Request for Expressions of Interest (Terms of Reference included)
This request for expressions of interest follows the general procurement notice (GPN) that appeared in UN Development Business No. 677 of 30 April, 2006.

A. BACKGROUND

1. The Government of Mongolia has received a grant from the International Development Association (IDA) under Governance Assistance Project (GAP). GAP is designed around three main components and a small component on project coordination & management comprising: (i) Management of Public Finance; (ii) Fostering Accountability and Monitoring; (iii) Investment Climate; and (iv) Project Coordination and Evaluation. The objectives of GAP are to improve the efficiency and effectiveness of key governance processes in public finance management, accountability and monitoring and investment climate. 2. Improve Anti-Corruption Framework is a sub-component of the Governance Assistance Project (GAP) and its main objective is to implement an effective anticorruption framework for reducing corruption and increasing integrity in the Mongolian Public Administration. This will be realized by producing such outputs as a functional system of income and asset declaration and disclosure, and a code of conduct framework for conflict-of-interest prevention and resolution.


B. OBJECTIVE OF THE ASSIGNMENT

A main objective of the anticorruption framework is to support the newly created the Independent Authority against Corruption (IAAC) in fulfilling its objective of reducing perceived and actual corruption. The IAAC was created in late 2006, following the adoption of the anticorruption law in June 2006. Since its creation more than a year ago, several significant achievements have been acknowledged, including (i) the disclosure of 40,858 (97.6 percent as preliminary data of 16 February, 2008) civil servant assets and income, among which 252 high level public officials were publicly disclosed as required by law, (ii) a strong 2007 awareness campaign; (iii) a number of investigations resulting for some of them in referral to the state prosecutor and convictions. To support the fulfillment of its mandate, the IAAC wishes to have an experienced international consultant provide assistance in the following areas:

The IAAC Strategic Framework: The existing legal framework in which the IAAC is operating consists of (i) the Anti-Corruption Law (June 2006): (ii) the UN Convention against Corruption (UNCAC) adopted in December 2006, (iii) the Criminal Procedures Code, amended in September 2007 to provide the IAAC jurisdiction to investigate corruption. While the legal framework appears adequate for the IAAC to operate, a holistic approach to strategic goals is needed to enhance and clarify the vision of the agency activities and objectives in the short and medium term and plan accordingly.

The objective of this assignment is to develop a detailed medium-term strategic framework for the IAAC activities, on the basis of a review of legal mandate, existing strategic orientations, institutional set up and relations with other stakeholders, including external partners.

Staff Capacity and Training: Staff in the IAAC is organized along the IAAC main mandates, i.e. in Awareness and Prevention, Asset and Income Disclosure, Investigation, Administrative matters. The IAAC consist of 90 staff. Compared to civil service, salaries are relatively high to attract professional and committed staff. Nevertheless, at the Independent Authority is relatively new, the need for skills and capacity building is important, if the Independent Authority is to maintain the momentum of achievements and build on these initial successes its credibility.

The objective of this assignment is to conduct a detailed review of skills needs with an associated staffing and training plan, based on the functions that are the responsibility of the IAAC, including detailed outline of the capacity needed for specific functions. Furthermore, detailed training plans for individual staff in the IAAC should be developed, again, with a strong focus on functions.

C. SCOPE OF WORK

The IAAC Strategic and Institutional Framework
• Review the existing framework for anticorruption activities (taking into account legal, regulatory, institutional and procedural aspects), and, with the IAAC, prepare a detailed medium–term strategic framework, including an implementation plan with timeline for interventions. In doing so, close attention should be paid to (i) existing institutional framework (de jure and de facto) for anticorruption activities, and (ii) external partner anticorruption activities and coordination mechanisms. In particular, realistic commendations on how to enhance the IAAC leadership and external partner’s coordination are expected.

Staff Capacity and Training:
• Review staff capacity and training, with a special focus on ensuring that the functions that are the responsibility of the IAAC can be met timely and with a high quality. The report will focus on the functions the IAAC are responsible for.
• Based on the responsibilities of the IAAC, outline the staffing requirements of the division.
• The Consultant will provide training through in-house workshops on specific issues, as agreed with the IAAC.

D. DELIVERABLES

Strategic and Institutional Framework
• Report reviewing (i) existing strategic framework for anticorruption activities, (ii) proposing a holistic strategic framework; and (iii) an operational implementation plan (End August, 2008).

Staff Capacity and Training:
• Detailed report on staff capacity and training (Beginning October, 2008 )
• Detailed paper outlining the staffing requirements of the IAAC (Beginning October, 2008)
• Training through in-house workshops on specific issues, as agreed with the IAAC (End October, 2008)

CONSULTANT’S QUALIFICATIONS / SELECTION CRITERIA

• Education: Candidate should have PhD or Master degree in administration law, or politics, economics and social sciences; or equivalent experience.
• At least 10 years experience of anticorruption agency(s) and related institutional frameworks including main mandates such as awareness and prevention, asset and income disclosure, investigation for corruption crimes and administrative matters as well as extensive managerial experience;

E. REPORTING AND LIAISON ARRANGEMENTS

The consultant will work under the Chief of Administration Division of the IAAC and closely with the IAAC team. Will report directly to the IAAC Commissioner General, and liaise with the Director for the Governance Assistance Project Coordination Unit. The Project coordinator at the IAAC will monitor the daily activities of the consultant and assist.

The IAAC Commissioner General will appoint members of his staff as main responsible for each of the components mentioned above, and the consultant will work directly with these staff members.

F. CONTRACT DURATION

The level of efforts is 5 weeks over an elapsed time 4 months commencing in end of July 2008. During the contract period, the consultant will be expected to visit Ulaanbaatar two times, the first visit with duration of 2 weeks starting by the end of July and last visit with duration of 3 weeks from the beginning of October 2008. In between visits, the consultant should be available through telephone and/or email to provide input as needed, and follow-up on activities.

G. DATA, LOCAL SERVICES, PERSONNEL AND FACILITIES TO BE PROVIDED BY THE CLIENT

The Client will provide:
• Office space with office furniture with exception of computer equipment.
• Appointment of the staff including an interpreter if required to work with the consultant.
• Provision of relevant information to assist in effective implementation of the assignment.

H. DEADLINE FOR SUBMISSION OF EXPRESSIONS OF INTEREST AND CONTACT

The GAP Project Coordinating Unit now invites eligible individual consultants to express their interest in providing these services. Interested consultants must provide information indicating that they are qualified to perform the services (CVs, description of similar assignments, and experience in similar conditions).

Consultant (individual consultant) will be selected in accordance with the World Bank’s Guidelines: Selection and Employment of Consultants by World Bank Borrowers, May 2004.
