3. Scope of Contract:

Mongolia has received a grant from the International Development Association (IDA) under the Governance Assistance Project (GAP). GAP is designed around three main components and a small component on project coordination & management comprising: (i) Management of Public Finance; (ii) Fostering Accountability and Monitoring; (iii) Investment Climate; and (iv) Project coordination and Evaluation. The objectives of GAP are to improve the efficiency and effectiveness of key governance processes in public finance management, accountability and monitoring and investment climate.

Progress with Public Financial Management reforms in Mongolia has been substantial but much still needs to be done. A February 2008 International Monetary Fund Mission, Fiscal Affairs Department (FAD) mission evaluated ongoing fiscal and budget planning reforms and identified institutional and process pre-requisites for further progress. One of the mission’s main recommendations to the authorities was to unify and modernize the two existing budget system laws and strengthen the role of the Executive in fiscal policy. It also suggested that a Fiscal Responsibility Law (FRL) would be essential for strengthening fiscal discipline and rules based approach to fiscal policy. Other recommendations related to institutional and process pre-requirements for the full introduction and use of medium term program budgeting. Following this mission, an initial one month of budget legal support was provided by FAD through a peripatetic advisor in October 2008. This mission focused on a first redraft of the FRL and exploration of the commitment of the authorities for a full review and integration of the existing IBL. The advisor, Mr. Dick Emery, was supported by local consultants financed from the ECTAC project.

The terms of reference are for the continued technical assistance to Mongolia’s Ministry of Finance (MoF) for reform of the budget legal framework. Main objectives of the TA are to finalize a draft Fiscal Responsibility Law and develop a new Integrated Budget Law (IBL). The Minister of Finance has requested that the draft FRL be ready for submission to parliament in February 2009. The development of a new Integrated Budget Law is expected to take up to early April, 2009 to finalize.

The four months of consultancy services, will be delivered mostly in Ulaanbaatar but possibly also in part at the home location of consultant, if this is seen as appropriate for the project by IMF back stopper.
