SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting entity:
RPA7178 Utility Diversions & Civil Works Framework Agreement.

performance: Works.
Realisation, by whatever means of work, corresponding to the requirements
specified by the contracting entities.

II.1.3) The notice involves: The establishment of a framework agreement.
II.1.4) Information on framework agreement: Duration of the framework
agreement Duration in year(s): 4.
II.1.5) Short description of the contract or purchase(s): RPA intends to
enter into a four year Framework Agreement for the provision of utility
diversions and related civil works. The scope of this Framework will
include, but is not limited to:
— Utility Diversionary Works, to include diversionary and protection works
to the utilities and services in the vicinity of the proposed alignments
including the diversion of water, sewage, gas, telecommunication,
electricity and other services,
— Construction of elements of metro and light rail infrastructure
including highway junction reconfiguration, sub-station civil works,
Overhead Cantenary System (OCS) foundations, track drainage, manholes and
ducting,
— Other civil elements associated with the accommodation works phase of
projects.
The procurement process in relation to the Framework Agreement is fully
described in a separate information memorandum and pre-qualification
questionnaire (PQQ) which can be requested from the contact in I.1.

II.2.1) Total quantity or scope: It is currently anticipated that this
Framework will be for the provision of Utility Diversions and Civil Works
required by RPA in connection with any RPA projects.
II.2.2) Options: No.
II.3) DURATION OF THE CONTRACT OR TIME LIMIT FOR COMPLETION: Duration in
months: 48 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: As per Framework Agreement.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: As per Framework
Agreement.
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: RPA intends awarding one or more
framework agreement(s) for the above works. If a tender is submitted by a
group (more than one contractor(s), if awarded the framework agreement,
may be required to assume such legal form by incorporation, partnership or
otherwise as will enable them to contract as a single entity. It may
become necessary for the group to state a single addressee responsible for
the receipt and processing of the participating orders and resolving any
problems relating to the Framework Agreement. RPA reserves the right to
disqualify any group or consortium which makes changes to the composition
of the group after pre-qualification without the consent of RPA.

address at Section I.1. This will be used to determine the
economic/financial and technical capacity of the applicants.The average
annual turnover of the candidate over the last 3 years must be equal to or
greater than the levels set out in the PQQ.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: A PQQ is available from the address at
Section I.1. This will be used to determine the economic/financial and
technical capacity of the applicants.

VI.3) ADDITIONAL INFORMATION: It is currently anticipated that a number
of panels will be established within the framework.
RPA will not be responsible for any costs, expenses or charges incurred by
candidate or tenderers involved in this process.
Award of Framework Agreements will be subject to the approval of the
competent authorities.
Award of Framework Agreements may be subject to successful interview.
Candidates are advised that RPA is subject to the Freedom of Information
Acts 1997 and 2003 (as amended). If a candidate considers that any of the
information supplied as part of this procurement procedure should not be
disclosed because of its commercial sensitivity, confidentiality or
otherwise, they must, when providing this information, clearly specify the
reasons for its sensitivity. Please note, it is not sufficient to include
a statement of confidentiality encompassing all the information provided
in the response.
Any Framework Agreement award will be subject to the production of a
current tax clearance certificate from the Revenue Commissioners in
Ireland or, for a non-resident, a statement from the Revenue Commissioners
in Ireland confirming suitability on tax grounds.
Where a candidate is a consortium, each member may be required to contract
on the basis of joint and several liability.
