OGCbuying.solutions requires to establish framework agreements for use by
or on behalf of UK public sector bodies. These will include Central
Government Departments & their Agencies, NHS Bodies, Local Authorities,
Police & Emergency Services and Educational Establishments.
The above Public Sector Bodies have a need for a comprehensive range of
Project Management and Full Design Team Services in order to assist them
to deliver a wide range of capital projects. For illustrative purposes,
the following types of construction projects can be delivered via the
framework agreement:
— Refurbishment exercises
— Programmes of Work
— Regeneration Projects
— New Build Projects
— Alteration/Extension Projects
— Relocation exercises
— Ancillary Construction projects connected to main construction
contracts. I.e. Roads, Bridges, etc.

II.2.1) Total quantity or scope: This Framework Agreement brings together
project management, design and a number of ancillary technical services
designed primarily to assist Clients in delivering a wide range of capital
projects.
The service package can be used as a comprehensive “one stop” consultancy
solution or as a schedule of specialist elements which can be purchased in
isolation or any bespoke combination according to Client need.
It provides clients with access to a full Project Management & Design team
service to progress clients through the Royal Institute of British
Architects Plan of Work Stages (A – L) and OGC Gateway Review Process when
delivering new build schemes, regeneration and major programmes of work.
For illustrative purposes, the following types of construction projects
can be delivered via the framework agreement:
— Refurbishment exercises
— Programmes of Work
— Regeneration Projects
— New Build Projects
— Alteration/Extension Projects
— Relocation exercises
— Ancillary Construction projects connected to main construction
contracts. I.e. Roads, Bridges, etc.

III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Participants will be advised
if this is necessary during the procurement. Parent company and/or other
guarantees of performance and financial liability may be [required by
Buying Solutions] [proposed by participants] if considered appropriate.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: One member of any grouping/consortium
of suppliers will be required to accept prime contractorship.

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Any supplier
may be disqualified who:
(a) is bankrupt or is being wound up, where his affairs are being
administered by the court, where he has entered into an arrangement with
creditors, where he has suspended business activities or is in any
analogous situation arising from a similar procedure under national laws
and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an
order for compulsory winding up or administration by the court or of an
arrangement with creditors or of any other similar proceedings under
national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata
in accordance with the legal provisions of the country of any offence
concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means
which the contracting authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social
security contributions in accordance with the legal provisions of the
country in which he is established or with those of the country of the
contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which he is
established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information
required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal
organisation, as defined in Article 2(1) of Council Joint Action
98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in
Article 3 of the Council Act of 26 May 1972 and Article 3(1) of Council
Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of
Article 1 of the Convention relating to the protection of the financial
interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined
in Article 1 of Council Directive 91/308/EEC of 10 June 1991 on prevention
of the use of the financial system for the purpose of money laundering.

III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: a) appropriate
statements from banks or, where appropriate, evidence of relevant
professional risk indemnity insurance;
(b) the presentation of balance-sheets or extracts from the
balance-sheets, where publication of the balance-sheet is required under
the law of the country in which the economic operator is established;
(c) a statement of the undertaking's overall turnover and, where
appropriate, of turnover in the area covered by the contract for a maximum
of the last three financial years available, depending on the date on
which the undertaking was set up or the economic operator started trading,

III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: (b) a list of the principal deliveries
effected or the main services provided in the past three years, with the
sums, dates and recipients, whether public or private, involved. Evidence
of delivery and services provided shall be given: - where the recipient
was a contracting authority, in the form of certificates issued or
countersigned by the competent authority, - where the recipient was a
private purchaser, by the purchaser's certification or, failing this,
simply by a declaration by the economic operator;
(c) an indication of the technicians or technical bodies involved, whether
or not belonging directly to the economic operator's undertaking,
especially those responsible for quality control and, in the case of
public works contracts, those upon whom the contractor can call in order
to carry out the work;
(f) the educational and professional qualifications of the service
provider or contractor and/or those of the undertaking's managerial staff
and, in particular, those of the person or persons responsible for
providing the services or managing the work;

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: In accordance with Regulation 32 of the Public Contracts
Regulations 2006. OGCbuying.solutions will incorporate a minimum 10
calendar day standstill period starting from the date when the award
decision notification is dispatched to bidders. This period allows
unsuccessful bidders to seek further de-briefing from OGCbuying.solutions
before the contract is entered into. Applicants have until midnight of the
second working day of the standstill period for their additional
debriefing requests to reach OGCbuying.solutions. A response to such a
request must be provided to the bidder by a minimum of 3 working days
before the expiry of the standstill period. If an appeal regarding the
award of the contract has not been successfully resolved, Regulation 47 of
the Public Contracts Regulations 2006 provide for the aggrieved parties
who have been harmed, or are at risk of harm as a consequence of a breach
of the procurement rules to bring an action in the High Court. Any such
action must be brought promptly and in any event within 3 months of the
date when the grounds of complaint first arose. Where a contract has not
been entered into, the court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into, the court may only award
damages. The purpose of the standstill period referred to above is to
allow parties to apply to the court to set aside the award decision before
the contract is entered into.

Project management consultancy services.Instead of: II.1.5) :
OGCbuying.solutions requires to establish framework agreements for use by
or on behalf of UK public sector bodies. These will include Central
Government Departments & their Agencies, NHS Bodies, Local Authorities,
Police & Emergency Services and Educational Establishments. The above
Public Sector Bodies have a need for a comprehensive range of Project
Management and Full Design Team Services in order to assist them to
deliver a wide range of capital projects. For illustrative purposes, the
following types of construction projects can be delivered via the
framework agreement:
— Refurbishment exercises,
— Programmes of Work — Regeneration Projects,
— New Build Projects,
— Alteration/Extension Projects,
— Relocation exercises,
— Ancillary Construction projects connected to main construction
contracts. I.e. Roads, Bridges, etc.

The duration referenced in Section II.1.4.1 is for the placing of orders.
The figure provided in Section II.1.4.2 is only an estimate. We cannot
guarantee to suppliers any business through this framework agreement.
Section 1.1 - OGCbuying.solutions wishes to establish a framework
agreement for use by or on behalf of UK public sector bodies (and their
statutory successors and organisations created as a result of
re-organisation or organisational changes). These will include but not be
limited to: Central Government Departments & their Agencies, NHS Bodies,
Local Authorities (i.e. a local authority as defined in Regulation 3(2) to
(5) of the Public Contracts Regulations 2006 ('the Regulations')), Police
& Emergency Services (i.e. fire authorities, fire and rescue authorities,
police authorities and the Metropolitan Police Authority as defined by
Regulation 3 (1) (j) to (p) of the Regulations, Educational Establishments
(e.g. School Governing Bodies; Voluntary Aided Schools; Foundation
Schools; Diocesan authorities; Academies; City Technology Colleges;
Foundation Partnerships; the Learning and Skills Council; further
education establishments; higher education establishments and other
