Contract specifications
6. Description of the contract: The contract is part of the rural feeder
roads programme. The spot improvements interventions are located across
Malawi and predominantly involve timber deck bridge replacement and
repair, spot gravelling and drainage works.
Timber decks are to be replaced with concrete and masonry. Spot gravelling
as well as drainage and protection works will be undertaken in short
sections where the road rapidly deteriorates due to poor 'in situ'
materials that deform under traffic load, are highly erodible or are
slippery when wet.
The interventions will cover a total of 1 437 kilometres and are divided
into lots based on type of intervention and geographic area of work. The
works will be contracted under the EDF 'General conditions for works
contracts' where the supervisor will be the Roads Authority of Malawi and
the supervisor's representative will be appointed under a separate
contract. The period of performance is expected to be 6 months and a
12-month maintenance period. The contractor will be required to provide
all the plant, machinery, labour, materials and supplies including the
location of borrow pits and quarries to complete the works.
7. Number and titles of lots: 20 lots:
Lot 01: spot gravelling on selected rural feeder roads in the northern
region of Malawi.
Lot 02: drainage and protection works on selected rural feeder roads in
the northern region of Malawi.
Lot 03: replacement and repair of selected timber deck bridges (component
A) in the northern region of Malawi.
Lot 04: replacement and repair of selected timber deck bridges (component
B) in the northern region of Malawi.
Lot 05: spot gravelling on selected rural feeder roads (component A) in
the central region of Malawi.
Lot 06: spot gravelling on selected rural feeder roads (component B) in
the central region of Malawi.
Lot 07: drainage and protection works on selected rural feeder roads
(component A) in the central region of Malawi.
Lot 08: drainage and protection works on selected rural feeder roads
(component B) in the central region of Malawi.
Lot 09: replacement and repair of selected timber deck bridges (component
A) in the central region of Malawi.

Terms of participation
8. Eligibility and rules of origin: Participation in tendering is open on
equal terms to all natural and legal persons (participating either
individually or in a grouping (consortium) of tenderers) which are
established in one of the Member States of the European Union and ACP
States and international organisations as authorised by the instrument
applicable to the programme under which the contract is financed (see also
heading 22 below). All works, supplies and services under this contract
must originate in 1 or more of these countries.
9. Grounds for exclusion: Tenderers must submit a signed declaration,
included in the tender form for a works contract, to the effect that they
are not in any of the situations listed in point 2.3.3 of the 'Practical
Guide to contract procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender per lot.
Tenders for parts of a lot will not be considered. Any tenderer may state
in its tender that it would offer a discount in the event that its tender
is accepted for more than 1 lot. Tenderers may not submit a tender for a
variant solution in addition to their tender for the works required in the
tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of:
lots 3, 9, 10, 11, 12, 14, 15, 17, 18: 2 600 EUR per lot;
lots 1, 6, 13, 16, 19: 3 500 EUR per lot;
lots 8, 20: 6 500 EUR per lot;
lots 2, 4, 5, 7: 11 000 EUR per lot;
all the lots: 97 900 EUR;
several lots: sum of the amounts of the targeted lots;
when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contract by all parties.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided together with
the return of the countersigned contract no later than 30 days after the
tenderer receives the contract signed by the contracting authority. If the
selected tenderer fails to provide such a guarantee within this period,
the contract will be void and a new contract may be drawn up and sent to
the tenderer which has submitted the next cheapest compliant tender.
13. Information meeting and/or site visit: A mandatory information
meeting will be held on 15.10.2009 (9:00), local time at the following

14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of implementation of tasks: The period of implementation is 6
calendar months (for 1 lot). For the implementation of 2 or more lots by
the same contractor, the different administrative orders to start the
different lots will be issued with an interval of maximum 3 months between
the first and the last one. There are 365 days of maintenance liability.
Selection and award criteria
16. Selection criteria: The selection criteria for each tenderer are as
follows:
Economic and financial capacity of candidate:
(a) the average annual turnover of the tenderer in the past 3 years must
be at least:
lots 3, 9, 10, 11, 12, 14, 15, 17, 18: 200 000 EUR per lot;
lots 1, 6, 13, 16, 19: 310 000 EUR per lot;
lots 8, 20: 550 000 EUR per lot;
lots 2, 4, 5, 7: 860 000 EUR per lot;
all the lots: 7 890 000 EUR;
several lots: sum of the amounts of the targeted lots;
(b) if it is the sole tenderer it must have access to sufficient credit
and other financial facilities to cover the required cash flow for the
duration of the contract. In any case, the amount of credit available must
exceed the equivalent of:
lots 3, 9, 10, 11, 12, 14, 15, 17, 18: 20 000 EUR per lot;
lots 1, 6, 13, 16, 19: 31 000 EUR per lot;
lots 8, 20: 55 000 EUR per lot;
lots 2, 4, 5, 7: 86 000 EUR per lot;
all the lots: 789 000 EUR;
several lots: sum of the amounts of the targeted lots.
Technical and professional capacity of candidate:
(a) it must have completed at least 3 projects of the same nature/amount
(taking into account past inflation rates)/complexity comparable to the
works concerned by the tender over the last 10 years. The contracting
authority reserves the right to ask for copies of the respective
certificates of final acceptance signed by the supervisors/contracting
authority of the projects concerned;
(b) it must carry out at least 70 % of the contract works by own
resources, which means that it must have the equipment, materials, human
and financial resources necessary to enable it to carry out that
percentage of the contract;
(c) if it is the lead member of a joint venture/consortium, it must have
the ability to carry out at least 50 % of the contract works by its own
means;
(d) if it is a partner of a joint venture/consortium (i.e. not the lead
member) it must have the ability to carry out at least 10 % of the
contract works by its own means;
(e) all its key personnel must have at least 10 years' appropriate
experience and proven qualifications relevant to works of a similar nature
to this project.
17. Award criteria: Price.
Tendering
18. How to obtain the tender dossier: The tender dossier is available
from: National Authorising Officer of the EDF, Ministry of Finance, NAO
Support Unit, Capital Hill, PO Box 30049, Lilongwe 3, MALAWI, upon payment
of 50 EUR (or equivalent in local currency) which excludes courier
delivery. It is also available for inspection at the premises of the
contracting authority, address as in point 5 above. Tenders must be
submitted using the standard tender form included in the tender dossier,
whose format and instructions must be strictly observed.

19. Deadline for submission of tenders: The deadline for submission is
27.11.2009 (14:00), local time.
Any tender received after this deadline will not be considered.
20. Tender opening session: Tenders will be opened on 27.11.2009 (14:30),
local time at the offices of the contracting authority given in item 5.
21. Language of the procedure: All written communications for this tender
procedure and contract must be in English.
22. Legal basis: ACP–EC Partnership Agreement signed at Cotonou on
23.6.2000 as amended on 25.6.2005 and in 2008 (Annex IV).
