SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Tender for the supply, installation and maintenance of photovoltaic
systems on Governmental Buildings, Public Schools and Army Camps.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Supplies.
Purchase.
Main place of delivery: Cyprus:65 Buildings located all over the Island
(Paphos, Limassol, Nicosia, Larnaka, Ammochostos).
NUTS code: CY00.
II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): The Contract
covers the supply, installation and maintenance of photovoltaic systems on
Governmental Buildings, Public Schools and Army Camps. Totally will be
installed 19 systems of 5 KW each, 16 systems of 10 KW, 3 systems of 15
KW, 15 systems of 20 KW each, 4 systems of 25 KW each, one system of 30
KW, one system of 35 KW, one system of 40 KW, one system of 45 KW, 3
systems of 50 KW and one system of 100 KW. The project will also include
the supply of 50 portable PV-based systems for demonstration/educational
purposes.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Estimated value excluding VAT: 4 300 000
EUR.

Description of these options: Fluctuation of the quantities up to 25 %.

the award of the contract).
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 9 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: 1. Each Tender shall be
accompanied by a Tender Guarantee for the amount of two hundred fifty
thousand euro (€250.000) 2. The Contractor shall submit a Performance
Guarantee for an amount equal to ten per cent (10 %) of the Contract
Value. 3. The Contractor shall submit an Advance Payment Guarantee for an
amount equal to twenty per cent (20 %) of the Contract Value. 4. The
Contractor shall submit a Good Operation Guarantee for an amount equal to
three per cent (3 %) of the Contract Value. 5. In addition with the
commencement of the Maintenance Contract period, the Contractor should
provide a performance guarantee to the amount of 10 % of the total
Maintenance Contract value. All Guarantees shall be bank guarantees.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: A. An advance
payment equal to twenty per cent (20 %) of the Contract Value, after
signature of the Contract and against submission by the Contractor of an
Advance Payment Guarantee for the same amount. B. Payment equal to sixty
per cent (60 %) of the value of each photovoltaic system, against an
invoice, and after final acceptance of each system. D. Payment of the
balance (20 %) of the Contract Value after final acceptance of all
photovoltaic systems. E. Regarding the maintenance period the Contractor
will be paid at the end of each year during the five-year maintenance
period.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: Consortia are not obliged to take a
specific legal form in order to submit their Tenders. If the selected
Contractor is a consortium, then such consortium shall not be obliged to
take a specific legal form before the Contract is signed.
III.1.4) Other particular conditions to which the performance of the
contract is subject: Yes.
The Contract governed and defined exclusively by the legislation of the
Republic of Cyprus and will fall into the jurisdiction of the Cypriot
Courts.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Eligible for
participation in the present tender procedure are natural or legal persons
(governed by public or private law) or consortia of natural and/or legal
persons lawfully established in Cyprus or in any other Member State of the
European Union (EU) or of the European Economic Area (EEA) or in third
countries who have signed and ratified the International Government
Procurement Agreement (GPA) or have signed and ratified association
agreements or bilateral agreement with the EU or with the Republic of
Cyprus. More details listed in the tender documents.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: 1. Average annual
turnover for the last three (3) financial years.
Minimum level(s) of standards possibly required: 1. For the manufacturers
of the photovoltaic modules must be at least equal to five million euro (€
5 000 000,00). 2. For the Tenderers must be at least equal to two hundred
thousand euro (€ 200 000).
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: A) For the Manufacturers of the
photovoltaic modules: 1. They must possess, and be able to document
adequately, know-how and experience in the implementation of contracts
similar to the contract being put out to tender and, more specifically,
they must be able to document their know-how, reliability, effectiveness
and experience in the production, delivery installation and maintenance of
photovoltaic systems. 2. They must, during the last three (3) years, have
completed successfully at least two (2) contracts, with a budgeted cost
amounting to at least one million (€1 000 000) euro and having as their
scope the supply of photovoltaic systems, with a minimum participation
rate of seventy per cent (70 %). The term “completed” shall mean that
implementation of the respective contract is at least 80 % complete. B)
For the Tenderers: 1.They must possess, and be able to document
adequately, know-how and experience in the implementation of contracts
similar to the contract being put out to tender and, more specifically,
they must be able to document their know-how, reliability, effectiveness
and experience in the delivery, installation and maintenance of
photovoltaic systems. 2. They must, during the last three (3) years, have
supplied and installed at least, twenty (20) photovoltaic systems of at
least 5KW each or photovoltaic systems of total power of at least 100 KW.
3.The number of natural persons permanently employed by the interested
economic operator, on average during the last three (3) years, should not
be less than four (4). 4. Interested economic operators should be
certified in accordance with the CYS EN ISO 9001:2000 of Cyprus standards,
or hold some other equivalent certification issued by Organisations
established in Member States of the European Union or other proof of the
existence of equivalent quality assurance measures. 5. They must include
in the proposed Project Team personnel whose qualifications shall cover
the following: A) Project Manager: 1. Education – University Degree 2.
Professional Memberships –N/A 3. Professional Experience – Minimum 5 years
in project management. 4. Skills – Project management, Team management,
Communication and Engineering skills. B) Electrical Engineer 1. Education
– University Degree 2. Professional Memberships – Member of ETEK (Cyprus
Scientific and Technical Chamber) or equivalent engineering institution of
EU member country. 3. Professional Experience – Minimum 3 years of which
the 1 year will be in the field of photovoltaic systems installation. 4.
Skills – Engineering, Photovoltaic systems design and installation. C)
Electrician 1. Education – High school or technical school graduate. 2.
Professional Memberships – Approved from EMS (Electromechanical Services)
for electrical installations or equivalent institution of EU member
country. 3. Professional Experience – Minimum 3 years of which the 1 year
will be in the field of photovoltaic systems installation. 4.Skills –
Photovoltaic systems wiring. D) Installation Technician 1. Education –
N/A. 2. Professional Memberships – N/A Professional Experience – Minimum 2
years of which the 1 year will be in the field of photovoltaic systems
installation. 3. Skills – Photovoltaic systems installation.

