REQUIREMENT:
Waterfront Toronto intends to award a contract to Toronto Hydro on an as-required basis to be responsible for providing hydro supply services related to multiple civil infrastructure projects within the Waterfront Lands within the City of Toronto. The hydro services will relate to design and construction of hydro distribution infrastructure for the revitalization and will only involve works proprietary to Toronto Hydro Electric System.

All noted services will be performed on lands specifically within the areas designated as Central Waterfront, East Bayfront, West Don Lands, Lower Don Lands and the Portlands (known as the waterfront revitalization area).

The Contractor shall provide labour, materials and equipment as relevant in removing and/or relocating existing hydro infrastructure to support road closures or reconstruction of existing roads as well as designing and installing new hydro supply to the revitalized areas within the Central Waterfront, East Bayfront, West Don Lands, Lower Don Lands and Portlands areas.

Pursuant to Clause 3.2.15 of the Ontario Energy Board, Distribution System Code – last revised on June 27, 2007 (originally issued July 14, 2000); the following work shall be uncontestable:
a)    the preliminary planning, design and engineering specifications of the work required for the distribution system expansion and connection (specifications shall be made in accordance with the distributor’s design and technical standards and specifications); and,
b)    work involving existing distribution assets.

MANDATORY REQUIREMENT:
The Contractor shall be the legislated authorized hydro service provider within the City of Toronto. Further, the contractor shall be the electrical distributor as licensed by the Ontario Energy Board under Part V of the Ontario Energy Board Act 1998.

QUALIFICATIONS:
The Contractor’s primary representative must hold a valid Professional Engineering License in Ontario and the contractor must be approved by the local hydro authority to perform the work.

CONTRACT PERIOD:
The contract will cover a 5-year period, commencing as soon as possible. It is intended to award a service contract to the contractor with a value of $15,000,000 and upwards.

Toronto Hydro Electric System is the only authorized entity to provide hydro services within the City of Toronto. Designated design and planning services to be provided on behalf of Toronto Hydro Electric System by:

SOLE SOURCE JUSTIFICATION IS SUPPORTED BY THE FOLLOWING:
Government Contracting Policy, Section 10.2.1 (d):
"only one person or firm is capable of performing the contract".

The unique skills and competence needed to assume this role are not readily available within the market place. The sole source option is supported to maintain a quality and proven service in this regard and address proprietary issues.

Suppliers who consider themselves fully qualified and available to provide the services described herein, may submit a statement of capabilities in writing to the Contracting Authority identified in this Notice on or before fifteen (15) calendar days.

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. Statement of capabilities must be mailed or faxed on or before the closing date. Statement of capabilities received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a competitive procurement. Information provided will be used by Waterfront Toronto for technical evaluation purposes only and is not to be construed as a competitive solicitation.

Suppliers that have submitted a statement of capabilities will be notified in writing of Waterfront Toronto’s decision to continue with the non-competitive procurement or to submit the work for competitive tendering.

WHAT IS AN ADVANCE CONTRACT AWARD NOTICE:
An Advance contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a goods, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded.

If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
