International Consultant in Developing
A Sustainable Procurement Training System

Request for Expressions of Interest (Terms of Reference included)
This request for expressions of interest follows the general procurement notice (GPN) that appeared in UN Development Business No. 677 of 30 April, 2006.

A. BACKGROUND

Mongolia has received a grant from the International Development Association (IDA) for the Governance Assistance Project (GAP). The project includes four main components: (i) Management of Public Finance; (ii) Fostering Accountability and Monitoring; (iii) Investment Climate; and (iv) Project Coordination and Evaluation. The objectives of the Project are to: significantly improve the efficiency and effectiveness of key governance processes in public finance management, accountability and monitoring and investment climate.

The Public Procurement Capacity Development is one of sub-components supported by the GAP and its objective is to provide comprehensive assistance to the Government on effective implementation of the revised Law on Public Procurement. Assistance in this regard will focus on (i) reducing the lead time in public procurement, (ii) increasing transparency and accountability in public procurement, and (iii) enhancing disclosure of information pertaining to public procurement by improving national capacity for procurement policy and implementation as well as procurement monitoring and auditing.

Mongolia has made significant strides in improving public procurement. In 2000, Mongolia promulgated a procurement law. This law significantly centralized procurement and tightened fiduciary controls. However, the centralization of procurement increased procurement lead times (causing delays in procurement) and budget entities felt disenfranchised at the loss of control over funds allocated to them by the Parliament. In order to improve procurement efficiency, while maintaining the fiduciary controls over public procurement, the Parliament passed the revised Procurement Law in December 2005.

Under the revised Law, budget entities shall be responsible for procuring goods from their budgetary appropriations while relevant portfolio ministries will procure capital expenditure goods. Under this law, the Procurement Policy and Coordination Department (PPCD) of the Ministry of Finance of Mongolia (MoF) has received a mandate of advising procuring entities on effective procurement, carrying out a review of major procurement transactions and procurement complaints, as well as overall monitoring and reporting of public procurement performance. The challenge is to implement the Law effectively while maintaining the gains achieved by the 2000 Public Procurement Law. Effective implementation of this revised law will require significant capacity building, development of a procurement monitoring framework for capital procurement and training on public procurement across the Government.

The training currently provided on public procurement is limited to the training conducted by the PPCD in collaboration with the Procurement Development Center for government officials. Procurement under private sector as well as a pilot course on public procurement for Bachelor’s and Master’s degree candidates are provided by the Academy of Management starting 2006. All these trainings mainly focuse on introduction of the revised Procurement Law with limited scope and lack of well organized and consistent training modules. In the face of the need ad the rise of the state budgetary expenditure, Government needs a full-functional procurement skills dissemination module fitted into the entire Mongolian educational system.

In the area of procurement capacity building reform, the GAP has been supporting the PPCD, MoF to promote good procurement governance and management practices, institutional strengthening of government bodies and training for officials.

In order to ensure economic and efficient procurement, promote the development of a market economy, avoid waste of public funds and combat corruption, the public procurement capacity development is an essential tool in overcoming poor public procurement performance.

Therefore, the PPCD in collaboration with representatives from other related ministries developed a “Public Procurement Capacity Development Program”, which was approved by the Government of Mongolia on January 10th, 2007. The Program provides medium term objectives for the establishment of a sustainable procurement training system and government policy actions toward them.

B. OBJECTIVE OF THE ASSIGNMENT

The objective of the assignment is to assist the Government in development and implementation of the “National Public Procurement Capacity Development Program” through the establishment of a long-term sustainable training program and the reforms of government procurement to align to best international public procurement practices.

C. SCOPE OF WORK

The duties and responsibilities of the international consultant will assist the MoF in the implementation of the Program in regard to the establishment of a sustainable procurement training system by designing national procurement curriculum and training programs and criteria for teacher trainers, students in the selected higher education instititions and current government officials working in charge of procurement issues and providing related advisory services. In this regard, the international consultant will support and work closely with the PPCD, MoF and the National Committee of the “Public Procurement Capacity Development Program” in various aspects of its functions by providing professional advice and services related to their respective field of expertise.

