Contract specifications
6. Description of the contract: The project concerns the construction of
an all-weather road link of 85 km of highway between Rogbere Junction in
Sierra Leone and Farmoreah in the Republic of Guinea. The project road
starts at Rogbere, which is about 106 km from Freetown, and continues for
76 km in Sierra Leone to the border with Guinea and ends at the town of
Farmoreah 9 km inside Guinea.
Due to lack of EDF funds at the time when the project was identified in
2002, it was decided that the Freetown–Conakry Highway project was to be
undertaken in 2 phases; the first phase was for the construction of the
road up to base course layer formation level, and a second phase for the
construction of a layer of crushed stone base with a wearing course of
asphaltic concrete, and road furniture.
The phase 1 works were only completed partially. The phase 2 tender
therefore includes the remaining works from phase I, the overlay and the
construction of a Common Border Post Facility.
7. Number and titles of lots: The following lots are foreseen:
Lot 1: Part A — Complete phase I work in Sierra Leone,
Part B — Overlay in Sierra Leone.
Lot 2: Part A — Complete phase I work in Guinea,
Part B — Overlay in Guinea.
Lot 3: Common Border Post Facility.
Tenderers must tender for all 3 lots. There will be only 1 contractor for
all the 3 lots. Lot 1 and lot 3 will be 1 contract with Sierra Leone as
the contracting authority and lot 2 will be 1 contract with Guinea as the
contracting authority.
Terms of participation
8. Eligibility and rules of origin: Participation in tendering is open on
equal terms to all natural and legal persons (participating either
individually or in a grouping (consortium) of tenderers) which are
established in 1 of the Member States of the European Union contributing
to the European Development Fund and ACP States and international
organisations as authorised by the instrument applicable to the programme
under which the contract is financed (see also heading 22 below). All
works, supplies and services under this contract must originate in 1 or
more of these countries.
9. Grounds for exclusion: Tenderers must submit a signed declaration,
included in the tender form for a works contract, to the effect that they
are not in any of the situations listed in point 2.3.3 of the 'Practical
Guide to contract procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender per lot.
Tenders for parts of a lot will not be considered. Any tenderer may state
in its tender that it would offer a discount in the event that its tender
is accepted for more than 1 lot. Tenderers may submit a tender for a
variant solution in addition to their tender for the works required in the
tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of EUR
250 000 when submitting their tender. This guarantee will be released to
unsuccessful tenderers once the tender procedure has been completed and to
the successful tenderer(s) upon signature of the contracts by all parties.
This guarantee will be called upon if the tenderer does not fulfil all
obligations stated in its tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided together with
the return of the countersigned contract no later than 30 days after the
tenderer receives the contract signed by the contracting authority. If the
selected tenderer fails to provide such a guarantee within this period,
the contract will be void and a new contract may be drawn up and sent to
the tenderer which has submitted the second best admissible tender.
13. Information meeting and/or site visit: A mandatory information
meeting and site visit will be held on the 17.9.2008. The meeting point
for the site visit will be the Rogbere Junction at mile 0 at 9:00 local
time and the clarification meeting will be held the same day at Mange
Camp. All tenderers must confirm their attendance to the site visit and
the clarification meeting at least 2 working days in advance to the
Director-General, Sierra Leone Roads Authority, Kissy, Freetown
(Telephone: (232-22) 23 22. E-mail: slra_mis@sierratel.sl) and also copied
to the Head of Delegation, Delegation of the European Commission in Sierra
Leone, 25 Main Regent Road, Leicester Square, Regent, Freetown.

14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of performance: The overall contract implementation period is
24 months, where the period for lot 1 — Part A, lot 2 — Part A and lot 3
is 18 months and for lot 1 — Part B and lot 2 — Part B is 24 months
(including 1 month mobilisation) from the date established in the
commencement order as the date of the commencement, and the maintenance
period shall be 12 months.
Selection and award criteria
16. Selection criteria: The minimum selection criteria for each tenderer
are as follows:
1. He must be a registered firm or natural person capable of carrying out
the specified works.
2. In case of a joint venture, the lead partner must satisfy at least 80 %
of the requirements listed below and each of the other partners must
satisfy at least 40 % of the requirements listed below.
NB: The joint venture as a whole must satisfy the minimum qualifications
required below.
3. His average annual turnover in the past 5 years must be equivalent to
EUR 25 000 000.
4. He must carry out at least 70 % of the contract works by his own
resources, which means that he must have the equipment, materials, human
and financial resources necessary to enable him to carry out that
percentage of the contract.
5. He must have access to sufficient credit and other financial facilities
to cover the required cash flow for the duration of the contract. In any
case, the amount of credit available must exceed the equivalent of EUR 3
000 000.
6. If he is the lead member of a joint venture/consortium, he must have
the ability to carry out at least 50 % of the contract works by his own
means, as defined in sub-clause 4.
7. If he is another partner of a joint venture/consortium (i.e. not the
lead member) he must have the ability to carry out at least 10 % of the
contract works by his own means, as defined in sub-clause 4.
8. He must have completed or have in his current portfolio at least 3
projects of the same nature/amount/complexity comparable to the works
concerned by the tender over the last 5 years.
The percentages for joint venture partners mentioned under selection
criterion 2 are to be applied to the amounts of the projects, not to their
number.
The contracting authority reserves the right to ask for copies of the
respective certificates of final acceptance signed by the
supervisors/contracting authority of the completed projects and for
evidence of awarded contracts for ongoing ones.
9. All his key personnel must have at least 10 years' appropriate
experience and proven qualifications relevant to works of a similar nature
to this project.
