to tender is divided into 2 lots and its main aim is to identify companies
able to help the 'Communication, press and protocol' Directorate of the
Committee of the Regions carry out communications activities in the
following fields:
lot 1: graphic design, layout and production of various types of
communication products and support material:
— on paper: posters, decorative materials for premises, brochures and
informative pamphlets, invitation cards and other items,
— using electronic media: website and other pages,
— using other media: textiles, gadgets and other means;
lot 2: drafting, final drafting, translation, coordination and production
(not including printing) of informative, promotional and other types of
document.

Section III: Legal, economic, financial and technical information
III.1) Conditions relating to the contract
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Payments will only
be made if the contractor has fulfilled all his contractual obligations on
the date of dispatch of his invoice. Requests for payment will not be
admissible if payments for preceding orders have not been made owing to an
omission or an error on the part of the contractor. The Committee has a
10-day period, from receipt of the order, in which to approve the work
carried out. The contractor will have 10 days in which to submit
additional information or the necessary corrections. To be valid, the
contractor's requests for payment must include the relevant invoice(s),
stating the reference number of the related contract and order, provided
that the Committee has approved the order. The payment corresponding to
the relevant invoice(s) will be made within 45 days of receipt of said
invoice(s).
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: Tenders may be submitted by groupings
of service providers/suppliers, who will not have to adopt a particular
legal form prior to the contract being awarded. However, a grouping of
companies must nominate 1 party to be responsible for the receipt and
processing of payments for members of the grouping, and for management and
coordination of the service. The documents required under point III.2 must
be provided by all grouping members. Each member of a grouping is jointly
and severally liable vis-à-vis the Committee of the Regions.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating whether requirements have been met:
tenderers must provide a solemn declaration duly signed and dated, stating
the following information:
— name of the economic operator,
— official name of the company or organisation,
— official legal form,
— official registration number,
—VAT number,
— name of the person who will sign this form (person legally authorised to
represent the tenderer or candidate with regard to third parties and
acting on behalf of the above-mentioned company or organisation). The
declaration provided by the tenderer must also contain the following
information regarding the exclusion criteria, stating that their
organisation:
situations leading to disqualification from taking part in a contract:
(a) is not bankrupt or being wound up, its affairs are not being
administered by the court, it has not entered into an arrangement with
creditors or suspended business activities, is not the subject of
proceedings concerning these matters and nor is it in any analogous
situation arising from a similar procedure under national laws or
regulations;
(b) has not been convicted of an offence concerning professional conduct
by a judgment which has the force of res judicata;
(c) has not been guilty of grave professional misconduct proven by any
means the contracting authority can justify;
(d) has fulfilled its obligations relating to the payment of
social-security contributions or taxes in accordance with the legal
provisions of its country of residence or those of the country of the
contracting authority or those of the country where the contract will be
carried out;
(e) has not been the subject of a judgment which has the force of res
judicata for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
(f) is not subject to an administrative penalty as laid down in Article
96(1) of Council Regulation (EC, Euratom) No 1605/2002 of 25.6.2002 (OJ L
25, 30.1.2003) on the Financial Regulation applicable to the general
budget of the European Communities, as amended by Council Regulation (EC)
No 1995/2006 of 13.12.2006 (OJ L 390, 30.12.2006).
Cases of disqualification from contract award:
tenderers will not be considered for contract award if, at the time of the
procurement procedure, they:
1) are subject to a conflict of interests;
2) are guilty of misrepresentation in providing the information required
by the contracting authority in order to take part in the contract, or
have not provided said information;
3) are in any of the situations giving grounds for exclusion from the
award procedure for this contract referred to in points (a) to (f) above.
