The Property Mortgaged To DFCC Bank By: Kammellaweera Dayarathne Silva of Katana carrying on business as Sole Proprietor under the name style and firm of "Dayarathne Tyre Works" at Katana has made default in payments due on Mortgage Bond No. 4146 dated 14/11/2006 attested by A W Gunawardhane Notary Public of Kurunegala. Description of Property Mortgaged by Mortgage Bond No. 4146 All that divided and defined allotment of land marked Lot 2 & 3 depicted in Plan No.3656 dated 15-03-2000 made by S Welagedara Licensed Surveyor of the land called KAHAMBILIYWA WATTA situated at Kadawala in Aluthkuru Korale of Dunagaha Pattu in the District of Gampaha Western Province. Containing In Extent: A0:R0:P16 Lot 2 - A0:R0:P12 Lot 3 - A0:R0:P16 Together with the everything else standing thereon. The successful purchaser will have to pay the following amounts in cash at the fall of the hammer. 1) 10% (Ten Percent) of the Purchased Price. 2. 1% (One Percent) of the sales Taxes payable to the Local Authority. 3) Auctioneer's Commission of 2 1/2 % (Two and a half percent only) 4) Total cost of advertising Rs 35,900.00 5) Clerk's & Crier's Fee of Rs 500.00 6) Notary's Fee for condition of Sale Rs 2000.00 The balance 90% of the purchased price together with any other statutory levies, duties, taxes or charges whenever applicable and imposed by the Government of Sri Lanka or any other authority to be payable within 30 days from the date of sale. Should any dispute arise between two or more bidders the lot will be put up again and re-sold. 2) A deposit of 50 percent (50%) to be made on each lot if required, at the time of sale. 3) All lots to be at the risk of the purchaser from the time of purchase, and no lot can be delivered while the sale is proceeding. 4) Should any mistake be made in describing a lot such mistake will not be held to vitiate or effect the sake if such lot in anyway – it being understood that intending purchasers will satisfy themselves on all points before bidding and no allowance will be made for imperfections discovered after the lots are knocked down. 5) No goods to be removed without the sanction of the Auctioneer. Any person removing any portion of the property without an order from the Auctioneer will be subject to an action at law. 6. Purchasers will bear all expenses of taking down and removing all lots purchased and shall make good any unnecessary damage, which may be caused thereby. 7) Notice- Servant’s bids will not be taken unless they produce an authority from their masters prior to the sale. 8. All articles must be paid for before delivery and removed immediately after the sale, otherwise they will be resold by public or private sale at the risk of the purchaser who will not be entitled to claim any surplus if any, at such re-sale will be liable for any deficiency. 9) The Auctioneer to have the option to refuse any bids. 10) No Goods Will Be Delivered Without Payment.
