SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
UK-London: procurement of a private sector partner to invest in a public
private partnership vehicle a local education partnership (lep) for
building schools for the future.

II.1.4) Short description of the contract or purchase(s): The London
Borough of Tower Hamlets is seeking an innovative private sector partner
or partners to participate and invest in a new Public Private Partnership
vehicle, (a 'Local Education Partnership' or 'LEP') to be established
jointly with some or all of the contracting authorities.
Tje LEP may provide (or arrange for the provision of) 'Partnership
Services', which may include (but not be limited to) the development of a
strategic investiment programme for:
(a) educational facilities including Secondary Schools and may include the
Primary School Capital Programme and Olympic legacy development projects
in relation to schools;
(b) community facilities that support education outcomes (e.g. co-location
and integration of key services such as education, social services,
children's services, health-care services etc);
(c) other civic/corporate buildings within the Council's control;
(d) facilities management across the Council's property estate;
(e) ICT managed services across the Council's property estate;
(f) Corporate /education planned and reactive maintenance;
(g) Housing programme works; and
(i) works relating to the Council's property portfolio; and any other
facilities or ancillary services to the above to be provided by the
contracting authorities in the exercise of the powers contained in Section
2(1) of the Local Government Act 2001;
The London Borough of Tower Hamlets will assess applicants on their
technical and professional ability and financial and economic standing to
provide Building Schools for the Future educational facilities, the value
of which is currently estimated to be approximately 180 000 000 GBP for
the authority's secondary schools programme. However, such assessment will
also take account of each applicant's capacity to deliver the additional
services described in (a) to (i) above as potential future opportunities
for delivery through the LEP (or through a special purpose vehicle
established by the LEP for that purpose) subject to the London Borough of.
Tower Hamlets strategic direction and LEP performance and demonstration of
value for money.
The Partnership Services may include (but shall not be limited to) any of
the following services or provision:
1. strategy advisory services;
2. programme management services;
3. project development services;
4. procurement consultancy services;
5. property related services involved in asset management, including but
not limited to real estate services and associated professional and
technical services; and
6. procurement and delivery or management of all services required to
deliver the strategic investment programme for the services mentioned in
(a) to (i) above (including through the provision, integration and
management of supply chain arrangements). It is anticipated that such
services may include in varying degrees:
(i) architectural services;
(ii) engineering services
(iii) construction services;
(iv) technical services;
(v) building services;
(vi) hard facilities management services;
(vii) soft facilities management services;
(viii) information communication and technology ("ICT") services;
(xi) educational support services;
(x) education programme development services;
(xi) educational strategy services; and
(xii) security support services; and
(xiii) furnitures, fixtures and equipment and supplies and services, for a
period of 10 years with an option to extend for a further 5 years, such
option being exercisable during the initial 10 year term.
For the Secondary Schools programme there will be a mixture of new build
and refurbished facilities, will be delivered under design and build
capital arrangements. Other funding routes, e.g. PFI, may be used for any
future other projects delivered through the LEP.
The LEP may also be required to provide for, or arrange for the provision
(through supply chain arrangements) or, the management and/or integration
of the Partnership Services, design and build and construction contracts,
facilities management services, support services and ICT services (this
list is not exhaustive). The London Borough of Tower Hamlets will expect
all contracts to involve organisations that pursue innovation and
excellence in design, capital development and support services.

Through the duration of the contract the London Borough of Tower Hamlets
may extend the number of education organisations it wishes to engage with
the LEP, subject to strategic requirements where other Governing Bodies
(including Voluntary Aided Schools, Diocesan Authorities, Academies, Trust
Schools and Trustees) within the London Borough of Tower Hamlets may be
included as contracting authorities partnerships for Schools is the non
departmental public body established by the Department for Education and
skills to implement the BSF initiative. Building Schools for the Future
Investments LLP has been established by the Department of Education and
Skills and Partnerships UK as the body which will invest equity in the
LEP. More information on the BSF initiative is set out at

Section I.2 - Additional types of contracting authority: national
agency/office, body governed by public law.
Section II.1.9 - Variants will be accepted in addition to a compliant bid
(as set out in the tender/contract documents) providing the London Borough
of Tower Hamlets' core requirements are met and provided they are in
accordance with the tender/contract documents.
Section II.2.2 and II.3 - The partnering contract between the private
sector partner and the contracting authorities will be for a period of 10
years with an option to extend for a further 5 years, such option being
exercisable during the initial 10 year term. The term of any design and
build, PFI, facilities management, management services or ICT agreements
or other agreements flowing from the partnership may extend beyond this
period.
Section IV.3.3 - The PQQ and information memorandum are available upon
request from the address specified in Section I.1 from the date of
despatch of this notice to [insert PQQ closing day and time]. Expressions
of interest must be by way of completion and the pre-qualification
questionnaire (PQQ) returned by noon, Monday 2.4.2007.
The Council is intending to use a secure web portal to manage the tender
process electronically.

Contract Award Additional Information.
The OJEU value (GBP 180 000 000) covered the investment for the entire
estate. However, the procurement is delivered for the whole estate through
the creation of the LEP, in order to establish the LEP, bidders were
invited to develop and cost 2 sample schemes plus an ICT managed service.
We then issue through the LEP new projects, known as non sample at an
agreed interval. Therefore the contract value quoted in the award notice
is, as we have only accepted tenders for 2 schemes, ICT managed service
and the LEP.
The duration of the contract will be for a period of ten years (10) with
an option to extend (exercisable during the intial 10 year term) for a
further five (5) years.
