SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): A new four
stage Jobseeker’s Regime is being introduced across Great Britain.
Flexible New Deal will replace the current mandatory New Deals, including
Private Sector Led New Deals and Employment Zones. Jobcentre Plus will
deliver stages one to three of the Jobseeker’s Regime for all new
Jobseeker’s Allowance customers. Customers who have not secured
sustainable employment during the first three stages of the new
Jobseeker’s Regime will enter stage four, a supplier-led Flexible New
Deal.
Implementation of Flexible New Deal is being delivered over two phases.
Phase 1 will commence from October 2009 and is already at the contract
award stage. This competition focuses only on suppliers who wish to
deliver Phase 2 of the Flexible New Deal from October 2010. Organisations
from the public, private and third sector are being invited to bid to
deliver the fourth stage, offering a more personalized, flexible and
innovative package of support to help customers find and sustain
employment. Stage four, will last for up to 12 months for each participant
and will include a minimum four-week period of mandatory, full-time
activity for customers.
For the procurement of Flexible New Deal Phase 2, the recommended approach
in the 14 contract package areas is that DWP will let contracts with one
or two prime contractors in each area. DWP will enter into contracts with
single lead entities who will deliver Flexible New Deal in one of the
following ways:
— Direct delivery of a proportion of the provision and subcontracting of
the remaining provision to other organisations; or,
— Sub-contracting of the entire provision to other organisations; or,
— Direct delivery by one organisation.
DWP has no preference for any of these options and all bids will be
considered on their merits. However, due to the size and complexity of
contracts to be awarded, it is unlikely that any single organisation could
deliver Flexible New Deal as a sole deliverer. Where organisations intend
to bid as a consortium, they may nominate a lead organisation who will act
as the prime supplier (with the other organisations as sub-contractors) or
they may set up a new legal entity such as a Special Purpose Vehicle (SPV)
to bid for the contracts.
Information on expected volumes is provided in the Provision Specification
on the Supplying DWP website as a guide only. Due to the nature of the
services to be provided and the current economic uncertainty, volumes are
likely to change both in the short term and throughout the duration of the
contract. Close working and an iterative dialogue will be required
throughout the procurement process to ensure that customer needs continue
to be met.

procured using a 2 stage tendering approach. For the first stage of the
process, bidders will complete a Pre-Qualification Questionnaire (PQQ).

for the second phase.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This authority will incorporate a minimum 10 calendar day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have 2 working days from notification of the
award decision to request additional debriefing and that information has
to be provided a minimum of 3 working days before expiry of the standstill
period. Such additional information should be requested from the officer
named in section I.1 of this contract notice or in the letter / e-mail
providing the information about contract award if different. If an appeal
regarding the award of a contract has not been successfully resolved, the
Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved
parties who have been harmed or are at risk of harm by a breach of the
rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the court may order
the setting aside of the award decision or order the authority to amend
any document and may award damages. If the contract has been entered into
the court may only award damages. The purpose of the standstill period
referred to above is to allow parties to apply to the Courts to set aside
the award decision before the contract is entered into.