By returning the duly signed form, the signatory accepts that, should he
be awarded the contract, he must provide, within the timescale defined in
writing by the contracting authority and before contract signature, the
following documentary evidence in support of the solemn declaration:
— recent extract from the judicial record or, failing this, an equivalent
document recently issued by a judicial or administrative body in the
country of origin or provenance, stating that he is not bankrupt or being
wound up, his affairs are not being administered by the court, he has not
entered into an arrangement with creditors, has not suspended business
activities, is not the subject of proceedings of this nature, nor is in
any analogous situation arising from a similar procedure under national
laws or regulations,
— recent extract from the judicial record or, failing this, an equivalent
document recently issued by an appropriate judicial or administrative body
in the country of origin or provenance, stating that he has not been the
subject of a judgment which has the force of res judicata for an offence
concerning his professional conduct or for fraud, corruption, involvement
in a criminal organisation or for any other illegal activity detrimental
to the Communities' financial interests,
— recent certificate issued by an appropriate body in the country in which
he resides, or those of the contracting authority's country or the country
in which the contract is to be carried out, stating that he has fulfilled
his obligations in respect of payment of social-security contributions,
— recent certificate issued by an appropriate body in the country
concerned, stating that he has fulfilled his obligations in respect of
payment of taxes (direct taxes and VAT) in accordance with legal
provisions in the country in which he resides, or those of the contracting
authority's country or the country in which the contract is to be carried
out,
— any document (such as an appropriate declaration or certificate issued
by a judicial or administrative body in the country of origin or
provenance) proving that the tenderer has not been guilty of grave
professional misconduct and has not been declared to be in serious breach
of contract for failure to comply with his contractual obligations
following another procurement procedure or grant award procedure financed
by the Community budget. Where no such documents or certificates are
issued in the country concerned, they may be replaced by a statement under
oath, or failing that, a solemn declaration made by the tenderer before a
judicial or administrative body, a notary or a qualified professional body
in the country of origin or provenance. Groupings of companies must
provide the necessary solemn declaration, and supporting documents in the
event they are awarded the contract, for each individual member.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating whether requirements have been met: proof of such
capacity can be provided by the following means:
— balance sheets or summaries thereof for the past 2 financial years for
which accounts have been closed,
— statement as to overall turnover and turnover for the services referred
to in the contract, achieved over the past 3 financial years.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating whether requirements have been met: proof of technical
capacity, which will be assessed in particular on know-how, effectiveness,
experience, reliability and language skills, must be provided by the
following means of proof:
* presentation of the company with detailed organisation chart showing:
— structure, organisation of the company,
— positions and qualifications of staff responsible for supervision and
management, and of the operational and technical staff,
— qualifications of staff directly involved in carrying out the services:
(a) details of the academic and professional qualifications of the service
provider and/or the company's managerial staff and, especially, of the
person(s) to be responsible for providing the services;
(b) tenderers must be able to prove that they have at least 3 years'
professional experience in the field covered by the lot for which they are
tendering;
(c) attach CVs and other means of proof;
* list of the main services provided over the past 3 years, giving details
of values, dates and public or private recipients of the services.
Services relating directly to the field covered by this invitation to
tender must be listed separately. Where the services were performed in
part by subcontractors, tenderers must clearly indicate the role and
contribution of said subcontractors;
* detailed list of the technical equipment, tools and materials to be used
in providing the services relating to the lot tendered for;
* statement as to tenderers' average annual manpower and the number of
managerial staff during the past 3 years;
* statement as to technical capacities of staff, and in particular of the
team actually responsible for providing the services in this invitation to
tender. Tenderers should name the people primarily responsible for
carrying out, coordinating and supervising the work, highlighting the
extent of their experience and expertise in the area in question, their
position within the company, their knowledge of European issues, and any
other factors which tenderers consider the CoR should be aware of;
* statement as to linguistic capacities of staff, and in particular of the
team actually responsible for providing the services in this invitation to
tender. Tenderers should name the people primarily responsible for
performing, coordinating and supervising the work, highlighting the extent
of their experience of working in English and in French — tenderers must
have within their team (or already arranged as subcontractors) at least 1
person whose command of English is equivalent to 'mother-tongue' level,
and at least 1 person whose command of French is equivalent to
'mother-tongue' level. In-depth knowledge of other European languages is
an advantage;
* details of the proportion of the contract tenderers may intend
subcontracting (limited to 50 % maximum), including a description of
subcontractors already selected by tenderers, upon whom they may call to
carry out certain types of work. The successful tenderer must provide a
signed statement giving details about the above-mentioned subcontracting.
