The Fort Worth District Corps of Engineers is soliciting comments from the construction community addressing the potential use of Project Labor Agreements, (PLAs), for a large scale construction contract, (exceeding $25 million) for the following project:
Fort Bliss Hospital Replacement Project
Fort Bliss, TX 79906

Project Description: Construct a new 1,132,237 SF Medical Facility to replace the existing Williams Beaumont Army Medical Center at Fort Bliss, Texas. The facility will consist of main hospital, in-patient and out-patient clinics, administrative building, clinical investigation building, and central utility plant. Project Number 72481 The project will be designed in accordance with criteria prescribed in Unified Facilities Criteria (UFC) 4-510-01, (MIL-HDBK-1191), DoD Minimum Antiterrorism Standards for Buildings UFC 4-010-01, Americans with Disabilities Act and Architectural Barriers Act Accessibility Guidelines (ADA/ABAAG), and applicable energy conservation legislation. Air conditioning: (estimated 4,550 tons).
Range of Magnitude: Over $500 Million.
Period of Performance: three years after date of award, estimated.

PLA is defined as a Pre-Hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f).
Federal Acquisition Regulation, (FAR), Policy Subpart 22.503:
a.) Project Labor Agreement, (PLA), is a tool that agencies may use to promote economy and efficiency in Federal Procurement. Pursuant to Executive Order 13502, Agencies are encouraged to consider requiring the use of project labor agreements in connection with large-scale construction projects.
b.) An Agency may, if appropriate, require that every contractor and subcontractor engaged in construction on the project agree for that project to negotiate or become party to a project labor agreement with one or more labor organizations if the Agency decides that the use of project labor agreements will:
1.) Advance the Federal Government's interest in achieving economy and efficiency in Federal procurement, produce-labor management stability and ensure compliance with laws and regulations governing safety and health. Equal opportunity, labor and employment standards and other matters and...
2.) Be consistent with law.

Some of the factors that maybe considered regarding their use are:
a.) The involvement of multiple contractors and/or subcontractors working in multiple crafts or trades.
b.) The complexity of the project.
c.) Shortage of skilled labor in the region.
d.) Completion of the project will require an extended period of time.
e.) The use of PLA's on other comparable projects.
f.) The promotion of the Governments long term programs interests such as training of skilled workforce for future projects.
g.) The possibility of labor disputes that threaten timely completion.
h.) Additional costs from use of PLAs may be cost prohibitive.

Please reference FAR Provision: 52.222-33 "Notice of Requirement for Project Labor Agreement" and FAR Clause: 52.222-34 "Project Labor Agreements."
In consideration of the above factors and any others which may be deemed appropriate, the construction community is invited to comment on the use of PLA's. Of particular interest to the Government are responses to the following questions:
a.) Should PLA's be executed on this selected large dollar contract at El Paso/Fort Bliss, Texas? What other factors should the Corps of Engineers consider before deciding to include PLA provisions in a Fort Worth District contract? What type of project should or should not be considered for the utilization of a PLA?
b.) Is the use of PLA's effective in achieving economy and efficiency in Federal procurement? What is the estimated relative cost impact or any other economies or efficiencies derived by the Federal Government if using PLA's? Will a PLA impact the cost of submitting an offer?
c.) Is the use of PLA's effective in producing labor-management stability? Have labor disputes or other labor issues contributed to project delays in the local area?
d.) Is the use of PLA's conducive to ensuring compliance with laws and regulations governing safety and health, equal employment opportunity, labor and employment standards and other relevant matters? Are there instances where these standards have not been met on Federal contracts in the local area? Were PLA's used for those specific contracts?
e.) Projects will require multiple construction contractors and/or subcontractors employing working in multiple crafts or trades. Do you foresee any work on projects that may result in both prime contractor and at least one subcontractor or two or more subcontractors employing the same trade?
f.) Are there concerns by prime contractors on the availability of skilled construction labor? Information may reference current apprenticeship statistics and workforce age demographics.
g.) Completion of anticipated projects will require an extensive performance period. Will a PLA impact completion time? What is the anticipated volatility in the labor market for the trades required for the execution of the project? Would a PLA benefit a project which contains a unique and compelling mission-critical schedule?
h.) Where have PLA's been used on comparable projects undertaken by Federal, State, Municipal or private entities in the El Paso/Fort Bliss, Texas area?
i.) Will the use of PLA's impact the ability of potential offerors and/or subcontractors to meet their Small Business utilization goals?

The following evaluation (rating) criteria listed below shall be used for solicitation W9126G-12-R-0054 unless modified by amendment prior to receipt of proposals:


Volume 1:

Factor 1 - Past Performance (Relevancy & Confidence)


Relevancy is defined as:


Construction of inpatient hospitals or medical centers that include, but are not limited to, inpatient, outpatient, administrative, surgical, intensive care, pharmaceutical, nuclear medicine, specialty care, and radiological services. All work must be new construction, or significant addition; and


(a) Project minimum size of 500,000 square feet of gross space; and


(b) Project construction value of at least $300,000,000.


