II.1.5) Short description of the contract or purchase(s): Cornwall
Council is proposing to enter into Framework Agreements with innovative
and forward-looking consultant organisations (up to £quarter million per
consultant per annum). These Frameworks are intended to provide Cornwall
Council with the ability to call off construction consultancy services to
enable the delivery of capital and maintenance programmes. It is intended
that the Frameworks run for a period of 2 years, commencing April 2010,
with an option for a 1 year extension and a subsequent option for a
further one year extension. The maximum length of the framework will
therefore be 4 years. Separate Frameworks will be established for each of
the following service areas:
— Project Management Services.
— Architectural Services.
— Quantity Surveying (Cost Management) Services.
— Structural Engineering Services.
— Building Surveying Services.
— Building Services Engineering Design and Associated Services.
— CDM Co-ordination Services.
— Travel Planning and Assessment Consultant Services.
— BREEAM Assessor Consultant Services.
— Estate Management Services.
These agreements will be used where consultants are directly engaged by
Cornwall Council or where engaged by an affiliated and related
organisation (for example Schools). Subject to the suitability of
applications received it is envisaged that within each separate Framework
a minimum of 5 will be invited to tender, with a view to appointing a
minimum of 3 providers from whom services will be procured as and when
required.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The appointed supplier will be required
to supply construction consultancy services to all departments of Cornwall
Council, or their successors in title, and potentially to other public
sector organisations and bodies (including Schools) in Cornwall and the
Isles of Scilly, who may at a later date adopt the terms and conditions of
this framework arrangement. Whilst there is no guaranteed quantity or
spend, the estimated value is likely to be up to a maximum of 250 000 GBP
per consultant per annum. The potential estimated total value may exceed
this range of spend if other organisations decide to participate. The
intention is to let a 2 year framework arrangement, with the option for a
1 year extension and subsequent option for a further 1 year extension.

TITLE: Estate Management Consultant Services
1) SHORT DESCRIPTION: The provision of professional estate management
services in connection with the negotiation of proper terms for the
acquisition and disposal of interests in land, negotiations for the
granting and taking of leases and licence and negotiations for the renewal
and surrender of leases and licences. The provision of valuations of all
kinds of property interests as from time to time instructed. Provision of
information on the Authority’s property ownerships and boundary
responsibilities both to internal clients and to members of the public.
Provision of a full rating service, including valuation of hereditaments,
estimate of rate liability, appeals against rating assessments,
negotiations with the Valuation Officer as required, checking of rate
bills and processing of rate payments.
All work is to be done in full and strict compliance with the relevant
legislation (Land Compensation Acts, Landlord and Tenant Acts, Local
Government Acts and others), the Council’s Constitution (with particular
regard to the Code of Practice for Land and Property Transactions as set
out therein) and to the highest professional standards as stipulated by

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: No deposits will be required
but where applicable the successful tenderer (or in the case of a
consortium bid, each member of the consortium) may be required to provide
a parent company guarantee or alternative performance bond.

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Parties will
be provided with detailed instructions concerning the information they
must provide. This will be contained in the Pre-Qualification
Questionnaire. Consideration will only be given to those consultants who
complete and return the Pre-Qualification Questionnaire by the required
date.
Consultants subject to any of the following will not be considered where
the said consultant.
(a) is bankrupt or is being wound up, where their affairs are being
administered by the court, where they have entered into an arrangement
with creditors, where they have suspended business activities or is in any
analogous situation arising from a similar procedure under national laws
and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an
order for compulsory winding up or administration by the court or of an
arrangement with creditors or of any other similar proceedings under
national laws and regulations;
(c) has been convicted by a final judgment in accordance with the legal
provisions of the country of any offence concerning his professional
conduct;
(d) has been guilty of grave professional misconduct proven by any means
which the contracting authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social
security contributions in accordance with the legal provisions of the
country in which they are established or with those of the country of the
contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which they are
established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information
required under this section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal
organisation, as defined in Article 2(1) of Council Joint Action
98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in
Article 3 of the Council Act of 26.6.1972 and Article 3(1) of Council
Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of
Article 1 of the Convention relating to the protection of the financial
interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined
in Article 1 of Council Directive 91/308/EEC of 10.6.1991 on prevention of
the use of the financial system for the purpose of money laundering.

appropriate, of turnover in the area covered by the contract for a maximum

the consultancy was set up or the economic operator started trading, as
far as the information on these turnovers is available;

(e) any other information or documents referred to in the
Pre-Qualification Questionnaire.

III.2.3) Technical capacity: Information and formalities necessary for

(c) Assessment of the totality of resources and core competences of the
supplier. The Supplier must be able to demonstrate a successful track
record of providing similar services to local authorities and private
sector organisations. In particular, consideration will be given to the
responses to the questions relating to:

organisations it may be necessary to request additional information, and
for applicants to give a presentation at their place of work, attend an
interview and arrange a site visit. Organisations must be able to
demonstrate through the Pre-Qualification Questionnaire that they possess
the necessary skills, knowledge and experience to undertake this service.
VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This contracting authority will incorporate a minimum 10
calendar day standstill period at the point information on the award of
the contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
requested from the addressee found in I.1.
If an appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No. 5) provide for
aggrieved parties who have been harmed or believe they are at risk of harm
by a breach of the rules to take action in the High Court (England, Wales
and Northern Ireland). Any such action must be brought promptly (generally
within 3 months). Where a contract has not been entered into the Court may
order the setting aside of the award decision or order the contracting
authority to amend any document and may award damages.
