Contract specifications
6. Description of the contract: The contract is part of the rural feeder
roads programme. The project road is located in Mchinji district, in the
western part of the Central Region of Malawi. The project starts at
Mchinji town, which is located about 115 km west of Lilongwe near the
border with Zambia and runs in a northerly direction, across a flat and
undulating terrain, up to Kawere (26 km). The road is constructed of
lateritic gravel of varying thickness and width, with an average
carriageway width of 6,0 metres (2 × 3 m lanes) and 1 m shoulders on both
sides.
The works comprise upgrading the 26 km gravel road to a single surface
dressed with 19 mm and 10 mm slurry between Mchinji and Kawere. Drainage
construction includes repair of existing, and installation of new,
prefabricated concrete pipes and box culverts. The works will be
contracted under the EDF general conditions for works contracts where the
supervisor will be the Roads Authority of Malawi and the supervisor's
representative will be appointed under a separate contract. The period of
performance is expected to be 18 months and a 12-month maintenance period.
The contractor will be required to provide all the plant, machinery,
labour, materials and supplies including the location of borrow pits and
quarries to complete the works.
7. Number and titles of lots: 1 lot: upgrading of Mchinji–Kawere (S118)
road.
Terms of participation
8. Eligibility and rules of origin: Participation is open on equal terms
to all natural and legal persons (participating either individually or in
a grouping (consortium) of tenderers) of the Member States of the European
Union and the countries and territories of the regions covered and/or
authorised by the regulation or other specific instruments applicable to
the programme under which the contract is financed (see also heading 21
below). All goods supplied under this contract must originate in these
countries.
9. Grounds for exclusion: Tenderers must submit a statement to the effect
that they are not in any of the situations listed in point 2.3.3 of the
'Practical guide to contract procedures financed by the 9th EDF'.
10. Number of tenders: Tenderers (including firms within the same legal
group, other members of the same consortium, and subcontractors) may
submit only 1 tender for the lot. Tenders for parts of a lot will not be
considered. Any tenderer may state in their tender that they would offer a
discount in the event that their tender were accepted for more than 1 lot.
Tenderers may not submit a tender for a variant solution in addition to
their tender for the works required in the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of 10 000
EUR when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contract by all parties.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided no later than
30 days after the tenderer receives the contract signed by the contracting
authority. If the selected tenderer fails to provide such a guarantee
within this period, the contract will be void and a new contract may be
drawn up and sent to the tenderer which has submitted the second best
admissible tender.
13. Information meeting and/or site visit: A mandatory information
meeting and/or a site visit will be held on 3.8.2009 (10:00) at Mchinji
Boma, Malawi. A written notice informing of the expected number and names

14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of execution: The period of execution shall be 18 months and
the maintenance period will be for 12 months.
Selection and award criteria
16. Selection criteria: The selection criteria shall be as per that
stated in the tender dossier. Among other criteria, Volume 1,
'Instructions to tenderers', clause 4.2 and 4.3, Section 3 states:
'in order to be considered eligible for the award of the contract,
tenderers must provide evidence that they meet or exceed certain minimum
selection criteria. This evidence must be provided by tenderers in the
form of the information and documents described in subclause 4.1 and in
whatever additional form tenderers may wish to utilise'.
The minimum selection criteria for each tenderer are as follows:
1. They must be a registered firm or natural person capable of carrying
out the specified works.
In the case of a joint venture, all members together or as individual
entities must satisfy the minimum requirements set out below. NB: The
joint venture as a whole must satisfy the minimum qualifications required
below.
2. The average annual turnover in the past 3 years must be equivalent to 5
000 000 EUR.
3. They must carry out at least 70 % of the contract works by their own
resources, which means that they must have the equipment, materials, human
and financial resources necessary to enable them to carry out that
percentage of the contract.
4. Whether they are a sole tenderer, or a joint venture, they also must
have access to sufficient credit and other financial facilities to cover
the required cash flow for the duration of the contract. In any case, the
amount of credit available must exceed the equivalent of 500 000 EUR.
5. If they are the lead member of a joint venture/consortium, they must
have the ability to carry out at least 50 % of the contract works by their
own means, as defined in subclause 4.
6. If they are another partner of a joint venture/consortium (i.e. not the
lead member) they must have the ability to carry out at least 10 % of the
contract works by their own means, as defined in subclause 4.
7. He must have completed at least 2 projects of the same
nature/amount/complexity comparable to the works concerned by the tender
over the last 10 years. The contracting authority reserves the right to
ask for copies of the respective certificates of final acceptance signed
by the supervisors/contracting authority of the projects concerned.
8. All their key personnel (excluding environmentalist and drafts person)
must have at least 10 years appropriate experience and proven
qualifications relevant to works of a similar nature to this project. The
environmentalist and drafts person shall have at least 5 years of
post-qualification experience.
Tenders submitted by companies in partnerships forming a joint
venture/consortium must also fulfil the following requirements:
— the tender must include all the information required by subclause 4.1
for each member of the joint venture/consortium and the summary data for
execution of works by the tenderer,
— the tender must be signed in a way that legally binds all members. See
form 4.6.5 in Volume 1, Section 4 of the tender documents,
— 1 member must be appointed lead member and that appointment confirmed by
submission of powers of attorney signed by legally-empowered signatories
representing all the individual members,
— the tender must include a preliminary agreement or letter of intent
stating that all members assume joint and several liability for the
execution of the contract, that the lead member is authorised to bind, and
receive instructions for and on behalf of, all members, individually and
collectively, and that the lead member is responsible for execution of the
contract, including payments,
— all members of the joint venture/consortium are bound to remain in the
joint venture/consortium for the whole execution period of the contract.
17. Award criteria: Price.

18. How to obtain the tender dossier: The tender dossier is available

upon payment of a non-refundable fee of 10 000 MWK which excludes courier
delivery. It is also available for inspection at the premises of the
contracting authority. Tenders must be submitted using the standard tender
form included in the tender dossier, whose format and instructions must be
strictly observed.

before the deadline for submission of tenders given in item 19. The
contracting authority must reply to all tenderers' questions at least 11
days before the deadline for submission of tenders.

Any tender received after this deadline will not be considered.
20. Tender opening session: The tender opening session will take place on
12.10.2009 (15:30) at the NAO Support Unit, Ministry of Finance, Annex
Building, Capital Hill, city centre in Lilongwe.
21. Legal basis: ACP–EC Partnership Agreement signed at Cotonou on
23.6.2000.
