The National Highway Traffic Safety Administration (NHTSA), US Department of Transportation intends to solicit a quote from, and award a purchase order, on a sole-source basis, to LexisNexis of Philadelphia, PA for the purchase of its proprietary software, Concordance®.  Concordance® is used to electronically identify, organize, analyze, and manage discovery and litigation documents.  Concordance® is required to interface with other federal agencies on litigation matters, and to respond to document production requests that require the use of Concordance®.  In addition, the agency will use Concordance®  to access several databases provided to the government that are formatted using the software.   

 This sole-source procurement is processed under 41 U.S.C. 253(c)(1) "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."

 This notice of intent is not a request for competitive quotes. No solicitation document is available and telephone requests will not be accepted. However, any vendor that believes it can meet these requirements stated above, may give written notification to the Contracting Officer within 15 days of the posting date of this announcement.  Supporting evidence must be furnished in sufficient detail, to demonstrate the ability to comply with the above requirements.  Capability statements may be sent to the Contracting Officer at and NHTSAOAM@DOT.GOV.  Responses received will be evaluated however; a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government.  If no responses are received, the National Highway Traffic Safety Administration (NHTSA) will proceed with the sole source procurement to LexisNexis.  Cost associated with the preparation and submission of information and/or any follow-up information requests are the responsibility of the vendor and these costs will not be reimbursed by the Government.
