SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
UK-Leicester: facilities management (2817/08).
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.
Service category: No 14.
Main place of performance: East Midlands.
NUTS code: UKF.
II.1.5) Short description of the contract or purchase(s): Leicestershire
County Council.
Cleaning and facilities management (FM) services for specific County
Council and other municipal buildings across the County of Leicestershire
and in adjacent neighbouring areas.
Requirement is divided into the following 6 lots:
LOT 1: Building Cleaning, comprising: daily and periodic internal building
cleaning; internal and external window cleaning; replenishment of washroom
supplies; management of internal waste and recycling.
LOT 2: Kitchen and high level cleaning, comprising: periodic cleaning of
all internal high level areas, including walls, ceilings, light fitting,
extractor fans and equipment, 'deep' cleaning and degreasing of kitchens.
LOT 3: Premises support, comprising: janitorial and caretaking duties
(including locking/unlocking buildings, porterage, preparation of meeting
rooms, internal mail handling and distribution); basic building
maintenance (handyperson role).
LOT 4: Security services, comprising: key holding; remote monitoring;
manned patrols at sensitive sites; fully staffed positions at the
Council's principle offices.
LOT 5: Waste collection and recycling, comprising: collection of residual
waste, office-grade paper, and other recyclables; collection of specialist
waste at key sites.
LOT 6: Grounds maintenance, comprising: general grounds maintenance
(including grass cutting, hedge cutting, path clearing, maintenance of
sports pitches and playing fields).
The Council will be seeking to award a contract (or contracts) which
offers best value (price and quality) for provision of the above services.
The Council is keen to approach the delivery of these services
holistically, and therefore welcomes expressions of interest from
suppliers of holistic FM services (i.e. tenders covering more than one
service lot). However expressions of interest for single lots (or any
other combination of the above services) from specialist service providers
are also welcome.
In addition to meeting the direct requirements of Leicestershire County
Council, the contract scope will include requirements of the Councils
partner organisations (which include schools in Leicestershire and
neighbouring authorities, fire police and ambulance services, district and
borough councils in Leicestershire and neighbouring counties, and
neighbouring county councils and unitary authorities.
Note that for some of the above lots, the provisions of the Transfer of
Undertakings (Protection of Employment) Regulations 2006 may apply.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Depending upon the extent of services
contracted for, from the options described in II.1.5 and II.1.6 above, the
contract value is estimated at between the ranges set out below.
Applicants are advised that these estimates are annual values, and relate
only to services to Leicestershire County Council. Values will be
accordingly higher in the event that partner organisations (described in
II.1.5) elect to participate in the contract. (Such rights to participate
may be exercised at any time before the expiry date of the contract.).
Estimated value excluding VAT:
Range: between 750 000 and 3 500 000 GBP.
II.2.2) Options: Yes.
Description of these options: 1. Options relating to the scope of services
to be provided under the contract are described in section II.1.5 above.
2. Options relating to the number of client bodies to whom services will
be provided are also described in section II.1.5 above.
3. An option also exists to extend the contract in whole or in part by up
to 36 months beyond the initial five-year contract term.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Starting:
1.10.2009. Completion: 30.9.2014.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: A performance bond likely to
be to a value equivalent to 10 % of the annual contract value will be
required.
A parent company guarantee will be required when a wholly-owned subsidiary
company which does not in its own right have the financial capacity to
tender is accepted onto the select tender list.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Joint and several liability.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: (a) is
bankrupt or is being wound up, where his affairs are being administered by
the court, where he has entered into an arrangement with creditors, where
he has suspended business activities or is in any analogous situation
arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an
order for compulsory winding up or administration by the court or of an
arrangement with creditors or of any other similar proceedings under
national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata
in accordance with the legal provisions of the country of any offence
concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means
which the contracting authorities can demonstrate;
(e) has not fulfilled obligations relating to the payment of social
security contributions in accordance with the legal provisions of the
country in which he is established or with those of the country of the
contracting authority;
(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which he is
established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information
required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal
organisation, as defined in Article 2(1) of Council Joint Action
98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in
Article 3 of the Council Act of 26 May 1972 and Article 3(1) of Council
Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of
Article 1 of the Convention relating to the protection of the financial
interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined
in Article 1 of Council Directive 91/308/EEC of 10 June 1991 on prevention
of the use of the financial system for the purpose of money laundering.
Applicants will be required to declare in an application form available
from ESPO that none of the above disqualifying conditions applies.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: (a) appropriate
statements from banks or, where appropriate, evidence of relevant
professional risk indemnity insurance;
(b) the presentation of balance-sheets or extracts from the
balance-sheets, where publication of the balance-sheet is required under
the law of the country in which the economic operator is established;
(c) a statement of the undertaking's overall turnover and, where
appropriate, of turnover in the area covered by the contract for a maximum
of the last 3 financial years available, depending on the date on which
the undertaking was set up or the economic operator started trading, as
far as the information on these turnovers is available.
The exact information called for will be specified in the application form
available from ESPO.
Minimum level(s) of standards possibly required: Applicants will normally
be required a) to possess a sound current financial situation and recent
trading record; b) to have an annual turnover at least 6 times higher than
the annual value of the proposed contract; and c) to be rated not worse
than 'below average risk' by any of the reputable independent business
information providers from whom ESPO may obtain a business report.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: (b) a list of the principal deliveries
effected or the main services provided in the past 3 years, with the sums,
dates and recipients, whether public or private, involved. Evidence of
delivery and services provided shall be given: - where the recipient was a
contracting authority, in the form of certificates issued or countersigned
by the competent authority, - where the recipient was a private purchaser,
by the purchaser's certification or, failing this, simply by a declaration
by the economic operator;
(h) a statement of the average annual manpower of the service provider or
contractor and the number of managerial staff for the last 3 years;
(j) an indication of the proportion of the contract which the services
provider intends possibly to subcontract;

