OGCbuying.solutions requires to establish framework agreements for use by
or on behalf of UK public sector bodies (see VI.3).
The wider Public Sector has a need for comprehensive fleet management
services to include but not restricted to:
Lot 1 - Fleet Maintenance Services, Roadside Assistance, Administration,
Accident Management, Fuel Card Administration, Insurance Management, Fines
Management, Acquisition and Disposal of vehicles and the provision of
Management Information.
Lot 2 - Fleet Audit & Consultancy e.g. Policy Development, Duty of Care
and Technology.
Lot 3 – any or all of the above services with the potential addition of
Contract Hire with guaranteed maintenance and enhanced security
specifically for HMRC and Contracting Authorities with the same enhanced
security requirements.
Successful suppliers will be required to utilise enabled collaborative
framework agreements. Further details will be provided in the ITT
documentation.

TITLE: Mandatory and Desirable Fleet Management Services Requirements

enhanced security requirements

5) ADDITIONAL INFORMATION ABOUT LOTS: A framework agreement for HMRC and
Contracting Authorities with the same enhanced security requirements for
any or all of the above services described in Lots 1 and 2 but
specifically including 1) higher levels of security when managing,
maintaining and repairing a proportion of the fleet and potentially 2) a
small portion of vehicles in excess of 3.5 tonnes and potentially 3) a
small proportion of motorcycles and other (non standard) vehicles and/or
4) the additional potential for contract hire with guaranteed maintenance
for the section of car fleet not wholly owned.
It is anticipated that one (1) Framework will be awarded under this Lot.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Participants will be advised
if this is necessary during the procurement. Parent company and/or other
guarantees of performance and financial liability may be required by
Buying Solutions if considered appropriate.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: One member of any grouping /
consortium of suppliers will be required to accept prime contractorship.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Any supplier
may be disqualified who:
(a) is bankrupt or is being wound up, where his affairs are being
administered by the court, where he has entered into an arrangement with
creditors, where he has suspended business activities or is in any
analogous situation arising from a similar procedure under national laws
and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an
order for compulsory winding up or administration by the court or of an
arrangement with creditors or of any other similar proceedings under
national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata
in accordance with the legal provisions of the country of any offence
concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means
which the contracting authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social
security contributions in accordance with the legal provisions of the
country in which he is established or with those of the country of the
contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which he is
established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information
required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal
organisation, as defined in Article 2(1) of Council Joint Action
98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in
Article 3 of the Council Act of 26 May 1972 and Article 3(1) of Council
Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of
Article 1 of the Convention relating to the protection of the financial
interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined
in Article 1 of Council Directive 91/308/EEC of 10 June 1991 on prevention
of the use of the financial system for the purpose of money laundering.

The Contracting Authority intends to use an eTendering system in this
procurement.
Exercise and reserves the right to use a reverse auction.
Revenue compliance checks will be undertaken throughout the tendering
exercise using information from HMRC's own records. UK applicants will be
required to provide their tax reference numbers: i.e. Value Added Tax
registration number, PAYE collection reference and Corporation Tax or Self
Assessment reference, as applicable. Overseas or non-UK applicants will be
required to submit a certificate of tax compliance obtained from the
country in which they are resident for tax purposes. Applicants unable to
demonstrate an acceptable revenue compliance record may be excluded from
tendering or from further participation in the tendering exercise. If a

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: In accordance with Regulation 47 of the Public Contracts
Regulations 2006. OGCbuying.solutions will incorporate a minimum 10
calendar day standstill period starting from the date when the award
decision notification is dispatched to bidders. This period allows
unsuccessful bidders to seek further de-briefing from OGCbuying.solutions
before the contract is entered into. Applicants have until midnight of the
second working day of the standstill period for their additional
debriefing requests to reach OGCbuying.solutions. A response to such a
request must be provided to the bidder by a minimum of 3 working days
before the expiry of the standstill period. If an appeal regarding the
award of the contract has not been successfully resolved, the Public
Contracts Regulations 2006 (SI 2006 No. 5) provide for the aggrieved
parties who have been harmed, or are at risk of harm as a consequence of a
breach of the procurement rules to bring an action in the High Court. Any
such action must be brought promptly and in any event within 3 months of
the date when the grounds of complaint first arose. Where a contract has
not been entered into, the court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into, the court may only award
damages. The purpose of the standstill period referred to above is to
allow parties to apply to the court to set aside the award decision before
the contract is entered into.
