of a measured term contract for minor civil enginering works using PSA
Schedule of Rates for the Belfast Health & Social Care Trust and possibly
other hospital and health service facilities within the former Eastern
Health & Social Services Board area.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Establishment of a measured term
contract for the execution of minor civil engineering works within the
Belfast Health & Social Care Trust and/or other Health Trust facilities
within the former Eastern Health & Social Services Board area using the
PSA Schedule of Rates including contractor's discounts and updating
percentages. The Employer wishes to appoint 4 principal contractors with a
further 2 reserve appointments should any of the principal contractors
fail to perform adequately within the terms of the contract or withdraws
for any reason. It is also envisaged that should the required workload
exceed the capacity of the principal contractors, the employer at its own
discretion may utilise the reserve contractors.
Estimated value excluding VAT:
Range: between 500 000 and 2 000 000 GBP.
II.2.2) Options: Yes.
Description of these options: The contract shall run for an initial period
of 3 years from date of award and may be extended for a further period of
up to 1 year at the discretion of the employer, thus resulting in a
maximum of 4 years.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 48 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: None.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: None.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: If applying on behalf of a consortium
all names must be submitted. Any contract will be entered into with the
nominated lead organisation and all members of the consortium, who will in
these circumstances each be required to execute said contract together
with all ancillary documentation, evidencing their joint and severally
liability in respect of the obligations and liabilities of the contract.
It will be for the members of the consortium to sort out their respective
duties and liabilities amongst each other and noted before contract
commencement. All associated documentation will be made available to the
nominated lead organisation.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and

III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: As per questionnaire.
Minimum level(s) of standards possibly required: Turnover of 2 000 000 GBP
per annum in each of the 3 previous financial years Public and Employer's
Liability Insurance both in the amount of 10 000 000 GBP. Consortia or
contractors who do not currently carry the required levels of insurance as
stated will be considered for shortlisting upon submission of a statement
which confirms that if they are successful, they will obtain the required
levels of insurance prior to official appointment.

IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Restricted.

VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: See point VI.4.2 below.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Belfast Health & Social Care Trust will incorporate a
minimum 10 calendar day standstill period at the point information on the
award of the contract is communicated to tenderers. This period allows
unsuccessful tenderers to seek further debriefing from the contracting
authority before the contract is entered into. Applicants have 2 working
days from notification of the award decision to request additional
debriefing and that information has to be provided a minimum of 3 working
days before the expiry of the standstill period. Such additional
information should be requested from the address in point I.1. If an
appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No.5) provide for
aggrieved parties who have been harmed or at risk of harm by a breach of
the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the Court may set
aside the award decision or order the authority to amend any document and
may award damages. If the contract has been entered into the Court may
only award damages.