Applicants will be required to demonstrate a successful recent track
record of relevant service delivery to clients of comparable size and
complexity to Leicestershire County Council. At least 3 good references
will be expected.
Evidence of an understanding of the principles of partnership working will
be expected.
Evidence will be required of the applicant's satisfactory contract
management structure and processes, and their experience in successfully
managing a large workforce (including managing large-scale staff
transfers).
Subcontracting procedures must show clearly how subcontractors are
assessed, and how the required contract standards will be upheld when
services are delivered using subcontractors.
Notwithstanding other factors, preference will be given to applicants who
hold a recognised quality assurance accreditation, and/or operate a formal
staff development scheme, and/or adhere to a recognised environmental
standard (e.g. EMAS).
Applicants who have incurred a higher than average for the industry
concerned level of accidents, or other prosecutions or infringements under
heath and safety at work legislation, are unlikely to be invited to
tender.
Minimum level(s) of standards possibly required: Applicants will be
required to demonstrate a successful recent track record of relevant
service delivery to clients of comparable size and complexity to
Leicestershire County Council. At least 3 good references will be
expected. Evidence of an understanding of the principles of partnership

IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Restricted.
IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged minimum number: 5. Maximum number: 10
Objective criteria for choosing the limited number of candidates: Note
that the envisaged number of operators stated above are per each of the
six contract lots. Applications are invited in respect of any number of
lots.
Applicants who do not meet the qualifying standards set out in III.2.2 and
III.2.3 above may at Leicestershire County Council's discretion be
eliminated from further consideration.
Other criteria against which applicants will be assessed, and their
approximate weightings, are:
Experience (including refernces): 40 %.
Quality assurance measures: 15 %.
Subcontracting arrangements: 10 %.
Management structure: 10 %.
Staffing and staff transfers: 15 %.
Other factors (sustainability, equalities, organisational culture): 10 %.

VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: ESPO will incorporate a minimum 10 calendar day
standstill period at the point information on the award of contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have two working days from the notification of
the award decision to request additional debriefing and that information
has to be provided a minimum of 3 working days before the expiry of the
standstill period. Such information should be required from the address
stated in section 1.1. If an appeal regarding the award of a contract has
not been successfully resolved the Public Contracts Regulations 2006 (SI
2006 No 5) provide for aggrieved parties who have been harmed or are at
risk of harm by a breach of the rules to take action in the High Court
(England, Wales and Northern Ireland). Any such action must be brought
promptly (generally within 3 months). Where a contract has not been
entered into the Court may order the setting aside of the award decision
or order the authority to amend any document and may award damages. If the
contract has been entered into the Court may only award damages.
