Contract specifications
6. Description of the contract: The contract foresees the design and
build of the infrastructure municipal projects: such as health and sports
centres; village roads; water supply networks; sewerage networks and
wastewater treatment plants; storm water drainage networks. The contract
is a design and build lump sum contract and it is subdivided into the 3
lots. There are in total 13 projects to be designed and constructed. The
projects are located at 13 different sites across Kosovo. The technical
documents contained in the tender dossiers have been produced based on
preliminary data. It is the responsibility of the contractor to undertake
geotechnical, hydrogeology and topographic surveys, at their own cost and
collect all necessary data for the preparation of detailed design. The
detailed design and construction of projects shall be in accordance with
the relevant European standards, EC directives, engineering norms and in
due consideration of the preliminary design documents which are contained
in the tender dossier.
7. Number and titles of lots: The contract consists of 3 lots as follows:
Lot 1 — design-build municipal building projects:
1.1. Novobërdë/Novo Brdo — sports and cultural centre in Llabjan/Labljane.
1.2. Vushtrri/Vučitrn — health centre.
Lot 2 — design-build municipal roads projects:
2.1. Han i Elezit/Đeneral Janković — village road Paldenicë/Palivodenica.
2.2. Kamenicë/Kamenica — village road Hogosht/Ogošte–Poliçkë/Polička.
2.3. Prishtinë/Pristina — village road Sushicë/Sušica–Shashkoc/Šaškovac.
2.4. Prizren/Prizren — village road Romajë/Romaja–Rogovë/Rogovo.
Lot 3 — design-build municipal water and sanitation projects:
3.1. Dragash/Dragaš — sewerage system for Kuk/Kukovce and Kosavë/Kosavce
villages.
3.2. Fushë Kosovë/Kosovo Polje — town storm water drainage.
3.3. Gjakovë/Đakovica — sewerage system Skivjan/Skivjane Village.
3.4. Junik/Junik — town sewerage and storm water drainage system.
3.5. Lipjan/Lipljan — sewerage system for Medvec/Medvece and Vrellë/Vrelo
villages.
3.6. Shtërpcë/Štrpce — town water supply network.
3.7. Suharekë/Suva Reka — water supply network for Mushtisht/Mušotište.
Terms of participation
8. Eligibility and rules of origin: Participation is open to all legal
persons participating either individually or in a grouping (consortium) of
tenderers which are established in a Member State of the European Union or
in a country or territory of the regions covered and/or authorised by the
specific instruments applicable to the programme under which the contract
is financed (see also heading 22 below). All works, supplies and services
under this contract must originate in one or more of these countries.
Participation is also open to international organisations. The
participation of natural persons is directly governed by the specific
instruments applicable to the programme under which the contract is
financed.
9. Grounds for exclusion: Tenderers must submit a signed declaration,
included in the tender form for a works contract, to the effect that they
are not in any of the situations listed in point 2.3.3 of the 'Practical
Guide to contract procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender per lot.
Tenders for parts of a lot will not be considered. Any tenderer may state
in its tender that it would offer a discount in the event that its tender
is accepted for more than 1 lot. Tenderers may not submit a tender for a
variant solution in addition to their tender for the works required in the
tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of the
below specified amounts when submitting their tenders:
15 000 EUR for lot 1;
25 000 EUR for lot 2;
60 000 EUR for lot 3.
If the offer comprises more than 1 lot, the combined total amount of the
corresponding lots must be provided in the tender guarantee.
This guarantee will be released to unsuccessful tenderers once the tender
procedure has been completed and to the successful tenderer(s) upon
signature of the contract by all parties.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided together with
the return of the countersigned contract no later than 30 days after the
tenderer receives the contract signed by the contracting authority. If the
selected tenderer fails to provide such a guarantee within this period,
the contract will be void and a new contract may be drawn up and sent to
the tenderer which has submitted the next cheapest compliant tender.

14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of implementation of tasks: — Lot 1: 455 calendar days from
the commencement date (plus 365 calendar days of defects liability
period).
— Lot 2: 455 calendar days from the commencement date (plus 365 calendar
days of defects liability period).
— Lot 3: 600 calendar days from the commencement date (plus 365 calendar
days of defects liability period).
Selection and award criteria
16. Selection criteria: Economic and financial capacity of candidate:
Sole tenderer:
a) shall have an average annual turnover of at least 11 000 000 EUR over
the past 3 years (2006, 2007, 2008).
Consortium/joint venture:
b) the lead partner shall have an average annual turnover of at least 8
000 000 EUR over the past 3 years (2006, 2007, 2008);
The consortium/joint venture as a whole shall have an average annual
turnover of at least 11 000 000 EUR over the past 3 years (2006, 2007,
2008).
Professional capacity of candidate:
Sole tenderer:
a) shall be a registered firm or a natural person capable of carrying out
the specific works. In the case of a firm, it shall have been incorporated
in 2006 or earlier;
b) shall carry out at least 70 % of the contract works by his own
resources, which means that he shall have the equipment, materials, human
and financial resources necessary to enable him to carry out that
percentage of the contract.
c) key personnel:
— 1 contract manager who will coordinate the entire contract. He/she shall
be a qualified civil engineer with at least 10 years of relevant project
management experience,
— 1 dedicated site manager for each scheme. He/she shall be a qualified
engineer with at least 7 years of relevant site management experience
and/or project management of at least 2 projects with a similar nature and
size as the scheme(s),
— 1 safety manager with at least 3 years of experience of safety
management in works of a similar nature,
— 1 quality assurance/quality control manager qualified as civil engineer
or equivalent with a minimum of 3 years' practical experience in
procedures of works and materials testing and document management.
All positions shall have an acceptable command of the English language.
Consortium/joint venture:
a) the lead partner shall be a registered firm or a natural person capable
of carrying out the specific works. In the case of a firm, it shall have
been incorporated in 2006 or earlier;
b) the lead partner in a joint venture/consortium shall have the ability
to carry out at least 50 % of the contract works by his own means;
c) the partner in a joint venture/consortium (i.e. not the lead partner)
shall have the ability to carry out at least 20 % of the contract works by
his own means;
d) key personnel: the same criteria shall apply as for a sole tenderer, in
point (c) above.
Important: the proposed key personnel for this tender cannot be already
employed in another works contract financed by the contracting authority
for the same period.
Technical capacity of candidate:
Sole tenderer:
a) shall have completed at least the following projects in each lot in the
last 5 years:
Lot 1 — design and build municipal building projects:
— construction of at least 2 building schemes with a value of at least 1
000 000 EUR each.
Lot 2 — design and build municipal roads projects:
— construction of at least 2 roads with a value of at least 2 000 000 EUR
each.
Lot 3 — design and build municipal water and sanitation projects:
— construction of at least 2 water and sanitation projects, including
sewerage systems and wastewater treatment plants, with a value of at least
3 000 000 EUR each.
Consortium/joint venture:
b) the consortium/joint venture taken as a whole (that is, the lead
partner or any other partner) shall have completed in the last 5 years at
least the same projects for each lot as above — sole tenderer, point (a)).
The sole tenderer or consortium shall supply copies of the respective
certificates of final acceptance signed by the supervisors/contracting
authority of the projects concerned and/or a written letter of
satisfaction from the employer of that contract.
17. Award criteria: The lowest price of the administratively and
technically compliant offer.
