SECTION 02: STOBREČ - DUGI RAT
LOT 1: TTTS (Stobreč) - Grljevac
1. Publication Reference Split Bypass, Section 02: Stobreč - Dugi Rat on
the national road D8, LOT 1: TTTS (Stobreč) - Grljevac, length 3,2 km.

own funds and European Investment Bank (Luxembourg) loan.

d.o.o. and European Investment Bank dated 20 July 2005.

CONTRACT SPECIFICATION
6. Contract Description The works will be carried out on the national
road D8, Section 02: Stobreč - Dugi Rat, LOT 1: TTTS (Stobreč) - Grljevac,
length 3,2 km. This section includes civil works, namely the construction
of a four lane highway, two tunnels, a bridge, overpass and underpass,
drainage, slope protection, noise protection and landscaping. The
structures are Perun Tunnel (the south tube, L=222,32 m, the north tube,
L=201,92 m) and Rudine Tunnel the south tube, L=360,52 m, the north tube,
L=363,23 m), the Žrnovnica bridge, L=556,00 m, the Grljevac underpass L=
20 m, and the TTTS overpass, L= 241,50 m.
7. Maximum Works Period 24 months from the Notice to Commence, or taking
possession of the site.
CONDITIONS OF PARTICIPATION
8. Eligibility This invitation to tender is open on equal terms to any
firms/legal persons participating either individually or in a grouping
(joint venture) of tenderers.
9. Grounds for Exclusion Firms of a country may be excluded if, in
accordance with a decision of the United Nation Security Council taken
under Chapter VII of the Charter of the United Nations, the Employer's
country prohibits any participation of firms from that country in works in
other countries, or any payments to persons or entities in that country.
10. Number of Tenders Each tenderer shall submit only one tender either
by himself, or as a partner in a joint venture. Tenders for parts of the
Works will not be considered. Alternative solutions are not permitted.
11. Tender Security The tenderer shall furnish, as part of its tender, a
tender security, issued by a commercial bank acceptable to the Employer,
in the amount of 2% of the tender price. The security will be returned to
unsuccessful tenderers upon completion of tender procedure and to the
successful tenderer upon signature of the Contract by both Parties (the
Employer and the Contractor). The security will be forfeited if the
tenderer fails to comply with the requirements stated in the tender
documents.
12. Pre-Tender Meeting The Employer will convene a pre-tender meeting
which will take place at the Employer's premises in Vončinina 3, Zagreb on
27 July 2007 at 11:00 a.m..
TENDERING
13. How to Obtain Tender Documents Tender documents are available from
the Employer, at the above mentioned address, second floor, room 201
(Snježana Kurek, tel: ++ 385 - 1 - 4722 - 497 ; fax: ++385 - 1 - 4722 -

The tender documents may be obtained upon a bank transfer of a
non-refundable fee of 200 Euro, including VAT, to the bank account of
Hrvatske ceste d.o.o., open at Privredna banka Zagreb (ref.no.:
05-8006-9-928):

Each tenderer or partner in a joint venture has to buy a tender document.
Upon a written request accompanied by evidence of payment, the Employer
will send the tender documents by mail to a prospective tenderer who
submitted a request, but will in no way be responsible for possible delay
in shipment or loss of these documents. Tenderers, who require delivery of
the tender documents by courier will bear the cost of such delivery.
14. Tender Submission Requirements Tenderers shall submit their tenders
in English language, using the standard forms included in tender
documents, format and instructions of which must be strictly observed.
15. Deadline for Submission of Tenders 62 calendar days after the date
of publication of this procurement notice in the Official Journal of
European Communities, that is not later than 30 August 2007, at 12:00 m.
(local time). Any tender received after this deadline will not be
considered for evaluation.
16. Public Tender Opening Session The time and venue of the tender
opening session: 30 August 2007 at 12.00 m. (local time), Vončinina 3, 10
000 Zagreb, Croatia, room 400. Designated and authorised representatives
of tenderers may attend the session.
17. Tender Validity Tenders shall be valid for a period of 90 days after
the deadline for submission of tenders.
SELECTION CRITERIA AND AWARD OF CONTRACT
18. Selection Requirements Evaluation of legal, economical, financial
and technical responsiveness of tenders will be carried out in accordance
with the following main considerations:
- Successful performance in the past five (5) years (contracts signed and
projects completed over the last five years) as the prime contractor on
projects similar by type, scope and complexity to the Works tendered:
- in at least 2 contracts/projects of construction of structures (bridges,
viaducts, overpasses) of length at least 100 m; and
- in at least 2 contracts/projects of road construction of section at
least 5km long, each of minimum value 20.000.000,00 HRK; and
- in at least 1 contract/project of tunnel construction of at least 300 m.
- Average annual turnover in the past three (3) years (specified as
completed works and ongoing works) shall be at least 400.000.000,00 HRK.
- Qualification and experience of key staff in accordance with Clause 5.1.
Tender Data; Special attention of foreign companies is drawn to the
conditions requested for key staff in accordance with the Croatian laws in
force (Clause 5.1. Tender data);
- Qualifications of equipment and machinery in accordance with Clause 5.1.

19. Contract Award Criteria The lowest evaluated price, as defined in the
Instructions to Tenderers.
20. Performance Security and Contract Award For contract signing the
successful tenderer shall be required to furnish a performance security in
the amount of 10% of contract price expressed in HRK. Signing of contract
and furnishing of performance security shall be carried out within 28 days
after the receipt of contract signed by the Employer.
Failure of the successful tenderer to sign the contract and furnish the
performance security within the deadline shall constitute a breach of
contract, and the Employer may resort to awarding the contract to the next
ranked tenderer.
