It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 31(1)(b) of Directive 2004/18/EC (Regulation 14(1)(a) (iii) of the Public Contracts Regulations 2006). For technical and interoperability reasons Essco Collins Ltd is currently the only economic operator which can provide the post design services for the Essco Collins Radome. This is for reasons related to the interoperability and technical issues that would be presented by using items of supply not produced under the Essco Collins production conditions and techniques.