(c) Additionally, projects that reflect the following features in terms of complexity will receive additional consideration:


1) Experience on large, complex medical campus construction projects to include RFP requirements, administration and/or research facilities
2) LEED certified projects, in particular LEED certified hospitals
3) Experience with multiple stakeholders
4) Experience with unique and/or stringent end-user requirements


(d) The government will give more consideration to projects submitted that clearly demonstrate an Offerors' ability to construct a facility that is similar in size and scope to this project and to execute the project successfully, while containing cost and maintaining schedule.


Confidence evaluation will be based on the following:


(a) Quality of Construction and Safety Record
(b) Timeliness of Performance Customer Satisfaction Subcontractor Management
(c) Working in the close proximity of other contractors

Description 


All questions regarding this SYNOPSIS Pre-solicitation Notice should be submitted in writing to the following E-Mail address:  ashley.morgan@usace.army.mil.  This Acquisition shall be competed as UNRESTRICTED.  This synopsis is for the purpose of a pre-solicitation notification only.  An unrestricted solicitation shall be issued for a Design-Bid-Build Construction Project.  The construction acquisition will be procured through a design-bid-build (D-B-B), one step, request for proposal (RFP) process with competition as full and open, using Best Value Source Selection Evaluation Criteria. 


 


The Fort Worth District, U.S. Army Corps of Engineers intends to award a Firm Fixed Price (FFP) Construction Contract for design-bid-build construction services for the Fort Bliss Replacement Hospital Project, located in El Paso, Texas.    


 


This Design-Bid-Build project includes new construction of the Fort Bliss Replacement Hospital including 1,132,237 SF Medical Facility to replace the existing William Beaumont Army Medical Center at Fort Bliss, Texas.  The project includes new construction of the main hospital, outpatient clinics, administrative building, connecting spine, clinical investigation building, central utility plan, and utility tunnel.  Construction also includes exterior site work, infrastructure, paving, and utilities.  The scope of this project includes responsibility for site access, maintaining and staffing temporary access control point, and security over all subcontractors, vendors, and prime contractors including those under separate USACE contract, and utilities and maintenance of temporary USACE construction office trailers.  Offerors shall provide Commissioning, LEED Certification, and Operations and Maintenance manuals.  Period of performance is 42 months (1277 days) after date of award or as adopted from successful bidder's proposed schedule in final award.  This project is incrementally funded throughout the construction period.  The project has been designed in accordance with criteria prescribed in Unified Facilities Criteria (UFC) 4-510-01, (MIL-HDBK-1191), DoD Minimum Antiterrorism Standards for Buildings UFC 4-010-01, Americans with Disabilities Act and Architectural Barriers Act Accessibility Guidelines (ADA/ABAAG), applicable energy conservation legislation, and referenced codes and standards.  Air Conditioning:  Estimated 6000 tons.    


 


The procurement method will be Best Value Source Selection.   Eligible Offerors will be required to provide a technical and price proposal for consideration of award in accordance with the RFP Instructions to Bidders.  The technical proposal will be evaluated based on the evaluation criteria stated in the RFP.  No plans, specifications, or DVDs will be provided. The contract drawings, specifications, documents, solicitation, and amendments and for this solicitation will be posted on www.fbo.gov. It is the responsibility of the contractor to check the www.fbo.gov website frequently for any amendments or changes to the solicitation. The Government is not responsible for any loss of internet connectivity or for Offerors inability to access the documents posted on the referenced website. The North American Industry Classification System (NAICS) code for this program is 236220, Commercial and Institutional Building Construction.  The successful offeror is required to perform at least 15 percent of the final cost of the contract, not including the cost of materials, with its own employees.  This project is incrementally funded throughout the construction period.   


 


The magnitude of this construction project (per Defense Federal Acquisition Regulation, 236.204 (v) Disclosure of the magnitude of construction projects) is estimated to be over $500 Million.

Relevancy is defined as:


Construction of inpatient hospitals or medical centers that include, but are not limited to, inpatient, outpatient, administrative, surgical, intensive care, pharmaceutical, nuclear medicine, specialty care, and radiological services. All work must be new construction, or significant addition; and


(a) Project minimum size of 500,000 square feet of gross space; and


(b) Project construction value of at least $300,000,000.


(c) Additionally, projects that reflect the following features in terms of complexity will receive additional consideration:


1) Experience on large, complex medical campus construction projects to include RFP requirements, administration and/or research facilities

The Fort Worth District, U.S. Army Corps of Engineers intends to award a Firm Fixed Price (FFP) Construction Contract for design-bid-build construction services for the Fort Bliss Replacement Hospital Project, located in El Paso, Texas.    


