Section II: Object of the contract
II.1) Description:

framework agreement: EUR 2 600 000 (excluding VAT).
II.1.5) Short description of the contract or purchase(s): To supply
workwear and accessories for technical and medical staff, shuttle drivers,
and staff in the kitchens, restaurants, crèches and reproduction
workshops, together with additional services.

Section III: Legal, economic, financial and technical information
III.1) Conditions relating to the contract:
III.1.1) Deposits and guarantees required: The firm awarded the contract
must furnish, prior to the contract coming into effect, a bank guarantee
for an amount equal to 10 % of the annual contract value.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Payment at 30 days
as stated in the draft contract appended to the specifications.
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: All the members of a grouping must
comply with the non-exclusion and selection criteria and be jointly and
severally liable for performance of the contract.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) Conditions for participation:
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating whether requirements have been met:
A. Dispatch of applications:
requests to participate must be sent in a letter posted prior to the
deadline given in IV.3.4.
Faxed or e-mailed requests to participate must be confirmed by a letter
posted before the same deadline.
Requests to participate must be sent in a double envelope. Both envelopes
must be sealed and the inner one must be marked with both the name of the
department which it is addressed to (see previously) and the following:
'OIB5/PR/2006/010 — Demande de participation de (name of candidate) — À ne
pas ouvrir par le service du courrier'.
Self-seal envelopes must be sealed with sticky tape, with the sender's
signature written across the tape.
Candidates may elect to send their requests to participate:
a) either by post to the official address in I.1;
b) or by delivering them to the European Commission's Central Mail
Department in person or via any representative of theirs, courier services
included. In this latter case, the full address given in I.1 must be
written on the outer envelope. Confirmation that the request to
participate has been delivered will be in the form of a dated receipt
issued by the European Commission's Central Mail Department. The address
of the European Commission's Central Mail Department is Rue de Genève, 1,
B-1140 Brussels. Its opening hours are 9:00–16:00, Monday to Friday,
public holidays excepted.
B. Candidates' particulars:
candidates (or each member in the case of groupings) must:
— quote reference OIB5/PR/2006/010 in their request to participate,
— enclose identity details (groupings shall provide separate sheets for
each member and state which is the lead company) as follows: name, legal
status, nationality, address, telephone and fax numbers, contact name and
e-mail address, VAT number, official registration number (where
applicable) and bank details,
— enclose the documents and information required under III.2 'Conditions
for participation'.
C. Legal position:
— name of the country in which candidates have their head office or are
domiciled, enclosing documents evidencing this under law in their country
of residence,
— duly signed and dated solemn declaration certifying that candidates are
not in any of the situations which would disqualify them from taking part
in a contract entered into by the European Communities. The template for
this solemn declaration, covering all the sections to be completed, can be
found at VI.3.5 of Section VI 'Complementary information'.
NB: the successful tenderer must, on pain of exclusion, furnish the
following documentary evidence in support of the solemn declaration within
a time limit set in writing by the contracting authority and prior to
signature of the contract:
• recent abstract of the judicial record or, failing this, an equivalent
document recently issued by an appropriate judicial or administrative body
in the country in which the tenderer resides, stating that he is not
bankrupt or being wound up, his affairs are not being administered by the
court, he has not entered into an arrangement with creditors, he has not
suspended business activities, is not the subject of proceedings of this
nature, nor is he in any analogous situation arising from a similar
procedure under national laws or regulations,
• recent abstract of the judicial record or, failing this, an equivalent
document recently issued by an appropriate judicial or administrative body
in the country in which the tenderer resides, stating that he has not been
the subject of a judgment which has the force of 'res judicata' for an
offence concerning his professional conduct or for fraud, corruption,
involvement in a criminal organisation or for any other illegal activity
detrimental to the Communities' financial interests,
• recent certificate issued by an appropriate body in the country in which
the tenderer resides, stating that he has fulfilled his obligations in
respect of payment of social-security contributions,
• recent certificate issued by an appropriate body in the country in which
the tenderer resides, stating that he has fulfilled his obligations in
respect of payment of taxes (direct taxes and VAT) in accordance with
legal provisions in said country.
Where no such documents or certificates are issued in the country
concerned, they may be replaced by a statement under oath, or failing
that, a solemn declaration made by the tenderer before a judicial or
administrative body, a notary or a qualified professional body in said
country.
NB: groupings of companies must furnish the necessary solemn declaration
and supporting documents for each individual member in the event they are
awarded the contract.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating whether requirements have been met:
• copy of the balance sheets and operating accounts for the past 3
financial years, showing the annual pre-tax profit. If, for a valid
reason, suppliers are unable to provide them, they must enclose a
statement as to annual pre-tax profits for the past 3 years. If the
balance sheets or the statement show an average loss over the past 3
years, then candidates must furnish another document as proof of their
financial and economic capacity, such as appropriate bank references or
proof of professional risk insurance cover,
• statement as to overall annual turnover during the past 3 financial
years,
• statement as to annual turnover during the past 3 financial years
specific to the field covered by this contract notice.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating whether requirements have been met:
• list of the main goods delivered and additional services provided
(alterations, mending, etc.) during the past 3 years with details of the
values, dates and particulars of the public or private recipients
involved,
• description of the supplier's logistics.

VI.3) Additional information: 1) The attention of interested parties is
drawn to the aim of this notice, i.e. to select candidates who will
receive the specifications and be invited to tender.
2) NB: interested parties are requested to observe strictly the conditions
stated in III.2 when submitting their request to participate, namely:
a) to send their application by post before the deadline given in IV.3.4;
b) to enclose the documents and information required under III.2.1 to
III.2.3.
Incomplete applications may be automatically rejected.
3) The framework contract will run for an initial 12 months and may then
be renewed for 3 further 1-year periods. The maximum possible term of the
framework contract is 4 years.
4) The following are taking part in this invitation to tender procedure as
contracting authorities:
— the European Commission (Brussels), as lead institution, for an amount
of EUR 2 545 000,
— the European Economic and Social Committee and the Committee of the
Regions (Brussels), for an amount of EUR 20 000,
— the Education, Audiovisual and Culture Executive Agency (Brussels), for
an amount of EUR 35 000.

contracting authority or those of the country where the contract will be
carried out;
e) has not been the subject of a judgment which has the force of 'res
judicata' for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
f) has not been declared to be in serious breach of contract for failure
to comply with contractual obligations, following another procurement
procedure or grant award procedure financed by the Community budget.
Situations leading to disqualification from contract award:
Candidates or tenderers will not be considered for contract award if, at
the time of the procurement procedure, they:
1) are subject to a conflict of interests;
2) are guilty of misrepresentation in furnishing the information required
by the contracting authority in order to take part in the contract, or
have not furnished said information.
