II.1) Description

framework agreement:

II.1.5) Short description of the contract or purchase(s): To provide
services which include, but are not limited to, the following:
1. The surveillance and patrolling of the premises with a view to avoiding
any intrusion and attack on persons and/or their belongings;
2. The control of access to the premises by visitors;
3. The operation of a VHF radio network for communication between the
premises, linking all the premises to a central operations centre to be
manned by operators provided by the company;
4. The immediate intervention by use of rapid response or back-up unit to
any of the premises in the event of an incident;
5. Appropriate clocking of night guards in the premises every half hour or
as may be instructed from time to time;
6. The provision of additional services as may be requested by the
Commission (e.g. during functions or escorts for up-country missions).
These additional services are paid on an hourly basis plus predetermined
reimbursable expenses, and are to be invoiced separately;
7. The provision of an armed quick reaction team with a guaranteed
response time of less than 10 minutes after activation of the panic button
system.

of the procedure to which this contract notice relates.

III.1) Conditions relating to the contract
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) Conditions for participation
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met:
1. Company details including, full name, physical address, postal address,
telephone and fax numbers, e-mail address, main activity of the tenderer,
name and signature of the person authorised to represent the company.
2. Certificates proving legal constitution and registration of the company
as well as certificates of registration with the relevant tax authorities
in Uganda or in the country of registration.
3. A licence to operate issued by the Inspector General of Police issued
under section 73 of the Police Act No. 13 of 1994.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met:
candidates shall be excluded from participation in this procurement
procedure if:
(a) they are bankrupt or being wound up, are having their affairs
administered by the courts, have entered into an arrangement with
creditors, have suspended business activities, are the subject of
proceedings concerning those matters, or are in any analogous situation
arising from a similar procedure provided for in national legislation or
regulations;
(b) they have been convicted of an offence concerning their professional
conduct by a judgment which has the force of res judicata;
(c) they have been guilty of grave professional misconduct proven by any
means which the contracting authority can justify;
(d) they have not fulfilled obligations relating to the payment of social
security contributions or the payment of taxes in accordance with the
legal provisions of the country in which they are established or with
those of the country of the contracting authority or those of the country
where the contract is to be performed;
(e) they have been the subject of a judgment which has the force of res
judicata for fraud, corruption, involvement in a criminal organisation or
any other illegal activity detrimental to the Communities' financial
interests;
(f) they are currently subject to an administrative penalty for having
been found guilty of misrepresentation in supplying the information
required by the contracting authority as a condition of participation in a
procurement procedure or for failing to supply this information, or having
been declared to be in serious breach of their obligations under contracts
covered by the budget of the contracting authority.
Candidates must provide a written declaration sworn before a Commissioner
of Oaths or a Notary Public affirming that none of the above criteria
apply to their company.
In addition, candidates must provide:
1. Certificates proving consistency in making payments for taxes (or in
their absence, solemn declarations from the relevant authorities attesting
that the company has been consistent in paying such taxes).
2. Statements showing the company's financial capability for the last 3
financial years (not before year 2005):
— turnover statement — demonstrating an annual turnover exceeding UGX 2
500 000 000 (EUR 1 000 000) for each of the last 3 years;
— balance sheets — extracted from the company's audited accounts and
indicating a positive net assets position for each of the last 3 years.
3. Certificates proving insurance cover for the company's activities,
specifically risk cover notes for either public liability insurance or
professional liability insurance.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met:
1. Information, including copies of contracts or written testimonials, on
similar services in Kampala rendered to at least 5 named clients in the
last 3 years, especially those services provided to international or
foreign companies, diplomatic missions or representations of international
organisations.
2. Information on the facilities and resources available to the company to
ensure the quality of the services.
These include:
— tools and equipment;
— motor vehicles and back-up units;
— offices, workshops, garages, other physical facilities;
— means of communication e.g. VHF/HF radio and radio control room
facilities;
— guard monitoring systems;
— panic button/alarm installation and maintenance facilities.
3. Information on staff numbers over the last 3 years:
— the number of permanent administrative (managerial) staff;
— the number of guards broken down into ranks/categories;
— the number of other technical (operational) staff such as radio
controllers, radio operators, inspectors, supervisors, back-up units,
other emergency units and alarm technicians.
4. Description of the training given to all groups of operational staff —
guards, supervisors, inspectors, radio operators, radio controllers,
back-up units, other emergency units and alarm technicians.
5. Information on the quality standards to which the company's services
comply.

concerning licences to operate issued to private security companies by the