 


This Design-Bid-Build project includes new construction of the Fort Bliss Replacement Hospital including 1,132,237 SF Medical Facility to replace the existing William Beaumont Army Medical Center at Fort Bliss, Texas.  The project includes new construction of the main hospital, outpatient clinics, administrative building, connecting spine, clinical investigation building, central utility plan, and utility tunnel.  Construction also includes exterior site work, infrastructure, paving, and utilities.  The scope of this project includes responsibility for site access, maintaining and staffing temporary access control point, and security over all subcontractors, vendors, and prime contractors including those under separate USACE contract, and utilities and maintenance of temporary USACE construction office trailers.  Offerors shall provide Commissioning, LEED Certification, and Operations and Maintenance manuals.  Period of performance is 42 months (1277 days) after date of award or as adopted from successful bidder's proposed schedule in final award.  This project is incrementally funded throughout the construction period.  The project has been designed in accordance with criteria prescribed in Unified Facilities Criteria (UFC) 4-510-01, (MIL-HDBK-1191), DoD Minimum Antiterrorism Standards for Buildings UFC 4-010-01, Americans with Disabilities Act and Architectural Barriers Act Accessibility Guidelines (ADA/ABAAG), applicable energy conservation legislation, and referenced codes and standards.  Air Conditioning:  Estimated 6000 tons.

Volume 1:

Factor 1 - Past Performance (Relevancy & Confidence)


Relevancy is defined as:


Construction of inpatient hospitals or medical centers that include, but are not limited to, inpatient, outpatient, administrative, surgical, intensive care, pharmaceutical, nuclear medicine, specialty care, and radiological services. All work must be new construction, or significant addition; and


(a) Project minimum size of 500,000 square feet of gross space; and


(b) Project construction value of at least $300,000,000.


(c) Additionally, projects that reflect the following features in terms of complexity will receive additional consideration:


1) Experience on large, complex medical campus construction projects to include RFP requirements, administration and/or research facilities
2) LEED certified projects, in particular LEED certified hospitals
3) Experience with multiple stakeholders
4) Experience with unique and/or stringent end-user requirements


(d) The government will give more consideration to projects submitted that clearly demonstrate an Offerors' ability to construct a facility that is similar in size and scope to this project and to execute the project successfully, while containing cost and maintaining schedule.

All questions regarding this SYNOPSIS Pre-solicitation Notice should be submitted in writing to the following E-Mail address:  ashley.morgan@usace.army.mil.  This Acquisition shall be competed as UNRESTRICTED.  This synopsis is for the purpose of a pre-solicitation notification only.  An unrestricted solicitation shall be issued for a Design-Bid-Build Construction Project.  The construction acquisition will be procured through a design-bid-build (D-B-B), one step, request for proposal (RFP) process with competition as full and open, using Best Value Source Selection Evaluation Criteria. 


 


The Fort Worth District, U.S. Army Corps of Engineers intends to award a Firm Fixed Price (FFP) Construction Contract for design-bid-build construction services for the Fort Bliss Replacement Hospital Project, located in El Paso, Texas.    


 


This Design-Bid-Build project includes new construction of the Fort Bliss Replacement Hospital including 1,132,237 SF Medical Facility to replace the existing William Beaumont Army Medical Center at Fort Bliss, Texas.  The project includes new construction of the main hospital, outpatient clinics, administrative building, connecting spine, clinical investigation building, central utility plan, and utility tunnel.  Construction also includes exterior site work, infrastructure, paving, and utilities.  The scope of this project includes responsibility for site access, maintaining and staffing temporary access control point, and security over all subcontractors, vendors, and prime contractors including those under separate USACE contract, and utilities and maintenance of temporary USACE construction office trailers.  Offerors shall provide Commissioning, LEED Certification, and Operations and Maintenance manuals.  Period of performance is 42 months (1277 days) after date of award or as adopted from successful bidder's proposed schedule in final award.  This project is incrementally funded throughout the construction period.  The project has been designed in accordance with criteria prescribed in Unified Facilities Criteria (UFC) 4-510-01, (MIL-HDBK-1191), DoD Minimum Antiterrorism Standards for Buildings UFC 4-010-01, Americans with Disabilities Act and Architectural Barriers Act Accessibility Guidelines (ADA/ABAAG), applicable energy conservation legislation, and referenced codes and standards.  Air Conditioning:  Estimated 6000 tons.    


 


The procurement method will be Best Value Source Selection.   Eligible Offerors will be required to provide a technical and price proposal for consideration of award in accordance with the RFP Instructions to Bidders.  The technical proposal will be evaluated based on the evaluation criteria stated in the RFP.  No plans, specifications, or DVDs will be provided. The contract drawings, specifications, documents, solicitation, and amendments and for this solicitation will be posted on www.fbo.gov. It is the responsibility of the contractor to check the www.fbo.gov website frequently for any amendments or changes to the solicitation. The Government is not responsible for any loss of internet connectivity or for Offerors inability to access the documents posted on the referenced website.
