item 2 what is meant by the "Project Plan"? Is this simply a summary of what tasks we think will be involved and how we will conduct our legal research?   Yes, including milestones with target dates for achievement.

4. Line item 6 Would the travel expenses (per Federal Travel Regulation) be for one trip to D.C. for an oral presentation?  The travel expenses would be for as many trips as the FBI deems reasonably necessary and must be included in the Cost Proposal CLIN 0006.

5.  Line items 7 and 8 What might the two-three month extensions entail? AS the Final Analysis kReport will have been submitted by the end of the six-month performance period, what work would be required in the extension periods?  This is an extension of the time period in which to complete the existing scope of work.

6.  As part of our proposal, we will be submitting resumes and references for our proposed personnel. Other than what the Solicitation already calls for, is there anything else the FBI is seeking to aid it with the Past Performance Evaluation Factor? No.

7.  How many attorneys/paralegals do you need for this assignment?  There is no set number of attorneys or support staff required. That decisioln is left to the discretion of the vendor.  The selected vendor will have the personnel with the appropriate skill, expertise and experience.

Amendment to RFP- Second round of answers to submitted questions:

1.  The statement of work's contract personnel requirements states that contractors with litigation and/or counsulting experience involving  environmental and safety and health laws "as they relate to firearms training facilities are required."  Is experience with firearms training facilities a necessary prerequisite to successfully bidding on this RFP?  Yes,unless no otherwise qualified vendors have such experience.

2.  In the "Past Performance Evaluation" section of the RFP, you have indicated that "evaluations may include interviews with previous clients or proposed personnel." Do you intend to interview prior clients and are you requesting references?  Yes, we will want to talk with prior clients and yes, we are requesting references.

Additional answers to questions received for RFP 0264489B:

1.  Does the FBI have a proposed start date in mind for the initiation of the project?  Immediately after award or a reasonable period of time thereafter, not to exceed 30 days.

2. Is there a particular end date for the final product that the FBI is attempting to meet?  Six months from the award of the contract, to be extended at the government's convenience if needed, on the basis of unforeseen delays or good cause shown, but without an expanded scope of work.

3.  The statement of work references "different types of ammunition," including explosives. Are there particular types of ammunition and explosives the FBI uses for training purposes at the indoor and outdoor range facilities that it would like the vendor to focus on?  It is not necessary for the contractor to know the different types of ammunition the FBI has used, currently uses, or may use in the future. The FBI is interested in learning whether the law treats different kinds of ammunition differently and, if so, what those differences are.

4. Is the vendor expected to revierw all significant federal, US territory, state and local environmental and safety and health laws, regulations, and policies relevant to the operation or use by non-owners of firearms training facilities?  Yes

5.What type of  "additional guidance and direction from the Office of Integrity and Complicance personnel, the Office of General Counsel, and other relevant subject matter experts" does the FBI anticipate providing to the vendor?  The guidance and direction will simply serve to aid the contractor to focus on its effort and to answer questions which arise.

6. How much time will the vendor have to prepare the Project Plan once the solicitation is awarded?  A reasonable period of time, not to exceed 30 days.

7. The FBI indicates that a partner shall fill the role of the Contract Manager. Will the FBI also require a partner to fill the role of back-up Contract Manager, or may the firm identify a non-partner to fill that role (e.g. Of Counsel)?  As long as a partner has ultimate responsibility for the contract, s/he may delegate to others to assist.

8.  Where discrepancies are noted between the RFP Statement of Work and the electronic combined synopsis/solicitation, which document should the vendor respond to (e.g. the electronic combined synopsis/solicitation requests "resumes and references for all professional personnel" but this requirement was stricken from the RFP Scope of work via redline?  Reference the Statement of work 2.5 Contract Personnel Requirements  and  Evaluation Factors-Factor T-1 and Past Performance Factors P-1 and P-2 located in the Description of the Combined Synopsis/Solicitation.

9. We have a question regarding task description (6)(g) in section 3.2-"Outside the firing range context, have courts found other bases for liability arising out of violations of environmental of safety and health laws attributable to a mere user of a facility? If so, what factors did the courts consider compelling in such determinations? Please provide additional information as to the scope of research that is expected on this issue. As stated, the question would require the contractor to evaluate liability in literally hundreds of contexts.  The FBI is interested in cases with reasonably analogous factual settings in which a user was found liable. It will be the contractor's responsibility to determine which factual contexts are relevant. The FBI is interested in case law that has precedential value or is otherwise noteworthy.

10.  With regard to task description (4)(h), please describe what is the concern with regard to "dust control, protective clothing, and safe work practices" The earlier identified personnel protection concern is inhalation of lead. Is this task (4)(h) to address exposures and work practices that are unrelated to lead? If so, please identify the specific exposures of concerns. The FBI would like the contractor to identify potential risks to health commonly associated with the operation or use of a firearms training facility.

11.  With regard to the state Deliverables-General Requirements in the solicitation synopsis for "hard and electronic copies using Microsoft Word in Arial 12 point font (in an) editable (non-PDF or read-only) format," do the requested deliverables requirements apply to the proposal due September 18 as well? No.
