Contract specifications
6. Description of the contract: Supply, installation and construction of
water supply schemes in 15 towns in the Federal Democratic Republic of
Ethiopia.
Each scheme comprises:
construction, testing and the development of a number of boreholes;
supply and installation of borehole pumps and standby generators;
supply and installation of collector mains;
construction of collector chamber and forwarding pump stations including
the supply and installation of pumps, motors and all electromechanical
equipment;
construction of water treatment plant, including supply and installation
of process equipment (for 1 town);
supply and installation of transmission mains;
construction of storage reservoirs including chlorination equipment,
supply and installation of distribution system within each town;
provision of power supply to all installations and the construction of
ancillary buildings.
7. Number and titles of lots: Lot No 1 — SNNP region (2 towns).
Lot No 2 — Amhara region (7 towns).
Lot No 3 — Oromiya region (4 towns).
Lot No 4 — Tigray region (2 towns).
Terms of participation
8. Eligibility and rules of origin: Participation in tendering is open on
equal terms to all natural and legal persons (participating either
individually or in a grouping (consortium) of tenderers) which are
established in 1 of the Member States of the European Union contributing
to the European Development Fund and ACP States and international
organisations as authorised by the instrument applicable to the programme
under which the contract is financed (see also heading 22 below). All
works, supplies and services under this contract must originate in 1 or
more of these countries.
9. Grounds for exclusion: Tenderers must submit a signed declaration,
included in the tender form for a works contract, to the effect that they
are not in any of the situations listed in point 2.3.3 of the 'Practical
Guide to contract procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender per lot.
Tenders for parts of a lot will not be considered. Any tenderer may state
in its tender that it would offer a discount in the event that its tender
is accepted for more than 1 lot. Tenderers may not submit a tender for a
variant solution in addition to their tender for the works required in the
tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of:
— 90 000 EUR for lot 1,
— 150 000 EUR for lot 2,
— 190 000 EUR for lot 3,
— 130 000 EUR for lot 4,
when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contract by all parties.
This guarantee will be called upon if the tenderer does not fulfil all
obligations stated in its tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided together with
the return of the countersigned contract no later than 30 days after the
tenderer receives the contract signed by the contracting authority. If the
selected tenderer fails to provide such a guarantee within this period,
the contract will be void and a new contract may be drawn up and sent to
the tenderer which has submitted the second best admissible tender.
13. Information meeting and/or site visit: Not applicable.
14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of performance: The period elapsing between the date of
commencement until provisional acceptance is 24 months.
Selection and award criteria
16. Selection criteria: 1. The tenderer must be a registered firm or
natural person capable of carrying out the specified works.
2. The average of annual turnover of the tenderer over the last 3 fiscal
years should exceed:
— for lot 1: 2 000 000 EUR,
— for lot 2: 3 300 000 EUR,
— for lot 3: 4 300 000 EUR,
— for lot 4: 2 900 000 EUR,
or equivalent currency. A tenderer tendering for more than one lot should
have the average of annual turnovers exceeding the cumulative values of
the related lots. For purposes of converting another currency to euro, the
conversion rates, published in the Official Journal of European Union at:
http://ec.europa.eu/budget/inforeuro/index.cfm?Language=en shall be used.
For calculating annual turnovers in euro, the rates for June of each year
shall be used.
3. They must carry out at least 70 % of the contract works with their own
resources, which means that they must have the equipment, materials, human
and financial resources necessary to enable them to carry out that
percentage of the contract.
4. They must have access to sufficient credit and other financial
facilities to cover the required cashflow for the duration of the
contract. In any case, the amount of credit available must exceed the
equivalent of:
— for lot 1: 1 500 000 EUR,
— for lot 2: 2 500 000 EUR,
— for lot 3: 3 250 000 EUR,
— for lot 4: 2 200 000 EUR.
5. They must have completed at least 2 projects of similar
nature/complexity comparable to the works concerned by the tender over the
last 10 years. The contracting authority reserves the right to ask for
copies of the respective certificates of final acceptance signed by the
supervisors/contracting authority of the projects concerned.
The tenderer tendering for each lot should have successfully completed
similar projects within the last 10 years (provisional acceptance
certificate should have been issued within the last 10 years) as defined
below:
— for lot 1: a contract with a minimum value of 2 000 000 EUR,
— for lot 2: a contract with a minimum value of 3 300 000 EUR,
— for lot 3: a contract with a minimum value of 4 300 000 EUR,
— for lot 4: a contract with a minimum value of 2 900 000 EUR.
The tenderer tendering for more than 1 lot should have successfully
completed contracts with the cumulative value of the requirements for each
lot that the tenderer is bidding for.
The contracting authority reserves the right to ask for originals of the
respective certificates of provisional or final acceptance signed by the
project managers/contracting authority of the concerned projects.
6. All their key personnel must have 8–10 years appropriate experience and
proven qualifications relevant to works of a similar nature to this
project. Key personnel shall include but not be limited to:

— CE/WE: civil/water engineering, E/M: electro-mechanical engineering.
7. Joint ventures as a whole must satisfy the following minimum
qualifications. Their annual turnovers in the past 3 years must be
equivalent to the amount specified in clause 4.2 of the instructions to
tenderer.
The minimum selection criteria for a joint-venture/consortium as tenderer
are as follows:
a) the leading partner shall meet no less than 50 % of the economic and
financial standing criteria (2) specified above;
b) the other partners shall each meet no less than 10 % of the economic
and financial standing criteria (2) specified above;
c) all partners must collectively meet the economic and financial standing
(2, 4) and technical and professional capacity criteria (6) specified
above;
d) each individual member shall satisfy the sound financial position,
legal status and litigation history criteria.
Tenders submitted by companies in partnerships forming a joint
venture/consortium must also fulfil the following requirements:
the tender must include all the information required by subclause 4.1 of
the instructions to tenderer for each member of the joint
venture/consortium and the summary data for execution of works by the
tenderer.
The tender must be signed in a way that legally binds all members. See
form 4.6.5 in volume 1, section 4 of the tender documents.
1 member must be appointed lead member and that appointment confirmed by
submission of powers of attorney signed by legally-empowered signatories
representing all the individual members.
The tender must include a preliminary agreement or letter of intent
stating that all members assume joint and several liability for the
execution of the contract, that the lead member is authorised to bind, and
receive instructions for and on behalf of, all members, individually and
collectively, and that the lead member is responsible for execution of the
contract, including payments.
All members of the joint venture/consortium are bound to remain in the
joint venture/consortium for the whole execution period of the contract.