SECTION IV: PROCEDURE

Terms and method of payment: A. All economic operators wishing to acquire
the Tender Documents shall send to the Contracting Authority a letter, a
fax or an email stating their interest in participating in the Tender and
indicating their full contact details (business name, address, telephone
number, fax number, email etc). Requests for obtaining the Tender
Documents shall be accepted not later than six (6) days prior to the
Tender Deadline. B. Economic operators shall pay (€500) EUROS VAT
excluded, for obtaining one (1) hard copy and one (1) electronic copy of
the Tender Documents. The electronic copy shall not contain the drawings
of Annex VI. C. The payment can be made by any of the following three
methods: •By cheque, crossed A/C payee only and made payable to: The
Permanent Secretary, Ministry of Commerce, Industry and Tourism. •By cash
to the Accounts Department, Ministry of Commerce, Industry and Tourism, 6
Andrea Araouzou Street, 1421 Nicosia, Cyprus. •By bank transfer to the
Central Bank of Cyprus for the credit of the Government General Account,
IBAN: CY16 0010 0001 0000 0000 0600 1010, or in the event of a bank
transfer from a bank operating abroad to the SOCIETE GENERALE Paris (Swift
code: SOGEFRPP), for the credit of the Account No. IBAN: FR76 3000306990
00301554039 94 of Central Bank of Cyprus (Swift Code CBCYCY2N) for further
credit to Government General Account, IBAN: CY16 0010 0001 0000 0000 0600
1010, in favour of the Ministry of Commerce, Industry and Tourism,
Photovoltaic Systems Tender Documents. D. Economic operators or their
authorised representatives shall deliver by hand or by fax to the
Contracting Authority the receipt of payment or a copy of the bank’s debit
advice showing the transfer transaction details in order to receive the
Tender Documents.

arrival at the place where the tender procedure is conducted, a relevant
