SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.3) The notice involves: The establishment of a framework agreement.
II.1.4) Information on framework agreement: Framework agreement with
several operators.
Maximum number of participants to the framework agreement envisaged: 40.
Duration of the framework agreement: Duration in months: 36.
II.1.5) Short description of the contract or purchase(s): Wirral Borough
Council requires a framework of suppliers to provide and deliver high
quality sandwiches and sundries at a reasonable price.This is a
buffet-type provision (not pre-packed sandwiches for re-sale) to cover
such events as business lunches, meetings and training courses. Wirral
Borough Council has authority buildings in: Wallasey, Birkenhead &
Tranmere, Bromborough & Eastham, New Brighton, Bebington, Rock Ferry,
Bidston & St James, West Kirby, Heswall, and Liverpool City Centre, that
require this provision. However, the Council is not looking for suppliers
to be able to service all of these areas. For example if a supplier is
only able to provide their service to the New Brighton area and not the
Bebington area then this will be acceptable i.e suppliers can tender for
the areas that they can provide for.
The Council currently employs 12,500 staff and the service provided must
cater for the diverse and multi-cultural needs of this ever changing
workforce.
Suppliers must have to ability to provide a timely and quality delivery
service with orders sometimes being placed at very short notice.
The Council cannot guarantee any volumes of business with suppliers,
requirements will be on an ad-hoc when needed basis.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Wirral Borough Council is looking to
appoint a number of organisations as suppliers under a framework agreement
to supply, when required, sandwiches and sundries within its
administrative area.
Estimated value excluding VAT: 450 000 GBP.
II.2.2) Options: No.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Starting:
1.4.2010. Completion: 31.3.2013.

Any economic operator may be excluded from participation in a contract if
it:
(a) is bankrupt or is being wound up, whose affairs are being administered
by the courts, who has entered into an arrangement with creditors or who
is in any analogous situation arising from a similar procedure under
national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an
order for compulsory winding-up or administration by the courts or for an
arrangement with creditors or is the subject of any other similar
proceeding under national laws or regulations;
(c) has been convicted of an offence concerning his professional conduct
by a judgement which has the force of res judicata;
(d) has been guilty of grave professional misconduct proven by any means
which the contracting authorities can justify;
(e) has not fulfilled obligations relating to the payment of social
security contributions in accordance with the legal provisions of the
country in which he is established or those of the country of the
contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which he is
established or those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying any information
required.

1) All candidates will be required to provide a statement covering the 2
previous financial years, including the overall turnover of the candidate
and the turnover in respect of the activities which are of a similar type
to the subject matter of this notice

authority or an independent body on their behalf
3) All candidates will be required to provide evidence of relevant
professional risk indemnity insurance.

1) The service provider’s ability, taking into account in particular their
skills, efficiency, experience and reliability
2) Details of the training, experience and qualifications of key staff
responsible for providing the services under the contract
3) An assessment will be carried out by the contracting authority to gauge
the available resources and technical capacity of the candidate
4) Certification from quality control institutes or agencies of recognised
competence attesting conformity to the appropriate national standards for
the provision of services and supply within the context of this
specification.
5) The authority may carry out or employ the services of a competent
official body of the country in which the supplier is established, a check
on the production capacities, study and research facilities, and quality
control measures.
6) Registration with an appropriate Environmental Health Department
7) Evidence of a recent inspection from the candidate’s local
Environmental Health Food Safety Officer.

SECTION VI: COMPLEMENTARY INFORMATION
VI.3) ADDITIONAL INFORMATION: All applicants who express an interest are
required to complete a Pre-Qualification Questionnaire (PQQ) which seeks
information including economic and financial standing, technical ability
and experience. Failure to answer all questions in the PQQ and provide
supporting documentation may result in disqualification.
The PQQ shall be assessed in the first instance, and if the assessment of
this document does not reach the required level, the Council will not
invite you to tender.
To obtain a PQQ document, e-mail tenders@wirral.gov.uk with your contact
details and the name of the contract you are interested in. The PQQ will
normally be e-mailed to you, unless you specifically ask for a hard copy.
You should complete the PQQ electronically and return it by e-mail,
enclosing any required certification as electronic attachments. However,
if you prefer, you can submit a hard copy, including any hard copy
certification (copies only), to the return address shown on the PQQ. You
may also e-mail the completed PQQ and post any supporting documentation,
e.g. certification, if such certification is not available as an
electronic attachment (note that if such hard copies of supporting
documentation are submitted separately by post, you should ensure that you
clearly cross reference each item of posted material to the contract
title, the question to which it refers, and the name of your organisation.
You should also make it clear on the relevant question in the PQQ that
supporting documentation has been sent separately by post).
The deadline for receipt of the completed PQQ is 12 noon on 7.10.2009.
