water pipelines using preinsulated pipes – year 2
(implementing year 2009)

1. The HEP d.d., Vukovarska 37a - ZAGREB, Republic of Croatia has applied for a loan from the IBRD - International Bank for Reconstruction and Development toward the cost of Reconstruction of district heating pipelines using preinsulated pipes in Zagreb and Osijek.
2. The HEP-Toplinarstvo d.o.o. Miševečka 15 a, 10000 ZAGREB, Republic of Croatia now invites sealed bids from eligible and qualified Bidders for works for reconstructions of hot water pipelines using preinsulated pipes – year 2 (implementing year 2009). The beginning of works is 15th April 2009 and completion date is 15th Sptember 2009. The works consist of 4 lots as it follows:

Note: Bidders are allowed to submit bids for one or more lots. Bids shall be evaluated on a per lot basis and the contract for the relevant lot shall be awarded to the lowest evaluated responsive bidder that meets the qualification requirements in accordance with ITB 5.5. Cross discounts shall not be taken into account.
3. Bidding will be conducted through the International Competitive Bidding (ICB) procedures specified in the World Bank’s Guidelines - May 2004 (Revised May 2005): Procurement under IBRD Loans and IDA Credits, and is open to all Bidders from Eligible Source Countries as defined in the Guidelines.

5. Qualifications requirements include:
(a) Financial Capability. The Bidder shall furnish documentary evidence that it meets the following financial requirements:
(1) The requested average annual financial amount of construction work within the period from the year 2004 to 2008 shall be at least EUR 11.400.000,00 for I. LOT - ZAGRE, EUR 11.000.000,00 for II. LOT – ZAGREB, EUR 4.200.000,00 for III. LOT – OSIJEK and EUR 4.000.000,00 for IV. LOT – OSIJEK
These requirements shall be fulfilled for each individual LOT. If the Bidder is going to submit the Bid for several lots, the required financial value of works during the last five years must be equal to the sum of works values for lots for which the Bidder has submitted the Bid

(2) reports on the financial standing of the Bidder, such as profit and loss statements and auditor’s reports for the past five (5) years;
(3) Evidence of adequacy of working capital for a minimum amount of: EUR 1.400.000,00 for I. LOT - ZAGRE, EUR 1.300.000,00 for II. LOT – ZAGREB, EUR 500.000,00 for III. LOT – OSIJEK and EUR 450.000,00 for IV. LOT – OSIJEK
These requirements shall be fulfilled for each particular LOT. If the Bidder is going to submit the Bid for several lots, the required minimum amount of liquid assets and/or credit facilities net without other contractual commitments must be equal to the sum for lots for which the Bidder has submitted the Bid .

(b) Experience and Technical Capacity. The Bidder shall furnish documentary evidence to demonstrate that it meets the following experience requirements:
(1) experience in works of a similar nature and size - minimum of 2 contracts of similar nature and size in the last five years, within the period from 2004 to 2008 (name and head office of the company, subject of the contract, value of the contract, time and place of completion of the contract , and person who may be contacted for further information on those contracts) with appended certificates issued by earlier clients on adequate delivery of contractual obligations during the last five (5) years.
These requirements shall be fulfilled for each particular LOT. If the Bidder is going to submit the Bid for several lots, the required number of works during last five years must be equal to the sum of works for lots for which the Bidder has submitted the Bid . As evidence of fullfilling above requested requirements the Bidder has to submit certificates issued by earlier clients on adequate fulfillment of contractual obligations.

(c) The Bidder shall furnish documentary evidence to demonstrate that the Works it offers meet the following usage requirement:
(1) All works have to be documented and have to follow the requirements induced in Section VII – Specification and Performance Requirements
(2) Evidences about fullfilling the requirements from ITB 5.

(d) Other documents:

(1) Certificate ISO 9001/2000,
(2) Statement of unpunishment with regard to potential involvement in a criminal organization, corruption, fraud or money laundering, certified by the authority. The Statement has to be signed by the authorized person of the Bidder, both for oneself and for its legal entity,

(3) Internal Revenue Certificate on paid taxes,
(4) Certificate of capability for performing of welding works according to ISO EN 729-2,
(5) Compliance of the Ministry of Environmental Protection, Physical Planning and Construction for the constructions of the III. group structures (pipelines) in accordance with Regulations about terms and criteria for issuing the compliance for setting-up of constructing operations (National gazette Narodne novine 89/06 and 139/06). Compliance has to be submitted in original or copy certified by the competent authority and it must not be older then 6 months before announcing ICB.

(6) The Bid Security on a amount of EUR 25.500,00 for I. LOT - ZAGRE, EUR 24.500,00 for II. LOT – ZAGREB, EUR 9.500,00 for III. LOT – OSIJEK and EUR 9.000,00 for IV. LOT – OSIJEK

(7) Copies of certified original documents defining the constitution or legal status, place of registration, and principal place of business of the Bidder;

6. A complete set of Bidding Documents in English and/or Croatian may be purchased by interested Bidders on the submission of a written Application to the address together with evidence of payment of a non-refundable fee of HRK 1,100.00 or EUR 150.00 (VAT is included). The Bidding Documents will be sent by courier or via e-mail. The method of payment will be :

7. Bids must be delivered to the address below at or before 31th March 2009 at 12.55 hours, local time. Electronic bidding will not be permitted. Late bids will be rejected. Bids will be opened in the presence of the Bidders’ representatives who choose to attend in person at the address below at at 31th March 2009 at 13.00 hours.
