Supply procurement notice
1. Publication reference: EuropeAid/128626/D/SUP/ER.
2. Procedure: Open international.
3. Programme: 9th EDF.
4. Financing: Financing Agreement No 9 ACP RPR 163: 'Expansion of LPG
storage and distribution facilities to urban/rural areas of Eritrea'.
5. Contracting authority: H.E. Mr Yemane Ghebremeskel, Director, Office
of the President, Deputy National Authorising Officer of the European
Development Fund.
Contract specifications
6. Description of the contract: The subject of the contract is the
manufacture, delivery, erection, installation and commissioning by the
contractor of the following goods:
— storage tanks: manufacture, supply, delivery, installation and
commissioning of 2 LPG spherical tanks of 1 000 metric tons each (i.e. 2 x
2 000 m³) with accessories (pipes, flanges, inline valves). Total weight
ca. 900/1 000 tons of steel,
— manufacture, supply and erection of a 2 000 m³ steel water tank complete
with all accessories,
— extension of fire fighting system and electrical system, piping system,
gas/thermal control system, lighting system,
— supply and installation of full set of a filling plant/evacuation unit
at Massawa with a carousel of 12 filling machines and scales and conveyor,
— erection of a control and office room,
— supply and installation of weighing bridge and transfer point (pumps and
compressors),
— including related civil works for the activities above (excavations,
foundations, ancillary works including gates, fences and dykes, sewage and
drainage system).
In a few words, the foreseen activities include the production of a
turnkey LPG plant as per design specifications prepared by the supervisor
(The Ministry of Energy and Mines of the State of Eritrea).
7. Number and titles of lots: 1 lot.
Terms of participation
8. Eligibility and rules of origin: Participation in tendering is open on
equal terms to natural and legal persons (participating either
individually or in a grouping (consortium) of tenderers) from ACP States
and Member States of the European Union contributing to the European
Development Fund and international organisations as authorised by the
instrument applicable to the programme under which the contract is
financed (see also item 22 below). All goods supplies under this contract
must originate in these countries.
9. Grounds for exclusion: Tenderers must submit a statement to the effect
that they are not in any of the situations listed in point 2.3.3 of the
'Practical Guide to contracts procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender per lot.
Tenders for part of a lot will not be considered.
Any tenderer may state in its tender that it would offer a discount in the
event that its tender is accepted for more than 1 lot. Tenderers may not
submit a tender for a variant solution in addition to their tender for the
supplies required in the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of 100
000 EUR when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contract by all parties.
This guarantee will be called upon if the tenderer does not fulfil all
obligations stated in its tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided no later than
30 days after the tenderer receives the contract signed by the contracting
authority. If the selected tenderer fails to provide such a guarantee
within this period, the contract will be void and a new contract may be
drawn up and sent to the tenderer which has submitted the next best
compliant tender.
13. Information meeting and/or site visit: No information meeting is
planned.
14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of performance: The estimated implementation period is
foreseen to be 18–24 months, from the date of contract signature until the
provisional acceptance. However, the contractor must provide in his
proposal, a detailed implementation plan indicating the exact number of
months for the supply and installation of the facilities.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. In the case of tenders submitted by a consortium, these
selection criteria will be applied to the consortium as a whole:
1) Economic and financial capacity of tenderer (based on i.e. item 3 of
the tender form for a supply contract):
a) Annual turnover: should exceed 10 000 000 EUR for each of the past 3
years (i.e. 1.1.2006 to 31.12.2008) of which at least 30 % was generated
outside the country in which the tenderer has its registered headquarters.
2) Professional capacity of tenderer (based on i.e. items 4 and 5 of the
tender form for a supply contract):
a) Permanent staff: permanent staff should as a minimum be 50 persons in
the last 3 years.
b) Certifications: the tenderer should be certified by American Society of
Mechanical Engineers (ASME) or equivalent institution and should be
authorised to use U and U2 ASME stamps or equivalent.
c) Environmental certification: the tenderer should be compliant with ISO
14001:2004.
3) Technical capacity of tenderer (based on i.e. items 5 and 6 of the
tender form for a supply contract):
a) The tenderer should have specific experience in design and erection of
pressure spheres and should have successfully completed at least 2
projects for design and erection of pressure spheres during the past 5
years (in the period between 1.8.2004 and 31.7.2009, i.e. the project can
have commenced before this period but must have been finally completed in
the period indicated above).
b) The tenderer should have specific experience in projects outside the
country in which the tenderer has its registered headquarters and should
have realised 1 comparable project abroad (preferably in Africa or Middle
East countries) during the last 3 years (i.e. in the period from 1.8.2006
to 31.7.2009).
An economic operator may, where appropriate and for a particular contract,
rely on the capacities of other entities, regardless of the legal nature
of the links which it has with them. It must in that case prove to the
contracting authority that it will have at its disposal the resources
necessary for performance of the contract, for example by producing an
undertaking on the part of those entities to place those resources at its
disposal. Such entities must respect the same rules of eligibility and
notably that of nationality, as the economic operator.
17. Award criteria: The sole award criteria shall be the price. Contract
will be awarded to the lowest compliant tender.
