SECTION I: CONTRACTING AUTHORITY

SECTION II.A: OBJECT OF THE CONTRACT (WORKS)
II.1) TITLE ATTRIBUTED TO THE CONTRACT BY THE CONTRACTING AUTHORITY: West
Bromwich & Wolverhampton Law Courts.
II.2) TYPE OF CONTRACT AND LOCATION OF WORKS: Main site or location of
works: The site for the West Bromwich Courts building is Spon Lane, West
Bromwich, England and the site for the Wolverhampton Courts building is
Darlington Street, Wolverhampton, England.
NUTS code: UKG35.
II.3) THIS NOTICE INVOLVES A FRAMEWORK AGREEMENT: no.
II.4) SHORT DESCRIPTION OF NATURE AND SCOPE OF WORKS: The contracting
authority wish to procure the design and construction of new courts
buildings in West Bromwich in the order of 3 720 m² comprising four
Magistrates' Courts and associated administration and custodial
accommodation and Wolverhampton in the order of 9 969 m² comprising eight
Magistrates' Courts, five Civil/Family Courts, two Hearing rooms and
associated administration and custodial accommodation. It is currently
envisaged that both buildings will be procured as a combined project via a
single stage Design & Build procurement using an amended GC/Works/1
contract (with amendments).
Estimated cost of works excluding VAT:
Range: between 50 000 000 and 60 000 000 Currency: GBP.

II.7) CONTRACT COVERED BY THE GOVERNMENT PROCUREMENT AGREEMENT (GPA):

II.8) ADDITIONAL INFORMATION: The procurement will be run by Her
Majesty’s Courts Service, an executive agency of the Ministry of Justice
(“MoJ”). One of the roles of the MoJ is to secure the efficient
administration of justice in England and Wales. The current function of
the administration of justice has previously resided in a number of
government departments and offices and legal title to land and buildings
may be held in one of the Contracting Authority’s predecessor departments
or offices. Accordingly, although for convenience, this PIN refers to the
Contracting Authority, the legal party to the contracts and deeds
concluded pursuant to this procurement may be the Secretary of State for
Communities and Local Government, The Secretary of State for Justice, The
Lord Chancellor, and/or other crown bodies. It is currently intended to
procure both the West Bromwich Courts building and the Wolverhampton
Courts building under a combined project approach. However, following the
issue of this PIN, the Authority intends to carry out market research to
establish whether there is sufficient interest from the market for the
combined project approach. In the event that sufficient interest is not
forthcoming, the Authority reserves the right to split the buildings into
lots when formulating the Contract Notice due for issue in August 2009. If
this becomes necessary, the lots maybe divided as follows: 1) West
Bromwich Courts separate; 2) Wolverhampton Courts separate; and 3)
Combined West Bromwich and Wolverhampton Courts. In this situation the
tender documents will allow for variant bids and the Bidder would have the
option to bid for single or several lots. The estimated cost of the works
excluding VAT for the Wolverhampton Courts building is between £35 000 000
and £40 000 000 with a provisional 26 month construction programme and 6
week lead in period starting on site in March 2010 with completion in July
2012. The estimated cost of the works excluding VAT for the West Bromwich
Courts building is between £15 000 000 and £20 000 000 with a provisional
20 month construction programme and 6 week lead in period starting on site
March 2010 with completion in January 2012. Programme dates and forms of
contract are indicative of the current programme and could be liable to
change. The project will be taken through to detailed design and will have
detailed planning approval on both sites which are already in ownership.
The project will be capital funded and the Outline Business Case has
received HMCS approval.