The tasks to be carried out by the consultant divided into three main Phases in accordance with substance of the whole work and will include the following:

1st Phase: Inception
 Evaluate the past and “as is” situation of the training on procurement of Mongolia;
 Assess the capability of candidate trainers and training institutions to undertake training;

2nd Phase Program Development
 Design a pilot project at one of the selected universities on introducing a student-course on public procurement basing on the current university-terms (semester duration) and curriculum;
 Design the co-operational hierarchy of the PPCD and training organizations;
 Develop a certificate-training program on procurement for the government officials who shall be working in charge of procurement;
 Develop a training program for the teacher-trainers who will be selected from training organizations and universities;
 Develop procedure and criteria on awarding a certificate to teacher-trainers and government officials who shall be working in charge of procurement;
 Develop certificate-training material on the following:
o 4 day training for trainers of the selected Universities
o 2 day training of selected government officials on short term training
 Develop long term training strategy for Mongolia

3rd Phase Training
 Introduction trainings consisting of:
o 5-days training for trainers of the selected five universities based on the approved training program;
o 3-days training for PPCD staff and government officials based on the approved training program;
 Prepare presentation to the PPCD on long term training strategy;

D. DELIVERABLES

In connection with above mentioned work, the deliverables for the Consultant will include, but not limited to:

Phase 1. Duration: 3 weeks
Provide initial report consisting of:
 evaluation report of the effectiveness of the Past and Present procurement trainings in Mongolia;
 recommended list of selected educational organizations who could be included as a training provider;

Phase 2. Duration: 11 weeks
 design of pilot project on introducing course on public procurement;
 approved design of the co-operational hierarchy of the PPCD and training organizations;
 approved certificate training program on procurement for the government officials who shall be working in charge of procurement;
 approved certificate training program on procurement for the teacher-trainers who will be selected from training organizations and universities;
 procedure and criteria on awarding certificate to teacher-trainers and government officials who shall be working in charge of procurement;
 Certificate-training material on the following:
a. 4-days training for trainers of the selected universities;
b. 2 days training for government officials;
 approved Long term procurement training strategy for Mongolia;

Phase 3. Duration: 2 weeks
 presentation paper to the PPCD on long term training strategy;
 approved final report to the PPCD;

CONSULTANT’S QUALIFICATIONS / SELECTION CRITERIA

 The consultant should have substantial knowledge and experience on procurement capacity development and capacity building of identified institutions.

E. REPORTING AND LIAISON ARRANGEMENTS

Working with the Government counterparts, the reporting and liaison arrangements governing the consultant will be:

 Consolidate work plan and coordination arrangements;
 The consultant will prepare monthly progress reports detailing the achievements and impediments in executing the entire work program effectively. These progress reports will be discussed with the counterparts;
 Drafts of inception, interim and final reports including draft curriculum and training programs to be discussed with the Client and other related parties, will be delivered in advance to the Client for its review. Remedial actions, where required will be agreed at these meetings;
 Inception, interim and final reports including draft and/or finalized curriculum and training programs will be submitted upon incorporations of the Client’s comments into the reports. And the reports should be approved by the Client;
 All the reports will be in English (in hard copy as well in electronic format). The submission of reports should disclose all issues pertinent to the project;
 The Director General, PPCD will be the direct counterpart. The experts from the PPCD and the local consultants will meet regularly to review progress with the work program and to resolve any outstanding issues;
 It is anticipated that the consultant will work with a wide range of assigned stakeholders including the MoF, the Ministry of Education, Culture and Science (MECS), and the Academy of Management and other related local higher education institutions as necessary and appropriate, in order to attain the objectives of the assignment;
 All information provided to the consultant will be regarded as confidential and information will not be shared with any outside individuals or organizations at the request of the counterparts.

F. CONTRACT DURATION

Total level of effort would be 4 man-months.

The assignment is expected to start in beginning of March 2008. The Consultant is expected to travel to Mongolia once during the duration of the contract.

G. DATA, LOCAL SERVICES, PERSONNEL AND FACILITIES TO BE PROVIDED BY THE CLIENT

The Client will provide:
• Office space with office furniture with exception of computer equipment.
• Appointment of the staff including an interpreter if required to work with the consultant.
• Provision of relevant information to assist in effective implementation of the assignment.

H. DEADLINE FOR SUBMISSION OF EXPRESSIONS OF INTEREST AND CONTACT
INFORMATION
The GAP Project Coordinating Unit now invites eligible individual consultants to express their interest in providing these services. Interested consultants must provide information indicating that they are qualified to perform the services (CVs, description of similar assignments, and experience in similar conditions).

Consultant (individual consultant) will be selected in accordance with the World Bank’s Guidelines: Selection and Employment of Consultants by World Bank Borrowers, May 2004.
