II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The Isle of Wight Council wishes to
develop two new learning facilities on the Cowes High School Site. The
Project is in 3 phases: - The design and construction of a learning
facility for 14-19 year olds. - The design and construction of a new
learning facility for 11-14 year olds. - Demolition of the old school and
making good to the clients specification. The Council has secured funding
for phase 1 and the contract may be extended to cover phases 2 and 3
should it be successful it accessing additional funding. Phase 1: For The
Council has developed a brief to RIBA Stage B and is looking for a design
and build contractor or consortium that can take that brief, develop the
design through the construction phase to RIBA Stage L. Phase 2: The
Council is committed to completing a feasibility study for this phase. It
is therefore looking for contractors to use the feasibility and take that
brief, develop the design through the construction phase to RIBA Stage L.
Phase 3: To demolish the existing school building which contains some
asbestos.
Estimated value excluding VAT:
Range: between 17 000 000,00 and 36 000 000,00 GBP.
II.2.2) Options: Yes.
Description of these options: The contractor will be asked to submit 4
options: 1) Passive Haus. 2) Bream Very good with inhancements. 3)
Innovatative option. 4) Contractors option.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 84 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: A performance bond and/or a
parent company guarantee may be required.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: As per contract
documentation.

whom the contract is to be awarded: The Council reserves the right to
require bidders to take legal form, or to require 1 party to take primary

III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Bidders will
be required to complete a Pre-qualification Questionnaire (PQQ)which the
Council will use to evaluate their economic and financial standing,
technical capacity and ability to ensure they meet the Councils minimum
requirements. This PQQ must be returned by xxxx and to Candace
Bloomfield-Howe, Deputy Head of Procurement, Isle of Wight Council, County
Hall, High Street, Newport, Isle of Wight PO30 1UD.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: As per PQQ including
submission of audit accounts for the past 3 years, statement of turnover
in respect of the supply of similar services and adequate insurance cover.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: As per PQQ including staff type/skills
to be allocated to the contract and experience of undertaking similiar
types of work.

SECTION IV: PROCEDURE
IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Restricted.
IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged minimum number: 5. Maximum number: 10
Objective criteria for choosing the limited number of candidates: Probity
ecconomic and financial standing technical ability.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: The project is subject to sufficient
funding being secured. A Bond or parent guarantee may be required. Any
contractor who responds to this notice has the opportunity to attend an
open day. It is anticipated that this day will be during the week
commencing 14.7.2008 but this is subject to change. Contractors are not
obliged to attend but may benefit from seeing the site and how it
operates. The contract may be subject to 1 or more extensions upto a
period of 84 in total at the Council's discretion. Further information
will be provided in the tender documentation. The period shown in the
Duration of Contract Section is an estimate and includes the possible
extension period. The contract shall be as a contract made in England and
according to English Law and subject to the exclusive jurisdiction of the
English Courts. Tenders and all supporting documents must be priced in
sterling and all contract payments will be made in sterling. All
discussion and/or meetings will be conducted in English. The contracting
authority reserves the right not to make any award and reserves the right
to accept all or part of any tender expressly stipulates otherwise in the
tender. The Freedom of Information Act (FOI) 2000 which came into force on
1.1.2005 applies to the contracting authority. If any tenderer considers
that any information supplied by them is either commercially sensitive or
confidential in nature, this should be highlighted and the reasons for its
sensitivity specified. In such cases the relevant material will, in
response to FOI requests be examined in light of the Act.
VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: The High Court, The Royal
Courts of Justice, The Strand, UK-London WC2A 2LL.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Proceedings may not be brought unless the economic
operator bringing the proceedings has informed the contracting authority
of the breach or anticipated breach of the duty owed to it by the
contracting authority and of its intention to bring proceedings, and
unless those proceedings are brought promptly and in any event within 3
months of the date when grounds for the bringing of proceedings first
arose, unless the Court considers that there is good reason for extending
the period within which proceedings can be brought. \
Precise information on deadline(s) for lodging appeals: The award of a
contract will incorporate a minimum 10-calendar-day standstill period at
the point information on the award of the contract is communicated to
tenderers. This period allows unsuccessful tenderers to seek further
debriefing from the contracting authority before the contract is entered
into. Applicants have 2 work days from the notification of the award
decision to request additional debriefing and that information has to be
provided a minimum of 3 working days before the expiry of the standstill
period. Such additional information should be required from contact point
at I.1. If an appeal regarding the award of a contract has not been
successfully resolved the United Kingdom's Public Contracts Regulations
2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or
are at risk of harm by a breach of rules to take action in the High Court
(England, Wales and Northern Ireland). Any such action must be brought
promptly (generally within 3 months). Where a contract had not been
entered into the Court may only award damages. (The purpose of the
standstill period referred to above is to allow parties to apply to the
Courts to set aside the award decision before the contract is entered
into).
