SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Calderdale Council "Halifax Customer First" Accommodation Project.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Works.
Realisation, by whatever means of work, corresponding to the requirements
specified by the contracting authorities.
Main site or location of works: Halifax, West Yorkshire.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The Authority
is proposing to procure premises for offices and a Customer First Facility
extending in total to around 7 000 m² in Halifax. It is anticipated that
the new Customer First facility and office accommodation will provide
state-of-the-art facilities responding to changing patterns of use and
innovation, an attractive environment for users and, where currently
provided, significant efficiencies over present arrangements – both in
terms of operation and space use.
The Council is seeking to ensure the best use of property and financial
resources. All the premises must ultimately enable the Council to achieve
its corporate objectives in terms of transformation and modernisation.
Most of all, the premises must effectively support the Council in the
delivery of local services, unlocking process improvement and efficiency
in the Council’s operations. It is inviting bidders to submit proposals
for schemes in Halifax, which could incorporate these facilities.
There is a preference to see the requirements being met by a scheme on a
single site located within Halifax Town Centre, in close proximity to
public transport and meeting performance and functionality requirements.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Ca 7 000 m² of accommodation to meet
Council’s requirements. The successful bid could include taking
responsibility under a private developer scheme for commercial risks for
the delivery of the facilities detailed under I.1.5. Alternatively, the
Council could proceed on a shared risk basis, whereby the risks are
assigned to the party best able to deal with them on a risk by risk basis
depending on the type of contract agreement.
Estimated value excluding VAT:
Range: between 4 000 000,00 and 16 000 000,00 GBP.

II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 36 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Parent company guarantees,
bonds and/or collateral warranties from principal as well as
sub-contractors may be required. The deposits or guarantees required by
the Authority will be set out in the Tender Documents.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: As detailed in the
tender documents.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: The contracting authority reserves the
right to require that each party undertakes joint and several liability.
In case of a consortium (which may include sub-contractors), a lead
contractor is required. There must be appropriate security for all
contractual obligations.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
Social and Environmental considerations may form part of the contract
conditions in accordance with Regulation 39 of the Public Contracts
Regulations 2006 and Article 26 of Directive 2004/18/EC. Details will be
provided in the tender documents.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Interested
parties will be required to complete a pre-qualification questionnaire
(PQQ). The PQQ will accompany the Marketing and Information Paper, which
should be downloaded by interested parties from the SCMS website
http://scms/alito.co.uk.
The completed PQQ must be then be returned electronically via the SCMS
website http://scms/alito.co.uk no later than 12:00 noon (GMT) on
15.5.2009.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: As specified in the
prequalification questionnaire document and/or Marketing and Information
Paper and pursuant to Articles 45-52 of Directive 2004/18/EC.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: As specified in the prequalification
questionnaire document and/or Marketing and Information Paper and pursuant
to Articles 45-52 of Directive 2004/18/EC. The Council welcomes
submissions from any suitable, experienced developer. The selected
developer will be able to demonstrate resources and capability to deliver
scheme proposals, and evidence of prior development experience, working
with both public and private partners.

SECTION IV: PROCEDURE
IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Accelerated restricted.
Justification for the choice of accelerated procedure: Given the gravity
of the current economic climate, it is crucial that this project is
completed with the uttermost urgency. The project forms part of a major
public investment, the rapid completion of which will ensure the timely
distribution of public funds into the marketplace. This project is one of
several which constitute the “Halifax First” programme. It is essential to
co-ordinate each project to meet the overall Programme deadline of
December 2011, the end date of this project being timed to meet that
endeavour. In light of the European Commission’s guidance on the use of
the accelerated procedure, it is felt necessary that this project is
completed as soon as possible as it is likely to have the requisite effect
of boosting the economy through the rapid execution of the contract.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: When the decision has been taken to award the contract,
the contracting authority will incorporate a minimum 10 calender day
standstill period between the date on which information on the award of
the contract is communicated to tenderers and the date on which the
contracting authority proposes to enter into the contract. Applicants have
2 working days from notification of the award decision to request
additional debriefing and that information has to be provided a minimum of
3 working days before expiry of the standstill period. If an appeal
regarding the award of a contract has not been successfully resolved the
Public Contracts Regulations 2006 provide for aggrieved parties who have
been harmed or are at risk of harm by a breach of the rules to take action
in the High Court (England, Wales and Northern Ireland). Any such action
must be brought promptly (and generally within 3 months). Where a contract
has not been entered into the court may order the setting aside of the
award decision or order the authority to amend any document and may award
damages. If the contract has been entered into the court may only award
damages.

The decision to discontinue the award procedure is based on the following
reasons:
(1) All of the bidders in the process failed to meet one or more of the
specified minimum performance requirements set out in the invitation to
tender, resulting in all tenders being disqualified;
(2) All tenders were submitted at a price/cost level which was
substantially in excess of the budget that had been set aside for this
project;
(3) There has been a change in the accommodation needs of the Council. The
amount of accommodation which would be procured under the project as
advertised would exceed the needs of the Council;
(4) The quality of the tenders submitted is significantly below the
Council’s expectations and what the Council is prepared to accept.
