SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:

II.1.4) Information on framework agreement: Framework agreement with
several operators.

II.1.5) Short description of the contract or purchase(s): The Homes and
Communities Agency (HCA) is seeking to establish a framework of delivery
partners who will work with the HCA and other contracting authorities who
may decide to take advantage of this framework. The framework will be for
3 years and be split into 3 regional clusters each with 6 to 12 members.
The Northern framework will cover the North East, North West and Yorkshire
and Humberside, the Midlands framework will cover East & West Midlands and
East of England, and the Southern framework will cover South East, South
West and London.
The framework will cover the full range of development activity including,
but not limited to, the raising and/or deployment of
development/construction finance, the design and construction of
residential and other buildings (including infrastructure), and the
sales/lettings and marketing of properties. Framework members will be
responsible for securing sales of the completed homes.
The framework may also be used to secure the expertise of framework
members in comprehensive development management across the following
areas, which may be drawn down independently to works elements - project
and programme management, brokering finance and funding, land and
planning, design and technical, commercial, construction management, and
sales and marketing.
The framework is being procured by the HCA but is open to Regional
Development Agencies, Local Authorities, Urban Regeneration Companies,
Urban Development Corporations, Registered Social Landlords and other
contracting authorities involved in housing and regeneration within
England.
Call offs from the framework will be via a competitive process to identify
the most economically advantageous delivery partner on a case by case
basis.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: It is envisaged that the framework will
be used to progress the majority of the HCA's development opportunities as
they arise. The quantity and scope of these opportunities will be
influenced by prevailing market conditions and the availability of
funding. Potential exists however for certain opportunities to be excluded
from the framework and these include simple sale of land (including plot
sales), sites allocated for social housing, or where there is no agreement
to use the framework when working jointly with local partners.
The framework will be open to other contracting authorities to use at
their discretion.
The following broad core areas of works and service may be covered by the
framework - housebuilding; mixed use development; city centre sites; and
estate regeneration. The following specialist areas are also covered -
small sites; elderly, specialist and high dependency accommodation; and
historic buildings and conversions.
The references to numbers of operators invited or appointed at II.1.4 and
IV.1.2 reflects the number for each regional cluster.
It is further envisaged that the framework will operate for 3 years. The
HCA reserves the right to extend the framework for a further year.

months: 36 (from the award of the contract).

Justification for the choice of accelerated procedure: The Accelerated
Restricted Procedure is being used to support the early set up of the
framework and call off thereon as the early award will benefit the economy
and in particular the housing industry.
IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged minimum number: 12. Maximum number: 20
Objective criteria for choosing the limited number of candidates: Refer to

VI.3) ADDITIONAL INFORMATION: The HCA has a suite of professional
services frameworks which will be subject to separate procurements later
in 2009.
All discussions, meetings and communications will be conducted in English.
The contract will be subject to English law. Tenders and all supporting
documents must be priced in GBP and all payments under the contract will
be made in GBP.
Candidates are advised that the HCA is subject to the Freedom of
Information Act 2000 ("the Act").
If a candidate considers that any of the information supplied as part of
this procurement procedure should not be disclosed because of its
commercial sensitivity, confidentiality or otherwise, they must, when
providing this information, clearly identify the specific information they
do not wish to be disclosed and clearly specify the reasons for its
sensitivity. The HCA shall take such statements into consideration in the
event that it receives a request pursuant to the Act which relates to the
information provided by the interested party. Please note, it is not
sufficient to include a statement of confidentiality encompassing all the
information provided in the response.

email by no later than 8.8.2009.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The contracting authority will incorporate a minimum of
10 calendar days standstill period at the point information on the award
of the contract is communicated to tenderers. This period allows
unsuccessful tenderers to seek further debriefing from the contracting
authority before the contract is entered into. Applicants have 2 working
days from notification of the award decision to request additional
debriefing and that information has to be provided a minimum of 3 working
days before the expiry of the standstill period. Such additional
information should be requested from the address in section I.1. If an
appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the court may order
the setting aside of the award decision or order the contracting authority
to amend any document and may award damages. If the contract has been
entered into the court may only award damages.
