II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Supply of
Banking Services to the Scottish Ministers (including Agencies), Scottish
Non-Departmental Public Bodies, offices in the Scottish Administration
which are not ministerial offices, cross-border public authorities within
the meaning of section 88(5) of the Scotland Act 1998, the Scotland
Office, the Scottish Parliamentary Corporate Body, special health boards,
any public body established by or under the Scotland Act 1998 or any Act
of the Scottish Parliament, any association of or formed by one or more of
the above, bodies financed wholly or mainly by one or more of the above,
bodies subject to management supervision by one or more of the above and
bodies more than half of the board of directors or members of which, or,
in the case of a group of individuals, more than half of those
individuals, being appointed by one or more of the above. The Scottish
Ministers are inviting tenders for a contractor to provide commercial
banking services to include local banking services, merchant acquiring
facilities and ATM facilities. The scope of the contract may also include
cash handling services. The contract will be for a 3 year period with the
option of a further 12 month extension.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: This is a framework contract. The
quantity and scope of work under the Contract will depend on individual
users' requirements. Such requirements are difficult to predict but it is
estimated that the total value for the duration of the contract will be
between £1 000 000 to £1 500 000. Further information on quantity or scope
will be provided in the contract documents.
II.2.2) Options: Yes.
Description of these options: Up to one additional year after the initial
3 year term.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 48 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: A parent Company Guarantee may
be required from applicants who operate within a larger trading group of
companies. Guarantees may also be required from banks. Cover for
professional indemnity, employer liability and public liability will be
required.

whom the contract is to be awarded: Where a consortium or other grouping
of contractors submits a bid, the parties in the grouping will be bound
jointly and severally. Such consortia or grouping must nominate a lead
member to deal with Scottish Government on all matters relating to this
procurement exercise.

tendering for this contract. The Scottish Government reserves the right to
award a contract for any or all of the requirements described.
VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: See V1.4.2.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Scottish Ministers will incorporate a minimum 10
calendar day standstill period at the point of information on the award of
the contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill period. Such additional information should be
requested from the address stated at 1.1 of this notice. If an appeal
regarding the award of the contract has not been successfully resolved The
Public Contracts (Scotland) Regulations 2006 (SSI 2006 No.1) provide for
the aggrieved parties who have been named or at risk of harm by a breach
of the rule to take action in the Sheriff Court of Session. Any such
action must be brought promptly (generally within 3 months). Where a
contract has not been entered into the Court may order the setting aside
of the award decision or order the authority to amend any document and may
award damages. (The purpose of the standstill period referred to above is
to allow parties to apply to the Courts to set aside award decision before
the contract is entered into.).
